I had done a post on Matthew Miller's arrest for rape of an intoxicated or unconscious victim. 

Linkedin profiles can have old information. So, I had reached out to APD. I never heard back from Arcata Police Department. Thankfully, I just got this email with contact information and verification from Big Blue Cafe.

"Hello, This is Michael over at the big blue cafe." He referenced my post on Miller as the reason for reaching out. "Just to inform you that he doesn’t work for us and hasn’t in a long time. Regards, Michael Martin-Kunkle."

Gerald McGuire case against County dismissed, another rare win and again only because of Deputy County Counsel Thomas Chapin

Failed candidate for First District Supervisor Gerald McGuire has lost his lawsuit !against County of Humboldt. The case has been dismissed and restraining order by McGuire has been denied.

McGuire represented himself after he told Judge Timothy Canning in April that he did not want Michael Acosta as his attorney. His request was moot because Acosta had already been suspended by the California State Bar in April due to his conviction and is ineligible to practice in California.

In December 2023, Judge Canning granted a TRO against County Code Enforcement Unit until judicial review of McGuire's coastal development permit.

A 6/26 writ of mandate hearing and oral argument was continued by stipulation to 7/1 because no court reporter was available and proceedings were being electronically recorded. As usual, the 7/1 minutes have not been entered by the clerk but an order filed by Deputy County Counsel Thomas Chapin on 7/1 states the case has been dismissed and the restraining order denied. Also a future calendar date of 7/5 is no longer listed in court records.

The County usually loses or settles but this is another win for the County only due to Mr. Chapin. Type in his name on the search feature on my blog for other cases.

Fatal crash on Eel River Ranch Road results in driver deceased, another occupant was able to self-extricate

 


According to CHP Sgt. Kevin Will, "On July 4, 2024, at approximately 1935 hours, a 2000 Dodge Ram 1500 was traveling east on Eel River Ranch Road, southeast of Hill Road. For reasons still under investigation, the driver allowed the Dodge to travel off the south road edge of Eel River Ranch Road and up a dirt embankment, causing the Dodge to overturn."

Charmaine Stapp arrested by State Parks for DUI, previous arrest for domestic violence and drunk in public

 


47 year old Charmaine Lynnette Stapp was arrested yesterday by State Parks and Recreation and booked on two misdemeanor charges for VC 23152 (a) DUI and VC 23152(b), blood alcohol level over the legal limit. She was released on O.R.

I received a tip from  regular reader and then another email from someone about Charmaine Stapp after this post. This is a small communit and while certain last names are related, I tried to see if I could verify and could not find any connection between Charmaine Stapp and Ryder Stapp.

I covered Charmaine Stapp in the past. In June 2020, she was arrested for domestic violence and in May for drunk in public, not a DUI. Humboldt Superior Court only lists a 2006 traffic infraction case with a conviction and guilty plea and 2012 assault case which was dismissed.

Tip from regular reader : "Charmaine Stapp got a DUI yesterday. I think she was picked up on a DV charge in McKinleyville earlier this year.. I'm told that this is a sister (can't confirm, I just know of brothers) of Ryder Stapp, whom everyone is well aware of. "

Tip from another reader after my post: "Ryder does not have any sisters and she's barely even a distant cousin by marriage. "

Busy day for HBF with multiple incidents including fire at transient encampment and water rescue near Samoa Bridge


On 7/04/2024 from the hours of approximately 10:00 a.m. to 2:00 p.m. Humboldt Bay Fire has responded to multiple incidents, including a vegetation fire fire that spread from a transient encampment, and a water rescue near the Samoa bridge. 

Parking at Humboldt airport will be impacted until September due to construction

 


The Humboldt County Department of Aviation this past month began conducting a long-overdue major rehabilitation project of the paid parking lots at the California Redwood Coast-Humboldt County Airport (ACV) in McKinleyville.

Browser compatibility of video consoles and entire readback of alleged molestor requested by jury

 


On 6/28, the jury heard from  alleged molestor Steve Boudreaux.  Retired Judge John Feeney did not allow Deputy District Attorney Whitney Timm to cross examine Boudreaux about Jane Doe 3. That day was not good for the People with Judge Feeney ruling against the prosecution a few times. 

