Terrostic and criminal threat suspect Daryl Ray Jones' preliminary hearing was scheduled for April 24. He is charged with 19 felonies.
The case was originally on calendar in Courtroom 3. Judge Steven Steward recused himself pursuant to PC 170.1 (a) (6) (c). Deputy District Attorney Trent Timm appeared on the case in Courtroom 3 for the sole purpose of that recusal and for the case to be sent to Courtroom 7.
Deputy District Carolyn Schaffer appeared on the case for the People. Conflict Counsel Supervising Attorney Meagan O'Connell is Jones' attorney. Ms. Joanne Carter represents the alleged victim in Count 1 and 2. She was present in court.
I had put in a media request to take his photo at this specific hearing since his booking photo cannot and is not being released. It was denied by Humboldt Presiding Judge Kelly Neel because identity may be at issue and could impact a fair and impartial trial and only denied for this proceeding.. That was also stated in court today by Judge Kelly Neel. This does not necessarily apply to future proceedings. "I don't know enough about Mr. Jones or the case to know whether there is an identity issue. I suspect there will be similar requests in the future. If that happens, we will need to schedule a hearing."
Doubt declared by defense. Judge Neel questioned Jones.
"I am having some issues," responded Jones. He said he did not know what today's proceeding was about and his responses to Judge Neel about whether he understood Ms. O'Connell's role and Ms. Schafer's role was inaudible and I could barely hear him. Jones seemed to understand why Ms. O'Connell was there.
"I think he understands to some extent but not fully" said Ms. O'Connell. "My major concern is if he can assist in his defense. I would like him assessed to make sure."
Judge Neel suspended criminal proceedings. Dr. Mark Lamers apointed to evaluate Jones. Next hearing is May 15 for Dr. Lamers' report.
Ms. Schafer just found out defense was declaring doubt this morning. This was not stated in court. It is from my observations and on scene reporting.
Jones was subdued this morning but still in a red jumpsuit and in admin segregation. I don't know if Jones was soft spoken and moving slowly because he is tired or is medicated. That health information would be confidential unless stated in court.
