James Merrick's murder, DUI, hit and run trial confirmed today but defense will be filing a motion to continue



Trial confirmation was scheduled for James Merrick on May 16.  Jury trial is scheduled for June 11. Trial estimate 4-5 weeks.



Dates were confirmed today but defense said they would be filing a motion to continue.  Visiting Judge David Devore said, "the anticipated motion to continue was for investigation purposes."

Deputy District Attorney Brent Kling said, "e will likely be opposing the motion."  He received a report from the defense today prepared by an accident reconstruction expert.


Four family members of the victim were present in court.

Merrick is charged with five felonies. Count 1 Murder. Count 2 Gross vehicular manslaughter while intoxicated. Count 3 DUI causing injury with prior conviction (2015). Count 4 DUI with blood alcohol 0.08% causing injury. Count 5 Hit and run resulting in serious injury or death.

Conflict Counsel Supervising Attorney Meagan O'Connell is representing Merrick.