Deliberations started on 7/1 at 4:00 p.m. and 4:30. Second amended information was filed on 7/1. On 7/2 jury sent a note and requested readback. On 7/3, there was another note from the jury. I was in court and jury asked, "Can we find out if X box or Playstation had browser capability in 2010?"

At 2:50 p.m. there was another note from the jury. They requested and will get to hear all of Boudreaux's testimony. 

Deputy Public Defender Casey Russo waived Boudreaux's appearance for both notes today. Deliberations continue on 7/3.  At 3:30 p.m. a third note. It is 3:46, attorneys have gone in twice to meet with Judge Feeney. This last note said, "Which incidents are associated with each charge?" Then the note listed Counts 1, 2, 3, 4, 5 and asked about jury instruction 207. All this was discussed with a response sent back and it was after 4 p.m. Jurors were provided a copy of the information.

CALCRIM No. 207

This instruction states that when alleging a crime occurred on a specific date or date range, the prosecution only needs to prove that it happened reasonably close to that date, not exactly on it. The court is not required to give this instruction on its own, and it should not be given if it is not relevant.

The jurors have verdict form with the charges and jury instructions. Requesting readback of an entire witness testimony? Looks like a holdout or few who should pay attention during the trial, learn to read instead of unnecessary dragging out deliberations.

Several jurors had plans so there were no deliberations on 7/5. Readback and deliberations will resume on 7/8.

Danny Fidler complaint for 2024 case has 13 counts and involves 4 law enforcement agencies

 


Danny Fidler was arraigned this afternoon on 13 counts which include 11 felonies and two misdemeanors. As I previously reported, Fidler has retained Ms. Andrea Sullivan. The complaint in his 2024 case merges cases from four different law enforcement agencies: EPD, HCSO, FPD and CHP.

Fidler is on no bail status. OR bail and preliminary hearing scheduled for 7/16.

Gregory Kreis is getting a taste of his own medicine in his divorce case

 


The points made in this brief filing by Brenda Elvine's lawyer in her divorce case against Gregory Kreis have already been made by me in prior coverage with court documents and other documentation. I was waiting to see if Brenda Elvine's lawyer would file anything.

With Gregor blabbing his business all over the courthouse and in other places, the information was known to quite a few people.





On 7/8, Kreis should be ordered to pay spousal support. Gregor has dragged this out for months; something he did not give the courtesy to anyone in his court that he was biased against or just didn't care for or wanted to punish for whatever reason.

Gregor deserves no sympathy; no mercy. Unlike people whose lives he destroyed, he bought this on himself. Instead of continuing to blame his ex wife, former Humboldt Public Deputy Public Defender Rory Kalin, Ms. April Van Dyke who won his seat by an overwhelming margin, me or anyone else, Gregor needs to start apologizing and take responsibility for why he lost the election and why he is no longer a judge. I doubt Gregor the terrible will ever do that because one has to have morals and a conscience. Pigs will fly before Humboldt's mini Trump will ever act like a man.  I shouldnt insult the rest of the male species using that term for Gregor. His denial also makes him a mini Biden. 

Before any of you clutch your pearls or think this is harsh, your life has not been decimated by a man who is a stain on the legal profession and should never have been a judge. The CJP ruling and facts are not even all the horror this man has unleashed on people who have stood up to him or expected him to have a clue about the law. Most of you risked nothing to expose this man and you didnt pay the price or be there for people affected by his tyranny. The voters ousted him. The CJP finally did something after years due to the persistence of many people who took risks and spoke up. Now that they have ruled; they were aware of the ongoing coverage on this blog about Gregor in real time. I am still talking to people he brought to tears in court and whose cases are not in the CJP proceedings but just as devastating. The California State Bar is a joke for reinstating his law license. 

Kreis screwed over a lot of people. People who were not making his $260,000 salary. He punished people who could not fight back;  people who were already struggling because he is biased and lazy.  Gregor cost people a lot of money, their homes, their reputation, their children.

