"Camera off?", "Off record", "I burnt the motherfucker's place down."


The most damning testimony in this morning's preliminary for Anthony Domenico came during the testimony of
KIEM Reporter Monica Petruzzelli; the final witness.

Domenico's own actions and words ended up being his downfall. His off camera interview and audio were played in court. Domenico's attorney did not cross examine Ms. Petruzzelli.

Ms. Petruzelli said she spoke to Domenico "a couple of times." The first time he was standing by himself with law enforcement and he mentioned to her that he had witnessed the incident. She told him she was going to film the fire and come back to talk to him.

When she came back, "a lot of media was surrounding him." She listened to what Domenico was telling them but wanted to have a solo conversation with him, so she waited.

When it was just her, she asked Domenico what he had seen. Domenico told her that "Tommy Uber had set his own home in fire."

"There had been some discrepancy between them. It turned violent," then Tommy Uber set his home on fire.

She said she could provide her entire interview with Domenico, if necessary.  "He basically explained that this Tommy Uber was having some sort of mental thing gping and lit his home on fire."

Following that on camera interview, Domenico leaned over and asked Ms. Petruzzelli, "Camera off?"

"I mumbled something like uh huh."

Domenico said "Off record?" Then he said, "I burnt the motherfucker's place down."

"I said, what did you say?"

"He said it again. Then walked away and smiled at me. I was stunned."

Ms. Petruzzelli went and spoke with the Fire Chief. She went back to the station to check and see if the off camera part had been recorded. Then gave the recording to HCSO Lt. Dennis Young.

Both the disk and a transcript of the disk were entered into evidence. Defense did not object.
