Trial setting for a third jury trial for convicted molestor Steve Boudreaux is scheduled for 5/7.
Boudreaux was convicted of Count 6 in the first trial and a hung jury on the remaining counts. The second jury trial on the remaining counts ended in the jury being hopelessly deadlocked and a mistrial was declared.
I was just going to add the 4/15 court minutes to the last post. Court minutes do not always tell all the details and can be inaccurate. Defense had a motion to continue scheduled on 4/17 which was vacated as was the 4/21 date. The People may have joined on the motion to continue so the assigned prosecutor could be present.
I have followed this case and the two previous trials. I checked with Deputy District Attorney Whitney Timm to see if a plea was in the works and am glad I did. It is too early to think there will be a resolution.
Deputy DA Roger Rees appeared on the case for Ms. Timm for that hearing. Deputy Public Defender Casey Russo is Boudreaux's attorney.
Court minutes say the continuance was a possible resolution. That may happen but that is the possibility for any case. Boudreaux's phone has been sent to another agency. Depending on what is discovered, there could be a third trial and a conviction or a plea. I wanted to do this post for all the former jurors who still have an interest in this case.