He is vindictive and he knows exactly what statements he has made about retaliation against facts and truth inconvenient to him and Tanya Ellis Gregor has no judicial immunity now and his pro per filings  are the joke among many lawyers in California. Did he and Tanya get married on June 10? Did they honeymoon in Cancun? Have Brenda Elvine and her lawyer looked into that or the renovation at the house? 

DA charges KRCR reporter with two counts for her DUI arrest

 




On May 3, I reported 24 year old KRCR reporter  Adelmi Yazmin Ysita was arrested by California Highway Patrol at 3:10 a.m for VC 23152 (a) andVC 23152(b) BAC over legal limit. She was released on OR. I had reached out CHP PIO Paul Craft who told me , "This arrest occurred on Myrtle Ave south of Park St., in Eureka." The arraignment letter was sent to an Arcata address.

The DA has charged her with those two counts as misdemeanors. As you can see from the top of complaint, the BAC was .13/12. Ysita's arraignment is on 7/24. Misdemeanor DUI cases are often scheduled in early resolution court and can resolve at arraignment. 

I had also reached out to KRCR for comment after that arrest. See previous post for response. As of early last month, Ysita was still employed with KRCR. I reached out to KRCR Assistant News Director Nazy Javid and News Director Kerry Loring to see if Adelmi is still employed and any other comment  but I doubt I will get a different response than I did in May. Ms. Loring is out of the office until Monday. I then contacted GM John Manzi.

Root Birimisa is back at the Humboldt jail, restoration hearing scheduled in his 2023 Humboldt case

 


Remember Root Harvest Birimisa who was found not competent to stand trial.? He is back in Humboldt and was booked into jail in his 2023 Humboldt case.

On 5/1/24, there was a review hearing. There are no minutes or information about the 11/4/24 hearing. There is a record of court supervision as of 1/11/24. The next scheduled date is a restoration hearing for 7/8/24.

I just read your posting of Gav's press release about Transitional Age Youth and housing funding and well.....I have questions. One being, where is Humboldt?

Humboldt dig get funding, but only ~$330k in the several rounds of funds given out. But how did Mendocino receive $1.2m versus $330k? The application process appears to be the same for everyone that applied on brief reading. Did our supes not try hard enough? Other cities such as Los Angeles, I would imagine have enough expendable income lying around that they shouldn't need to ask the government for money, but they got a piece of the pie. As did Salinas. Other cities were rewarded $0 for whatever reason, though I suppose they didn't apply or something held up the money.

BOS updates hours for County offices, most to be closed on Fridays

 


The Humboldt County Board of Supervisors today approved updated public office hours for several county departments. 

"These grants are critical for helping to connect some of the most vulnerable Californians with access to housing. Many of these young adults don’t have the support of friends or family that most of us take for granted.”

 



Out of 52 counties, more than $15 million was awarded to eight communities including Mendocino. Compare what Humboldt County got to Mendocino.



County opens cooling centers at Hoopa, Willow Creek and Garberville library branches

 


In response to the extreme heat forecast for the coming days, Humboldt County is opening cooling centers at the Hoopa, Willow Creek and Garberville library branches. These centers will provide a safe and cool environment for residents seeking relief from high temperatures that are expected to reach into the 100s in some locations.

34-year-old Eureka resident Raul Villalobos deceased after crash in Redway

 


On June 29, 2024, at approximately 10:35 PM, Humboldt Communication Center (CHP Dispatch) received a 9-1-1 call of a crash involving a motorcycle on Redwood Drive, north of the community of Redway. Redway Volunteer Fire Department, City Ambulance, and CHP arrived on scene and provided life saving measures to the rider.

Convicted felon Danny Ray Fidler was arrested by HCSO in November 2023 for PC 422 criminal threats, PC 207(a) kidnapping and PC459/461(a) burglary. He was arrested again yesterday by the Fortuna Police Department on a bench warrant for two old charges including kidnapping and 17 new charges.

Fidler has retained Ms. Andrea Sullivan.
