Kade Chandler arraigned for last year's Hwy 36 accident which resulted in the death of two women and injury to a third male

This afternoon Kade Chandler was finally arraigned this afternoon in Courtroom 5.

The original incident occurred in February 2015.  Chandler was 20 years old at that time.

Chandler is charged with Count 1 gross vehicular manslaughter, Count 2 gross vehicular manslaughter while intoxicated and special allegation of great bodily injury.

Deputy District Attorney Roger Rees is prosecuting the case.

Courtroom 5 was packed with family and friends of the three victims and their lawyers.

Ms. Elan Firpo represents the third victim in the accident, Bradley Thuemler. Mr. Patrik Griego represents the families of the two women, Savannah Kiana Kindred and Kendra Paige Leialoha Lewis. who died in the crash. His colleague David Nims was in court today for the arraignment.
The two women were members of the Blue Lake Rancheria Tribe.

Private attorneys Mr. Benjamin Okin represents Chandler. Mr. Manny Daskal was also in court on behalf of Chandler and requested discovery.

Pleas of not guilty to all charges and special allegations were entered by Mr. Okin on Chandler's behalf. Chandler stood quietly next to Mr. Okin in court. He was dressed in jeans and a striped shirt.

There was discussion about his custody status because Chandler appeared out of custody and people wanted remand this afternoon. DDA Roger Rees also explained why it took so long to arraign Chandler.

"The People are asking the Court to remand Mr. Chandler and to set bail according to schedule," said Mr. Rees.  He said Chandler failed to negotiate a turn and was intoxicated with a combination of cocaine, opiates, marijana and alcohol. "As a result two people lost their lives." One of the women was 20 years old and the other barely over 20 years old, said Mr. Rees.

"Mr. Chandler's conduct puts entire community at risk," said Mr. Rees. " The reason Mr. Chandler is here today instead of an arrest warrant is because the People have kept in touch with Mr. Okin. As a courtesy to him and his attorney, we allowed him to appear out of custody."

Mr. Rees said that the reason arraignment took so long was that before charges could be filed, "significant investigation was done" which included investigation by the California Highway Patrol's Multi-Disciplinary team, DNA analysis and because the individuals were not wearing seatbelts, seating positions had to be determined. The report took a long time.

Judge Hinrichs acknowledged that while there were public safety issues, an arrest warrant contained declarations under penalty of jury and provided information to the Court which would be helpful to make a decision on custody status.

Mr. Okin asked for OR with terms and conditions and said this was a year later and his client was not a flight risk.

"The People were put in a position to charge prematurely than dismiss; the People took the time to gather evidence," said Mr. Rees. "The community should not be punished."

Chandler remains out of custody for now. Judge Hinrichs allowed him to leave "on OR today" with terms and conditions of no alcohol, that he could be subject to chemical testing and search and seizure without an arrest warrant and if he was insured with a valid license, he could only drive to work between the hours of 6 a.m. and 5 p.m. She referred Chandler for a supervised release report from probation.

His custody status will be addressed on February 24 at 2 p.m. Intervention is currently set for February 29 at 3 p.m. and Preliminary hearing is set for March 3 at 8:30 p.m.

On June 9, 2015 the law offices of Zwerdling, Bragg, Mainzer & Firpo filed a personal injury lawsuit in Humboldt County Superior Court on behalf of Bradley Thuemler. 
The suit alleges that on February 21, 2015, Kade Chandler lost control of his vehicle and crashed on State Route 36 while driving under the influence of alcohol. Zwerdling, Bragg, Mainzer & Firpo represent Bradley Thuemler, a passenger who was seriously injured in the incident. The incident also resulted in the death of two female passengers, Savannah Kiana Kindred and Kendra Paige Leialoha Lewis.

On February 21, 2015, at approximately 10:45 p.m., Kade Chandler, was driving his 2005 Toyota Tundra eastbound on SR-36, east of Swimmers Delight.  Due to Chandler’s level of drug/alcohol impairment and traveling at an unsafe speed, Chandler failed to negotiate a curve in the roadway and allowed his vehicle to run off the north road edge and where it collided with a large redwood tree before overturning down an embankment. 
As a result of the collision, Chandler and passenger Savannah Kindred were ejected from the vehicle and sustained major injuries.  An additional unrestrained female passenger (name withheld pending notification) succumbed to her injuries at the scene. Passenger Bradly Thuemler, who was restrained at the time of the collision, suffered moderate injuries.    Chandler and Kindred were transported to Redwood Memorial Hospital.  Kindred was transferred via air ambulance to Santa Rosa Memorial Hospital.  Thuemler was transported to St Joseph Hospital.
Chandler was subsequently arrested for felony DUI and vehicular manslaughter.  He was released to Redwood Memorial Hospital for treatment of his injuries. 
Emergency personnel from the Carlotta Volunteer Fire Department, Bridgeville Volunteer Fire Department, City Ambulance, Humboldt County Coroner’s Office, and the California Highway Patrol responded to the scene.

    Thanks for your Blog. The criminal justice system will take it's course, and while I think it is beyond slow, I know it takes time. I am beyond deeply troubled by the fact that Mr. Chandler has, and continues to posses, a driver's license and has been allowed to continue to drive with no restrictions. For over year!!! Only after this event are some small restrictions emplaced. Explain how this protects the community at large, and provides even the smallest justice to the families? It is so broken how he is posting photo's of his travels on his Facebook page!!! I can clearly state that Savannah Kindred and Kendra Lewis are not able to drive, post photos or take a road trip! No Shame...

