"She threatened that if she found out if he was touching any other children, she would tell what he was doing to her."

On January 5, at 1 p.m. EPD Detective Ron Harpham was contacted by Captain Patrick O'Neill who advised him a complaining witness had walked into the POP office. She said that "she had been repeatedly raped by her father and that these rapes had been videotaped."

"She showed me her phone and some messages on her phone," said Detective Harpham. "I photographed those messages."

A search warrant was served on the address where Jane Doe lives. Det. Harpham conducted an interview and collected forensic evidence. Jane Doe was accompanied to the interview by her 17 year old sister. As of this January, Jane Doe turned 15.

Captain O' Neill had set up an emergency CAST interview. Det. Harpham said he transported Jane Doe and her sister to the CAST office. The interview was conducted by Child Interview Specialist Jed Mefford. Jane Doe has 7 siblings, two older than her. Yang goes by "Jimmie."

"Jane Doe told Mefford that she has been sexually assaulted by her father and he videotaped those assaults."

"Jane Doe said that the first incident occurred when she was 12 years old. The family was on a trip to Fresno to visit her grandmother. Due to shortage of space, Jane Doe shared a room with her father. She woke up with Jimmie on top of her." Jane Doe said her father was intoxicated. "He was pressing his erection against her leg. He was shaking like he was cold but he was warm. She asked him if he needed to masturbate and she could leave the room. He laid on top of her for two hours. Jane Doe said she was very afraid. The following day Jimmie apologized to her."

During the interview, Jane Doe referred to her father as Jimmie. She said she did not tell anyone about the first incident because she was terrified.

The second incident happened in 2013 after they moved to an apartment on (name of street withheld). "He would come into the room and would touch her genital areas over her clothes while he was masturbating."

"Touching her genital area and masturbating continued until she was 13 years old.  Jane Doe asked her father if he was touching any other siblings. He said no. She threatened that if she found out if he was touching any other children, she would tell what he was doing to her."

"The first time she was vaginally raped occurred when she was 13 years old. Jane Doe said she has texted her mom and said she had to tell her something important. Later that morning, Kristy Lee was took the other children to school. After Jane Doe returned home from school, Jimmie was mad because she wanted to talk to her mother. He put all the other kids in their room. He ripped all her clothes and vaginally raped her. She was fighting, told him to stop, he was slapping her legs, holding her hands above her head. He ejaculated inside her, took her to the bathroom and taught her to clean herself out. This is the first time she had anything in her vagina. The incident took an hour.  Jane Doe said that her vagina hurt afterwards; the next day it didn't hurt anymore."



In September 2017, at 2 a.m. Yang started having sex with Jane Doe in his recording studio. Due to the lateness of the hour and the noise, his wife came inside the studio. Yang quit having sex with Jane Doe at that point. "Jimmie was on top of Jane Doe" when his wife walked in on them.

Jane Doe said that her mother discovering them "had the opposite effect due to no consequences to her father. The activity continued for the rest of 2017. Two/three times a week; sexual intercourse and other things."

Jane Doe said "on a given day he would want to have sex, it would last 10 minutes. If she mad ehim angry, he would have sex again with her and it would last closer to an hour."

"In Summer 2017, Jimmie began videotaping portions or all of their sex acts using his phone  Jimmie told Jane Doe they had a family debt issue. He was going to make commercial sex videos for a single person and he would get paid."

"Everytime they had sex, it was videotaped. He would hold the phone or have her hold the phone. Take closeups of genital areas and sometimes body shots. He claimed he was blurring her face."

"The last time they had sex was December 29, 2017 in Fresno at a hotel/motel in Fresno. She was sleeping on the floor. Kristy was sleeping in the bed. He had sex with her on the floor. Jane Doe was holding the phone filming the sex act. She was at the point of no longer resisting."

"Jimmie and Kristie went home to Eureka. The 17 year old sister and Jane Doe stayed behind. Jimmie contacted her and told her to go to an Asian restaurant where he lost a thumb drive. She didn't do it right away. He reminded her that her face was not blurred and if someone found it, they could be in trouble. Jane Doe could not find the thumb drive."

