When I also see local business owners I have known for years go out of their daily route for a cup of joe; I knew it was time to check out Stu's Brews.

I covered convicted molestor Steve Boudreaux's first trial. It was a hung jury for five counts. Boudreaux was convicted for Count 6. This week, there were motions in limine for his retrial for Counts 1 to 5. 

I was in court on 1/28/25 for a very important motion. Defense was trying to keep out Boudreaux's prior conviction. 

Even a white dress shirt and black suit did not change Boudreaux's creepy appearance. He did not even bother to shave. He could have since jury selection was expected to begin after motions that day. The jury trial started on 1/27/25 and already a female juror requested to be excused for hardship due to unexpected development. 

Before arguments, defense witnesses Shaylene Williams, Darian Ridley, Kamber Tiernam Stein  and Jessica Sovereign were ordered back to court on 1/31/25.

FBI investigating former Fortuna City Councilmember Kris Mobley

I emailed the FBI spokesperson Cameron Pollan in San Francisco.  I have contacted Ms. Pollan before and heard back from her last September. While I have included the City of Fortuna press release, I am not adding any other information about the investigation or allegations unless it is released from the FBI.

White House and Trump administration more inclusive than California when it comes to independent journalism

 


We don't even have anywhere to get press credentials in Humboldt and I made suggestions to Sheriff William Honsal and former Eureka Police Chief Steve Watson.

For partisan extremists who cannot give the Trump administration credit for this important move; you are petty. Like him or not; agree with him or not; those of you who say you appreciate my independent reporting should appreciate this inclusion.

On January 27, 2025 at about 4:25 p.m. Eureka Police Department officers were dispatched to First and W Streets in Eureka on a report of a stabbing.

California Attorney General Rob Bonta just issued a press release about a plea agreement which resulted in the felony convictions of "David Robert Daleiden and Sandra Merritt for criminally recording confidential communications with women’s healthcare providers."

Child abduction suspect Peter Thompson out of custody after Retired Judge Marilyn Miles reverses Visiting Judge Richard Kalustian's October 2024 ruling

On 1/23/25, at the Readiness Conference, trial was confirmed for child abduction suspect Peter Thompson. Yurok Tribe Wellness representatives Pepper Lopez and Courtney Card appeared via Zoom.

Thompson has been on no bail status since October 2024 when Visiting Judge Richard Kalustian denied OR and supervised release.

Another OR bail hearing was scheduled for 1/24/25. Retired Judge Marilyn Miles granted Thompson supervised release. Criminal protective order filed and served. I have included court minutes and conditions of supervised release which have information regarding guardianship of the minor.

Jury trial is scheduled for 2/3/25. Deputy District Attorney Whitney Timm is the prosecutor for this case. Deputy Public Defender David Celli is Thompson's attorney.

The last post I did was on September 27, 2024. I added an October update to that post as I do with other court cases.

On 1/24/25, there was a hearing for status conference  and request for order hearing-Sanctions in this case. Humboldt e court lists orders made but no details. There is a trial setting on 1/31/25. These are the court minutes from 1/24/25. 

Later, when I checked the case on 2/4/25 more detailed minutes were added. Kreis has hired Humboldt attorney Kelly Walsh who requested a continuance. Trial setting regarding spousal support is scheduled for 4/4/25. Walsh endorsed Kreis in the last election which Kreis lost with an overwhelming defeat. His opponent, now Humboldt Superior Court Judge April Van Dyke got over 60% of the vote.

PCWindham left a comment on RHBB's recent article on Joseph Larue. I only respond and do one on one updates for my advertisers, subscribers and donors.

Others can read this blog regularly, call the DA or go look up court cases themselves. Monica Pereira, that is for you and anyone else who feels entitled to my time without any investment or support and email me when the information is already on my blog; for free.

Larue could have posted bail months ago in the 2024 case when it was set. Retired Judge Ksenia Tsenin set bail amounts on 11/6/24. That was at the first court hearing after he was booked in jail. And that is when his status from having a bail hold changed.

The fact that he did and was released on 1/23/25 is not breaking news. The confusion could have been cleared if case numbers or complete information is provided. The local jail log is very simple to understand. In Humboldt, there is access to public computers.

My comment is directed at people who don't read or look for information on more than their go to source. We have a lot of local media who cover different news. I often see questions in comment sections which would not be necessary if people did a simple google search. 

1/27/25: As I suspected, there was a 2025 case filed by the DA on 1/21/25. Charges are fugitive from justice. He was arraigned on that 2025 case. Bail in that case was set at 85,000 by Retired Judge Christopher Wilson and that is the bail LaRue posted. Setting of identity hearing on 2/19/25.

