"I told him I did not want to. He responded , "That it was okay. That it didn't matter."

Jane Doe # 1 was the first witness for the People. She took the stand after opening arguments.

"Is this your first time testifying in court? How do you feel about being here?"

"Okay," said Jane Doe #1.

Jane Doe is 24 years old. She had been to Petrolia twice, in October 2014 and December 2015.

Jane Doe #1 said Kailan Meserve asked her if she had a minute to talk and "clear things up." Meserve offered her a ride, she agreed so they could talk at the same time." She got into his truck.

"We started to talk  as we started driving." Meservse started to drive down towards the direction where she was staying, then turned down another road. She asked where they were going. "He said he was taking a detour" and she asked to go home.
Jane Doe #1 said she did not remember what he said. She kept telling him she had to get up early. She said Meserve kept saying "I just want to show you where my property is."

She said she started getting worried. She then asked him about the previous night and if anything happened. Meserve said a kiss. She did not recall.

He took her to the area known as the "Grove." She had never been there before. She described the property in court. She said,she remembers a gate but does not remember if the gate had to be opened. Meserve stopped his truck near a trailer.

"I asked him why we were here," said Jane Doe #1. "That is when he started to kiss me. I brought up his wife. He asked me to get out. I got out." She entered the trailer, she said it was his idea . "I don't remember the exact wording, he said that we needed to go in there."

"I told him I did not want to. He responded , "That it was okay. That it didn't matter."

"How did you feel at that time?" asked Deputy District Attorney Brie Bennett.

"Panicked," said Jane Doe. "I didn't know what to think, how to get out of the situation. It was progressing somewhere I didn't want."

Jane Doe # 1 described the inside of the trailer. A small table, a dining area, bedroom in the back.

"I don't remember the words exactly ," said Jane Doe #1. She remembered that "he wanted to get physical. That he wanted to get naked and have sex." She was crying at this point while she testified.

"I told him I did not," said Jane Doe #1. "He removed his clothing, all of it." Her clothes were still on. "They were removed by him."

"How were you feeling when all this was going on? asked Ms. Bennett.

"In shock," said Jane Doe.

They were standing "at first, facing each other. After that I was put on the bed by Mr. Meserve. I was lying down on my back. He was on top of me, holding my hands down."

"Things started getting physical. His genitals on mine." When asked to specify what part of their bodies, she said "his penis" and "my vagina."

When asked what Meserve did, Jane Doe said responded, "He penetrated it." Then she added, "Multiple times."

Jane Doe #1 was looking down as she testified, crying.

She said Meserve was not wearing a condom, "he did not do it until completion." With his hands and mouth he touched her neck and breasts.

"Biting my breasts and holding my neck with his hands. It was painful. It was scabbed for a few days after."

"At one point, it felt like choking, it hurt to breathe," said Jane Doe. While choking her, she said she didn't remember what he said. "I asked him to stop, that I couldn't breathe."

While she could not remember in court, at the preliminary hearing , DA Investigator Kyla Baxley said that Jane Doe #1 told her that Meserve said something to the effect of that she was weak; he wasn't choking her that hard.

During cross examination by Mr. Clanton, she answered his questions clearly and without hesitation. She reiterated during cross that she did not remember what happened the night before the alleged rape.

She acknowledged that Meserve did not try to talk to her when he came over to Sam Epperson's house. She denied Mr. Clanton's insinuation that she asked anyone to introduce her to Kailan Meserve or "strike up a conversation." She said Meserve asked her if she wanted a beer and "I said, no thank you."
