"When you were going through jury selection, we talked about presumption of innocence and burden of proof," said Mr. Russ Clanton who is Kailan Meserve's defense attorney. "We will present to you from the defense perspective. This will be very important. The evidence will accurately portray who Mr. Meserve was in 2013-2014."
"He was an alcoholic, he sought sex outside his marriage and he worked in our agricultural" industry," said Mr. Clanton.
"Character is not what one should be judged on but facts," said Mr. Clanton. "What I would tell you is that when you have heard all the facts, you may not like Mr. Meserve ad a person but he is not a rapist or kidnapper."
The defense portrayed Jane Doe #2 and $1 as pursuing Meserve, the sex being consensual and asking the jury for acquittal since no criminality was involved. The defense did not deny any of the sex acts taking place or comments made by Meserve to Jane Doe #1 such as you are "my bitch".
Meserve was acknowledged as a polarizing figure in Petrolia.
The Meserve jury consists of six men and six women jury, with four alternates, all men.