Not only did Chrisjenna Moore waste Shannon Miranda's time and money, the ruling against her just one example of the misuse of the court system by people with no clue about the law and the purpose of civil restraining order

 


I was not going to write anything about this court case because it is one of the many bs cases filed and a misuse of the court system. I sat in court on December 13, 2024 and listened to some of the evidence and testimony from Chrisjenna Francis Moore. I watched Commissioner Sarah Kaber ask questions. I watched Ms. Allison Jackson respond. Like many people in the community, I know Shannon Miranda as an acquaintance and from social events.

I looked at the court documents filed. Even before Commissioner Kaber's ruling filed 1/14/25, I knew Moore would lose.

The Smith lawsuits are on the Board of Supervisor's January 28 agenda under closed session.

A search for Smith shows he is not in custody anymore at the Humboldt County jail. A search in the CDCR inmate search locator does not bring up any results.

Resolution by Supervisor Bushnell to name Alderpoint Bridge in memory of Trevor John Earley

 


On this this Tuesday's Board of Supervisor's meeting, there is a resolution by Board Chair and Second District Supervisor Michelle Bushnell naming the Alderpoint Bridge in memory of Trevor John Earley.

Regular readers of my blog are familiar with my coverage of the Jake Combs case and jury trial. Combs was convicted of Earley's murder.  25 people from the Alderpoint community showed up for the jury trial including Supervisor Bushnell. If she was not in court on a particular day, Supervisor Bushnell checked in with her constituents and Earley's family members at the courthouse.

Earlier this month, I mentioned a conversation I had with Supervisor Bushnell. After that post, a few people told me how responsive she was to them and helpful when they reached out to her. These are not funders or people politically involved; just grateful constiuents.

64 year old gets 60 hours of community service and 90 days in jail for sexual battery of a victim who was "institutionalized for medical treatment and was seriously disabled and medically incapacitated."

 


Last July, I reported on the arrest of 64 year old Ernest Paul Gruetzmacher for PC 664/287(c)(2) attempted forcible oral copulation and PC 243.4(d) aggravated battery causing serious bodily injury.

The victim in this case was "institutionalized for medical treatment and was seriously disabled and medically incapacitated."

On 12/12/24, Gruetzmacher resolved his case with a plea to sexual battery. Count 1 was dismissed. On 1/23/25, Judge Lawrence Killoran sentenced Gruetzmacher to 60 hours community service, 90 days in jail with credit for 1 day served and two years of probation. A protective order was filed and served on him in court and his bail bond was exonerated. Commit to jail date is on 2/22/25.

Eureka Police Department issued a press release today about the traffic collision yesterday on Broadway that resulted in the death of a pedestrian.

Ribbon cutting next week for City of Eureka Uplift Eureka Community Resource Center

The City of Eureka celebrates the Grand Opening of its much  anticipated Uplift Eureka Community Resource Center with a ribbon cutting scheduled for Wednesday, January 29th at 1:00 p.m. Mayor Kim Bergel, City Manager Miles Slattery and Special Projects Manager, Jeff Davis will be in attendance. 

"All individuals, regardless of who they are or who they love, deserve to be recognized and treated equally. Here in California, the LGBTQ+ community is and will continue to be protected under a myriad of state laws and California’s constitution."

Allan Dollison is becoming a regular contributor for the Daily Journal; his second analysis this month is on the federal judge's temporary block of Trump's birthright executive citizenship order

 


Two weeks and three days later since his last article Mr. Allan Dollison is published again in print and online in the Daily Journal and California Lawyer.

Glass all over 5th and I street outside the courthouse, EPD on scene




Just walked up to the courthouse to see glass all over the sidewalk on 5th and I, then saw the EPD officer speaking to these two people and this vehicle.

Courthouse security at the 5th street entrance heard a loud noise but did not see what happened.

1/27: Three days later, there is still glass all over the sidewalk and crosswalk.

Two Deputy DAs out sick this week, Deputy DA Schaffer handles their cases as well as her own; deja vu with former DA Magie Fleming being in the courtroom


Deputy District Attorney Whitney Timm and Deputy DA Carolyn Schaffer are specially assigned to CAST cases. That is an intense caseload. In addition to that, they also handle other major cases.  Both of them and Deputy DA Roger Rees prosecute serious, violent and life crimes and all three are among the few, experienced long term prosecutors currently at the Humboldt District Attorney's office. With Ms. Timm and Mr. Rees out sick; Ms. Schaffer held down the fort by herself this week. She appeared on her cases; their cases which include a current jury trial.

Logan Brewer Hearst was held to answer on all but one count in his 2024 drug and criminal case

Eureka Police Department Sgt. Dustin Nantz was designated as lead investigating officer for Logan Brewer Hearst's preliminary hearing today in his 2024 criminal case. The hearing did not start until this afternoon. 7 women were in court, 6 with Victim Witness. One was there for Brewer Hearst.

