Man who threatened Rex, has a restraining order, arrested for the second time by EPD within a month for violation of a court order and possession of a firearm

Frederick Breckenridge arrested again and this is the second time by Eureka Police Department yesterday for PC 273.6 (a) violating a restraining order and PC 29825 (b) possession of a firearm in violation of a court order.



He was arrested on 3/3/25 by EPD for PC 602 (m) trespassing and PC 419 tenant re-entry after eviction. The last time I saw him was on April 2 in court speaking with Deputy Conflict Counsel R.J. Leohner after Humboldt Presiding Judge Kelly Neel had denied his Marsden motion.

The DA charged Breckenridge with a felony in Count 1 PC 29825 (a) unlawful firearm activity; a misdemeanor in Count 2 PC 273.6 (a) disobeying a domestic relations court order and a misdemeanor in Count 3 PC 602.5 (a) unauthorized entry of a dwelling house.


4/17/25: At arraignment, Conflict Counsel's office appointed by Judge Lawrence Killoran. Bail $25,000. OR bail hearing on 4/21; preliminary hearing on 4/29.

4/21: OR bail continued by defense to 4/23, 2024 case to be included in supervised release report, 2024  preliminary hearing scheduled on the same day as 2025 case which is 4/29.

4/23: Supervised release denied by Judge Killoran; custody status is no bail.

4/29: Criminal proceedings suspended; defense disqualifies Judge Kaleb Cockrum; case sent to Judge Timothy Canning. Competency hearing on 5/8; Dr. Rassti reports due 5/29.

5/8: Probable cause hearing. In CR2500859, Deputy District Attorney made a motion to amend language in Count 1 and to reduce it to a misdemeanor. Retired Judge Christopher Wilson granted the motion. In CR2401531, Judge Wilson finds probable cause for Count 1; no probable cause for Counts 2 and 3. In that case, Judge Wilson denies defense PC 17 (b) motion without prejudice. Judge Wilson also denies defense request to release on OR without prejudice.



5/29/25: Found not competent. Judge Lawrence Killoran makes an interest of justice finding. Placement hearing on 6/16.

6/16/25: Placement hearing continued to 6/23 because Breckenridge's attorney, Deputy Conflict Counsel R.J. Leohner is in trial.

6/23/25: Placement hearing continued to 6/27.

6/27/25: Bail bonds exonerated; Breckenridge cannot post bail. Judge Lawrence Killoran will issue his ruling on 6/30. 

6/30/25: In both CR2500859 and CR2401531, Judge Lawrence Killoran ruled that in the interest of justice Breckenridge should participate in competency treatment. Humboldt County Mental Health appointed to perform antipsychotic med evaluation; CONREP to submit recommendation and  criminal proceedings remain suspended. Placement hearing and med evaluation scheduled for 7/30.
