Broderick Brown was arrested by CalPoly Humboldt police in May, this was a month after he filed a civil lawsuit against them

 


I covered Broderick Brown's criminal case. He was arrested in May by Cal Poly Humboldt Police for burglary and stalking. DA also added a trespass charge. He was found not competent to stand trial.  Court records show admission into the JBCT program filed 7/19. Confirmation of transport scheduled on 7/30 was vacated. Brown has a review hearing on 9/9/24. According to court records, Brown is in custody at the Humboldt jail. On 7/24, it will be 80 days.

I was checking on Brown's criminal case today and found a civil lawsuit he filed against the CalPoly Police Humboldt in April 2024. Nothing has happened yet because HCSO failed to serve a fellow, local law enforcement agency. There is a case management conference on 8/5/24. Brown is in custody, pro per. 

You can read Brown's complaint which covers June and July 2023 and alleges lack of probable cause and false police report among other claims. Whether Brown's case has merit or not, who knows. He was declared not competent to stand trial in his criminal case so CalPoly Humboldt can use that against him. He is in custody and obviously did not have money to hire a lawyer or no one wanted to take on the CalPoly machine. 

HCSO Deputy Foy Melendy unable to serve CalPoly Humboldt Police Department twice? In this case, there is a fee waiver but HCSO Deputy Seth Crosswhite  and HCSO Mela Kay were also unable to serve Aunna Bollman. I reported and have documents in that case. HCSO was paid  in the Bollman case. What is the point of paying HCSO when they can't serve papers.? Better to hire a reutable process server and not just anyone claiming to do that in Humboldt. There have been issues with private servers too but there is no excuse for HCSO. It is CalPoly Humboldt Police and you can't serve them.











8/5: Minutes from 8/5 were finally added to e court on 8/8. Dismissal hearing scheduled for 11/4.

11/4/24: Judge Timothy Canning dismissed the case without prejudice for failure to prosecute.
