Alleged witness in Fortuna attempted murder case arrested, DA files Pitchess motion

(Ramirez)

(Moreno)

(Quintero)

I just did a post on June 18 about the jury trial for Fortuna attempted murder suspects Miguel Moreno and Ruben Ramirez.

Both Moreno and Ramirez worked at Burger King. Moreno was arrested at work in front of his co-workers.

So much has been happening with constant twists and turns and filings by the DA. Even the experienced court clerk is behind with court minutes. The trial is expected to conclude this Friday if there are no more hiccups. This post will get you caught up except I am going to wait to add the second amended information. The way things are going if the DA amends charges again, I have to prioritize ny time and amended complaints are not always in e court.

It is very time consuming to get court minutes and go back repeatedly for many reasons and I am not wasting more time with last minute amended filings by the DA every other day.

There was already a lot of tension with parties involved. Alleged victims are Romarico SanchezMartinez and Nicole Paola Quintero. And now there will be more.

On 7/1 an arrest warrant body attachment was issued by the DA for a witness. On 7/2, Ms. Rebecca Linkous was appointed as an attorney for 22 year old Nicole Quintero who is to be held in custody. Bail for her was reduced to $10,000 and she was booked into jail on 7/2 on arrest warrant for contempt. Quintero posted bond.

On 7/2 a Pitchess motion was filed by DA. Usually that motion is filed by the defense inspect a law enforcement officer's personnel file for evidence of misconduct. It is also unusual to be filed at this stage. On 7/3, day 10 of the jury trial, an amended Pitchess motion and  declaration of DA Stacey Eads was filed. That is scheduled to be heard on 7/8.

This case lead is Fortuna Detective Brian Taylor. His name has come up through different sources but I am waiting for court minutes or other official confirmation.

After endless continuances and an intervention last that did not result in a resolution, the cases were assigned to Retired Judge Christopher Wilson.
Deputy District Attorney Trent Timm is the prosecutor. Moreno is represented by Mr. Ken Bareilles.  Deputy Public Defender David Celli is Ramirez's attorney.

Moreno's has picked up another case for assault and battery in the jail on inmate and murder suspect Brandon Widmark which is trailing the homicide case.

7/12: I went back multiple times this week to check on court minutes this case and nothing was available all week. Doing the minimum cover page required for jail as a cop out happens too often and for an entire week is a joke. I let court admin know.

7/8 minutes dont have Pitchess motion result ? no detailed 7/8 minutes
Pitchess motion on 7/9 checked 7/9 minutes no detailed minutes or result
7/9 document by DA use of immunity agreement
check status of trial nothing in e court

So next week, in addition to 20 cases, I have to spend time looking up court minutes for an entire case and the second amended complaint just for thos case.
