Gary Cudney, the suspect in Dirty Dave's death had setting scheduled today. The defense had filed and requested a motion to continue. The People had no objection and the request to continue was granted.
Intervention is scheduled for July 26. Preliminary is scheduled for July 31. There has been no other hearing since arraignment in March.
Cudney is charged with Count 1 Gross vehicular manslaughter while intoxicated; Counts 2 DU while causing bodily injury and Count 3 DUI while causing bodily injury. Count 3 has a special allegation, personally inflicting great bodily injury in the commission of a felony.
If convicted, Cudney would be punished by an additional and consecutive term of imprisonment in the state prison for three years.