Mama Nylander gets summons; Stephanie, Rachel and Russel Nylander agreeable to mediation

 


Since my last post on the Nylander vs Nylander saga, there was a proof of service summons filed on 1/2/25 for service of a summons on Marleen "Mama" Nylander on 1/1/25.

A case management conference statement was filed by the plaintiffs on 1/10/25. There is a case management conference scheduled for 1/27/25.

Convicted molestor Steve Boudreaux's retrial for Counts 1 to 5 and setting for sentencing was continued twice since 1/22/24 because Deputy District Attorney Whitney Timm is ill. I added those updates to the previous post. Deputy DA Carolyn Schaffer has appeared on the case for Ms. Timm this week.

California Attorney Rob Bonta and members of the States Negotiating Committee: the attorneys general of New York, Colorado, Connecticut, Delaware, Florida, Illinois, Massachusetts, Oregon, Pennsylvania, Tennessee, Texas, Vermont, Virginia, and West Virginia reached a   $7.4 billion with Purdue Pharma and the Sackler Family "for fueling the opioid crisis."

It has to be approved by the United States Bankruptcy Court for the Southern District of New York.

At defense request, 19 year old Poe murder and criminal threats suspect's OR bail hearing is vacated

19 year old Dauwin Poe is one of the suspects who was arrested on charges for multiple shooting incidents in December 2014 including Toni's restaurant.

The DA's office has charged him in two 2025 cases. He has one 2024 case. Poe was arraigned on 1/13/25 and Conflict Counsel's office was appointed. At defense's request, OR bail hearing was vacated. Preliminary hearing is scheduled for 1/24. 

Edmund Moon is the alleged victim in one 2025 case. Panther Colegrove is the alleged victim in another 2025 case.

Charges, court minutes and court records are posted below if you want more details. Murder and criminal threats are just two of the charges Poe, Jr is facing.

I have covered quite a few court cases involving different members of the Moon and Colegrove family. This will be another Humboldt drama filled court case and there are is always more to the story if there is a preliminary hearing and trial.

Rob Bonta files lawsuit against Southern California real estate agent for price gouging Eaton Fire victims




California Attorney General Rob Bonta has filed charges. In addition, 500 price gouging warning letters have been sent to hotels and landlords. If you want to read the entire complaint, go to the California Attorney General website.

DA subpoenas Ashley Pearce-Pifferini's DHHS records and health records from Oakland

Yesterday, there was a hearing on a motion filed by the DA in Ashley Pearce-Pifferini's case. The DA's office subpoenaed records from DHHS & health records from Oakland. The motion was granted. Preliminary hearing still scheduled for 2/6/25.

The International Association of Chiefs of Police and Fraternal Order of Police issued a joint statement an hour ago on the recent presidential pardons.

"Lambda Legal condemns in the strongest terms President Trump’s first actions in office targeting LGBTQ+ people, everyone living with HIV, and communities of color. We are prepared to challenge them in court. "


Yesterday,  Lambda Legal issued a statement on the executive orders by the Trump administration impacting the LGBTQ community.

At least three EPD officers looking for someone near Days Inn and IHOP on 5th street

 



Just saw an EPD officer walk into Days Inn on 5th and D. And another EPD officer pull up at 11:01.

Officers just cleared the scene at Days Inn. I see another officer 11:03 near IHOP. They are obviously looking for someone.

EPD PIO Laura Montagna told me, "Someone broke the placard near our Officer Memorial in front of the department and they were looking for that person."



EPD is having a busy morning. Sgt. Omey was at both scenes. EPD, CSET and Animal Control on 4th and D. I saw a bunch of animals exiting from the the camper van. This is one of the vehicles EPD has received numerous complaints about as part of the EPD vehicle abatement program. It was towed.

In addition to ACLU, CA Attorney General sues Trump Administration over unconstitutional birthright citizenship order


ACLU, California Attorney General Rob Bonta and New York Attorney General Letitia James are just two of 18 state attorneys generals  making headlines in the last 24 hours for suing the Trump Administration over the executive order on birthright citizenship. San Francisco and Washington D.C. are also plaintiffs in the lawsuit.

After this post was published, the number of states has increased to 22. 

Jennifer Facer arrested by EPD for failure to register as a sex offender





The booking photo is after a conviction. The Ninth Circuit ruling only applies to booking photos prior to a conviction and the Ninth Circuit ruling does not apply to Florida.

Jennifer Lynn Facer aka Jennifer Romero was arrested by Eureka Police Department yesterday for PC 290.011(a) failure to register as a sex offender. She is still in custody this morning. Let's see what happens at her next court hearing.

In Humboldt courts, there are no consequences for such arrests. Female offenders in Humboldt are rare; at least in the 11 years of coverage I have done on local courts and arrests.

10: 22 a.m.: She has a 2025 case fugitive from justice warrant. The DA dismissed the Humboldt case on 1/17/25. Facer's warrant is from Florida. You can read more details from court records and court minutes provided.
