Under closed session, the Humboldt County Board of Supervisors have two items on litigation; onewhere there is a significant exposure to litigation against the agency and the other to discuss and decide whether to initiate litigation

 


Under closed session on the agenda for the November 18 meeting are two items; one is exposure to litigation in one potential case and the other is anticipated litigation in one potential case.

California Government Code 54956.9(d)(2) allows a local government to hold a closed session with legal counsel to discuss a matter where there is a significant exposure to litigation against the agency.

California Government Code (54956.9(d)(4) allows a local government legislative body to meet in a closed session with legal counsel to discuss and decide whether to initiate litigation. This provision is part of the Brown Act and permits the discussion of potential litigation based on existing facts and circumstances, allowing the government to decide if legal action should be pursued. The agenda for such a meeting must specify that it pertains to the initiation of litigation. 

I am still waiting for Humboldt County to respond to my PRA about First District Supervisor Rex Bohn. The County responded within the timeline to my request about Second District Supervisor Bushnell. The County responded earlier than the deadline to my PRA about being unsubscribed  from three County civic plus lists which was filed after my PRA request regarding the investigation into First District Supervisor Rex Bohn. Let's see if they respond to that request by Monday November 17.
