Patrik Griego wins motion against Humboldt County in lawsuit regarding Public Defender
Visiting Judge Dowling granted Mr. Patrik Griego's motion for discovery finding good cause this morning, despite County's objection.
Mr. Griego asked in his motion that the process be expedited to determine whether newly hired Humboldt County Public Defender David Marcus meets the state qualfications required under Government Code 27701.
Allegations have been made against Mr. Marcus that he is unprepared for court and attorneys working under him are concerned about the well being of clients. One of his imost vocal critics has has been Conflict Counsel's Mr. Greg Elvine-Kreis, who applied for the job that Mr. Marcus currently holds.

It seems that some lawyers are more committed to their State Bar oaths than some local officials are committed to their oaths to serve the people of Humboldt County. Humboldt County and its cities have demonstrated over and over that almost anyone can be elected to, and serve in public office without solid qualifications or real, continuing commitments to those who elected them.
ReplyDeleteSometimes true professionalism shines through and newspaper interviews which are based on someone else's opinion do not detract from what Mr. Griego is doing. I don't know him, hadn't heard much about him before this but I am proud that someone IS standing up and telling it like it is.
And I have a question for Mr. Marcus: If you know California Law so well, how is it you thought you were qualified to serve at Public Defender?
For over 20 years I had to correctly apply the Customs Laws in CFR49 and while there may be room for interpretation there, I don't see any here. I've read that Code. If misusing the law to your own benefit is your take on it, I hope you go back to Florida and do whatever you were doing before.
Griego is a PIG!!! He represent all the DUI killers out there. He is currently representing Kade Chandler who killed two (over 2 yrs ago) in a DUI where he had alcohol, marijuana, cocaine and opiates in his system. ALSO he is currently representing Marci Kitchen whom ran down her own child and her child's friends while driving drunk....she then leaves them for dead and goes home to hide her Jeep. So ya.....Mr Griego is a PIG!!
ReplyDeleteYou need to get your facts right. Kade Chandler is being represented by Manny Daskal and Benjamin Okin. Marci Kitchen is being represented by Benjamin Okin and Patrik Griego but initially, it was Mr. Okin speaking on her behalf. While Mr. Griego does represent clients with criminal cases, he also does civil cases; he certainly does not represent nearly as many DUI clients as some other lawyers.

DeleteAnonymous needs to chill out. This isn't about cases algready being handled. This is about getting someone qualified to run the PD office and making sure people who can't afford a lawyer get quality representation. Mr. Marcus can't provide that type of quality representation period!

DeleteIf he became a lawyer that would be good... it would be sad to not have his writing. It is a very hard choice to make. I also think he would make a good supervisor.