"There was one occasion at the apartment. They had visitors so she and the 11 year old were sleeping on the floor in their parent's room. She woke up with Jimmie on top of her. She had stopped resisting at this point but she did not want the 11 year old to see and she resisted. Jimmie got angryand soccer kicked her in the head."

When that incident happened, Jane Doe "felt his erect penis against her leg. This was a month prior to her reporting the sexual molestation."
"Just prior to Halloween 2017, Jimmie gave Jane Doe oral sex, not every time but frequent. Jimmie never asked her to give him oral sex. ON another occasion, August 2017, Jimmie tried to penetrate her anus with his penis. He did penetrate but it hurt so much that she submitted to vaginal sex instead."

"Jimmie ejaculated every time, either on her belly or outside her vagina. Sometimes she felt ejaculate leaking out of her vagina."

"The 11 year old walked in on them right after they had sex. Jane Doe was on her back naked. Jimmie was getting dressed. Jimmie told the 11 year old Jane Doe was just trying on a Halloween costume and made her leave. There were several other times other family members were shuffling outside the door. Jimmie would stop having sex until it was quiet then continue having sex until he climaxed."

Jane Doe shared with a friend some of what her father had done to her. She shared that her father had been raping her. Jane told three people; one of them her 17 year old sister.

Afer the CAST interview, the 17 yea old sister was interviewed. Detective Harpham took photos of messages between Jane Doe and her 17 year old sister. He went back to EPD. The search warrant had been served. Yang had been arrested. Detective Harpham made sure Yang was aware of his rights and he interviewed Yang.

Yang told Detective Harpham he didn't know why he was arrested. Detective Harpham asked Yang if he had any idea why his daughters would come down and speak  with law enforcement. Yang said, "No. He said his daughters always do whatever he tells them to do." Detective Harpham asked him, "why would your daughter say you were having sex with her since she was 13?"

"Up to that point, his answers were very quick. That froze him. He just said he had a lot of things going on in his life. Detective Harpham asked if his wife knew. He said, "No, it is all on me."

"He put his head down in a subdued tone and said, I don't want to talk about it." Detective Harpham could tell that Yang was embarassed but he inquired if Yang was invoking his rights and clarified to make sure. "At that point, Jimmie just started talking." He talked for two minutes.

"I told him we have laws against having sex with your daughter," said Detective Harpham.

Yang responded, "I am so sorry."

"Jimmie said he apologized to her and she should not have to go through these things."

"But you kept doing it," Detective Harpham said. Yang was quiet and just nodded. Detective Harpham asked Yang if he threatened his daughter. Yang was unresponsive. Detective Harpham asked about the videotapes and asked if it was financial. "It's hard to explain everything," said Yang. "I'm broke to the bone."

Detective Harpham asked how much he got for the videos. "$200-400," was Yang's response. Yang told Detective Harpham that he put the videos on a hard drive and sold them. He explained the process of transferring the video from hios phone to his computer to a thumb drive. Yang also corroborated what Jane Doe said about the lost thumb drive.

Detective Harpham asked Yang if he had molested any other children. Yang said, "No." Detective Harpham asked Yang, "Why Jane Doe?" Yang responded, "Because I was closer to her than the rest of the children."

On a piece of paper, Yang drew the pattern and how to unlock his cell phone for Detective Harpham. Yang also corroborated what Jane Doe's said about his wife and 11 year old walking in on them.

"Jimmie was very embarrassed and did not want me to take his photo and didn't want anything in the news. He had a very well-known reputation in the Hmong community as an entertainer."

"Jimmie thanked me and law enforcement, in general for stopping him from doing what he was doing."

Yang and his family moved to Fresno from Eureka four years ago.

Detective Harpham spoke to Kristy Lee, Yang's wife, at the apartment. Her phone had been taken as a part of the search warrant. Lee said "there was one occasion in 2017 where she walked in on Jimmie and Jane Doe having sex. Jimmie was the primary careprovider because he did not have a full-time job. Lee worked full-time.

