Kidnapping and assault suspect Kevin Carns entered a plea today. Judge Timothy Canning refused his request to condition the plea on a grant of probation.
Carns waived his right to appeal and his right to a preliminary hearing. Carns has to register as a sex offender. This is an open plea.
The offer to resolve the case was for PC 220 (a) (1) assault with intent to commit rape. This is a lesser charge for Count 1 and Count 3, PC 236, false imprisonment.
Both are felony offenses and one is a strike offense. The maximum term for Count 1 is 6 years and Count 3 is three years. The plea deal was for 6 years for Count 1 and 8 months on Count 3.
Count 2 was dismissed.
Ms. Christina Allbright is Carn's attorney. Deputy District Attorney Stacey Eads is the prosecutor for the case.
Carns is the husband of Jane Doe's best friend.
Sentencing is scheduled for December 21. Carns was facing life in prison. Ms. Eads said that Carns had a previous criminal record included non violent crimes but also exposure of genitalia.
Ms. Eads said 21 year old Jane, 23 year old Carns and some friends went out to some bars. They were drinking. Jane Doe and Carns were "simply friends." Carns grabbed "Jane Doe's butt" several times despite being told to stop. Later, Carns and Jane Doe were in the backseat of a car. Another couple was driving. Carns pushed Jane Doe down and rubbed her face in his crotch.
After Jane Doe went inside her residence, other friends were leaving and she wanted Carns to leave but he did not.He claimed he was concerned about her. Carns pressed "his body from behind" and Jane Doe saw his pants were down and "his penis was erect."
Doe managed to run out of the room. Jane Doe ran outside to get help. Carns ran after her, dragged her back into the house, with his hand on her mouth. Another friend was trying to get into the house, Carns was pressing on the door to prevent the friend from entering. Carns was holding Jane Doe while this was happening. The friend managed to get into the house.
Later, Carns texted an apology to Jane Doe. He told her he had left a picture of his penis on her phone. When he was contacted by law enforcement, "he immediately placed his hands behind his back."
12/21 update: Judge Lawrence Killoran sentenced Carns to 6 years and 8 months. Carns had to give up all his custody credits, agree to 180 days in jail and was then placed on five years of formal probation.
