Evidence of raunchy text messages, "I need a blow job", and affair charges with ex co worker Daniels' jury was not allowed to hear

Before the jury trial, motions in limine are filed by each side. According evidence code 402, the trial judge rules on what evidence can be allowed.

In the Jason Daniels' case, the defense was able to exclude evidence which could have made the difference in how the jury ruled.

Pictures speak louder than words. Here is only a bit of the evidence that was not allowed in the jury trial. I got copies of some of these documents today.

The photos are text messages Daniels' exchanged or sent to other deputies and some indicate clearly during work hours.

To protect the privacy of those deputies, who received these messages, I cannot show you the times and dates.

Of interest is the testimony of ex dispatcher Lisa Morrison and her admitting her affair with Daniels. There was also testimony regarding reliability of witnesses using meth and heroin.

There are rumors Daniels wants to be hired back by HCSO, whether they want him or not.

The jurors said that they felt they needed more evidence to meet guilty beyond a reasonable doubt. They said they believed the victims.This evidence could have made all the difference in the vote.

  1. What do you, or anybody reading, gain from releasing this on your blog, John? Like it or not, Jason Daniels was found Not Guilty in a jury trial. Jason does not currently work for any California law enforcement agency that I am aware of. Lisa Morrison does currently work as a public emergency dispatcher in this county. She is an excellent dispatcher who I am proud to work with. Lisa was not on trial for anything, she wasn't accused of any wrongdoing, nor did she have any part in the incident which led to Jason's trial. Lisa is a consenting single adult woman, whos now adult son has not lived with her in at least 4 years. Her sex life is not the business of anyone except her and her partner. So I ask you seriously, what purpose was served with this hit piece? Why have you chosen to lower yourself to the point of actually sullying the name and reputation of a woman who has done nothing at all to you or anybody else in this county except provide excellent emergency service? You couldn't even redact her phone number? Why? Because she chose to have relations with someone you dont like? Feel good about yourself now? Have the decency to edit or take this article down. The only person you've made look more an asshole here is yourself.

  2. Mr. Hoppe, the only reaction I have received to this is two private messages and your public comment. One private message was from someone I respect and knows me as well as Daniels and Lisa Morrison. That person politely expressed their feelings but respected why I did this post.

    The other was a private message from HSU Chief Petersen. Since he had the decency to write and contact me privately. I will do the same. You are a coworker of Ms. Morrison, maybe even a friend. You are hardly unbiased. I do not know if you know Jason Daniels. Ms. Morrison was interviewed for possible court testimony. These are public documents. Had this evidence been allowed, it would have been admissible in court and other media would have covered it. Just because it was not due to a good defense lawyer, it is still a public document.

  3. Mr. Hoppe, private conduct is not anyone's business, sexting on duty and sex in duty is not what either Jason Daniels or Lisa Morrison werw being paid for by the taxpayers at that time. Not all their dalliances were on duty. Ms. Morrison was a potential witness to an alleged crime. Had this evidence been allowed in, the jury may not have reached the same verdict. Juries do not always reach the right verdict. Did you even bother to read what the jurors said. You say Ms. Morrison does not work in this county. She works and you both ate listed as HSU emoloyees. How do you know Jason Daniels will not apply for a future job in LE? You don't. I had no opinion of Jasin Daniels while I covered the case. After this evidence I do. Had I wanted to do a hit piece, I would have written about the out of court remarks by his wife during tbe trial and after the verdict. You are not a journalist, you are emotionally involved and close to at least one party in this case. Had the conduct between Daniels and Morrison been on their own time,that would be different. You are just pissed that all the facts came out. Jason Daniels is not quite the happily married man he portrays himself to be and you do not seem just as outraged about Jane Doe #1 or #2's life being dissected or other so called media sources that anonymously allow unsubstantiated rumors and pot shots about others, including me.

    I am not intimidated in providing information. Not my fault that you seem to think in a small town, media can be bullied unto silence. Maybe you are used to media conveniently printing stuff. As for name calling, the only character and asshole it shows is yours. That you seem to think that its okay to disparage vulnerable victims and that boinking on duty and disgusting messages are okay. Next time provide me with a verifiable phone number or email address or dont expect your insulting rants to be published.

  4. And one last point to Mr. Hoppe or anyone else. Unlike Lisa Morrison, Jane Doe #1 and #2 did not have a choice. Also Daniels has done quite well for himself in his business, despite this case, and he did not pay for his defense. Once again, he stuck it to the taxpayers. Your anger is misdirected at me, when it should be directed at a man, who clearly thinks he is entitled to whatever and whomever he wants. The names of the women add a face. Their reputation is just as important as that of any woman. Unlike Lisa Morrison, Jane Doe #1 and 2 did not have anyone championing their cause except for the excellent work by the DA and Investigators. Jason Daniels is in no way representative of the many men (and women)in law enforcement who I respect.