On the wall in the master bedroom, there was a camera on which one could mount a cellphone or camera. I could be turned in various directions. Lee said that Yang "taped sex acts between them a long time ago."

EPD Detective Richard Bise wrote a search warrant for the apartment and it covered various items law enforcement looks for in child abuse investigations, including electronic devices and phones. Another search warrant was written and signed by Judge Dale Reinholtsen on January 12 to allow DA Investigator Martin Perrone to search a IPhone 6 belonging "taken off Lee" and a Samsung phone from Yang. "Evidence showed that Jimmie was very skilled at making movies," testified Detective Harpham.

On January 19, DA Investigator Perrone" received a hard drive of 82 gigagbytes of digital data. which contained 66 photos. Some were clearly child porn. All of men having sex with young girls. Themes of daddy daughter sex; mom asleep on the bed while dad had sex with the daughter, themes of violence in obtaining sex."

"Two videos files, one was two minutes and 48 seconds and the the second video was one minute and 35 seconds. Date stamped Jan 2, 2018. Sex acts in the missionary position. Showed pelvic area of a female and a man, naked with an erection, having vaginal sex with the female. The phone twisted and the face was Jane Doe."

 Detective Harpham said "special comparisons" would  need to be made to determine if the man with the erection was Yang but the man's body type was similar to Yang.

Text messages, both SMS and MMS were recovered. Series of messages (including  one MMS message) were exchanged on January 5  between Yang and Jane Doe. "Jimmie was trying to ask V1 to participate in a video."

VI is how Detective Harpham referred to Jane Doe in his report.

Public Defender Marek Reavis objected to transcripts of the text messages being read in court so Detective Harpham did a summation of the messages.

"Jimmie was asking Jane Doe to get together to redo a video." The video they did a couple of nights ago needed to be redone.

"Every time he sent a text, she would say, I'm on my period."

"We need to do with mommy again," was one text Yang sent to Jane Doe. Detective Harpham said that Yang described the sex acts and told Jane Doe, "she needed to be into it" for him to get a "G or $1,500."

He explained "he'd do her for a bit, turn on the light and do mommy for a bit, then hit her again." Jane Doe did not understand what "hit her" meant.

"Jane Doe said, ' I don't want todo it.' Jimmie responded, 'Just do as I direct.' She stopped responding and went to the POP office."

"There were other videos of Jane Doe engaged in sexual acts found on Google drive. Search warrant was obtained. Picture of bed in the mastee bedroom. You see Jimmie adjusting the camera. A dejected female sitting on the bed, appeared to be Jane Doe. It was confirmed that it was Jane Doe with other videos."

Another video, 8 minutes in length. "Jane Doe sitting on a couch. She was disrobed from the waist down. Compliant, in dejected mode. Jimmie goes over and performs oral sex. Jimmie gets phone. Makes Jane Doe hold it while he is giving her oral sex, then has vaginal sex and then he ejaculates on her."

Third video, 33 minutes, filmed in master bedroom. "It is clear Jane Doe is wearing a tshirt, naked from waist down. She is dejected, head slumped down. Jimmie approaches her, she lays there emotionless. About 17 minutes into the video, knock on the door, Jimmie still in missionary position, tells child to go away. Jimmie continues having sex. He tries to pull her shirt up to expose her breasts, he manages to do so, fondles her breasts. All this time Jane Doe lays lifeless. At 22 minutes, he brings her legs up high and continues fornicating with her. At 33 minutes, he tries to get her to straddle him, when he has her on his lap, she just slumps and is lifeless."

Detective Harpham testified about Facebook messages between Jane Doe and a friend, Brandon Lee who lives in Fresno. He encouraged her to go to law enforcement about what her father did to her.

There is a Facebook message in which Jane Doe expresses fear that if going to law enforcement is not successful, that she is afraid if law enforcement doesnot believe her, "then her father would beat her."

There was a Facebook message where Jane Doe wanted to spend the night at her cousin's house to get away from "her situation." When that does not work out, she tells the cousin, "I've been rapedfucking 6 times." On January 6, 2018, after she has talked to law enforcement, she tells her cousin that the night she threw a tantrum, "the person who did that was my dad."