    Humboldt County and the State of California; step up and do the right thing.

      I too am amazed that Kade Chandler continues to this day 2/6/17 to have a drivers license. He was under the legal drinking age and in California an underaged driver charged with a alcohol violation there is a no tolerance law which restricts their drivers license for one year. This law didn't even come into play in this case. Absolutely mind blowing. I know today is hopefully the final day of Kade's preliminary hearing and I do hope they are able to finish with this phase of the process and move onto the sentencing phase. Nearing on two years and I pray you are able to put this portion (court process) behind you soon.

    I can't possible know or understand what you must have gone through in the last year and believe me you have my condolences. Being someone who knows Kade I can definitely tell you that he is not shameless. Kade is simple not the same person he was before. Please don't believe for a second that he does not have shame. Those pictures you see on Facebook is kade trying to move on from this terrible ACCIDENT, as I'm sure you are doing as well. he made a horrible mistake, one that he wishes he could take back but can't. I'm still Terrible sorry for your loss.

  5. Colton Ross, Kade seems to have moved on from this horrible CHOICE he made (notice I choose not to use your wording: ACCIDENT) He moved on quite quickly in fact! Kendra and Sav have both paid the ultimate price for being in a vehicle with a driver (Kade) under the influence of Alcohol, marijuana, cocaine & opiates. It is time for him to stop his postponements and pay his price for his part as the driver and allow us, Kendra and Sav's family and friends to move forward in our lives. He has hurt us beyond words and continues to do so with his cowardly postponements. I fail to believe you would be using the words: ACCIDENT and MISTAKE if it were your sister, cousin, daughter that perished thanks to Kade's CHOICE.

    1. The girls also made the choice to get in the car that night. Brad also made the choice to give the keys to kade. But in the end it was a choice that ended in an accident. They could of chose not to get in the vehicle that night. I'm not saying he is not guilty I'm just saying he is not shameless. It was an ACCIDENT.

    2. Where is his shame when he continues to put us through postponement after postponement?? Also, are you forgetting that yes Kendra and Sav made a choice to get into that truck that night BUT they have already paid the ultimate price. Wouldn't you say it's time for Kade to just man up??? I still say if it were your sister, cousin, mother or daughter that perished due to Kade's DUI you would not be so quick to be his cheerleader!!!

  6. Unlike you, I use my name, he is yet to be convicted in a court of law, so I have to use words like alleged. There was an accident which resulted in their deaths. Instead of criticizing me, maybe you could thank me for being the only one to keep up with every postponement and actually cover this case. We will see if there is any delay after today's intervention. You are not the only one frustrated by the legal process, but there are rights. I personally waited two years to see justice for an unexpected brutal death of someone I cared about. I understand your grief but venting it on me when I am trying to keep the public informed is misguided on your part.

  10. Yes, this means the preliminary hearing is scheduled for September 19. Anything could happen before then, it could be delayed again, he could plead out. If it goes as scheduled, and he is held to answer on the charges, then it proceeds to him being arraigned for jury trial.

  11. Hi John, I have been following the Fortuna hit and run case quite closely as I believe the entire community has. I have noticed something that brings a question to me that possibly you can answer. I see that the suspect Marci Marz Kitchen has two attorneys, Ben Okin and Patrik Griego. I also remember that Ben Okin is Kade Chandlers attorney and Patrik Griego represents the families of the two girs Kade Chandler is accused of killing in a DUI gross vehicular manslaughter case still under way. So what I'm getting at is these two attorney's are going up against each other in the Kade Chandler case but are working with each other in this hit and run case?? This seems unethical to me, am I right?

  14. Hi John, I was just wondering if your ever able to find anything out regarding the two attorney's (Okin & Griego) and if there was any thing weird about them working against each other on one current case and against each other on anther current case? Thanks!!

  15. Before responding to you, I checked with a local attorney, his response is the same as I would have given you.

    "The cases are completely separate. The attorneys have an obligation to exercise zealous representation of each respective client in their respective cases. The fact that they join in one case but oppose each other in another case is of no import."

  17. Thank you for looking into that....I was just curious. I figured that the answer would be something to that affect. I guess if I were one of their clients I wouldn't feel warm and fuzzy about the situation though. That's just my person take on it.

  18. I can see all that are involved with this Kade Chandler case are a real mess there is nothing to bring any of this back. I know some of you that are in this sad situation 30 or 35 years ago all of us know that what has happened is a mistake. I told my kids when they where in there teens to never get in a car or truck motorcycle ever when someone is intoxicated I have lost a cousin to a DUI driver will it bring him back NEVER!!! Kade is going to live with this all the days of his life every one of you will also it will not be good at all. I see the Bragg and his group has turned this into money and in the end Kade might do jail time but that won't help any of you been there this now has turned to $$$$$$$ really how will justice be served cold or hot either won't bring any of this back but there will be money given and that is what this is going to be money!!!!

    1. Anon Aug 29 ~ You really make no since!!! You must have been drinking when you wrote this. Looks like you may have had an idea of what you wanted to write but, the words didn't come out right. I will tell you this, this Kade Chandler case is not a $$ show. It's about wanting justice to be served on a punk who has thought he was above the law for way too long. SWIFT JUSTICE is about to happen soonn son!
