I just spoke with Mr. Kling and congratulated him. The jury deliberated for a bit Friday and then today, had a verdict.
Hired at the end of September, this was the first case, he took to jury trial. Mr. Marek Reavis from Conflict Counsel represented Hart.
After a five day jury trial before Judge Marilyn Miles, jurors returned a verdict of guilty as charged against Philip Scott Hart. Hart, 62 of Eureka, was convicted of driving under the influence as well as finding true a special allegation that his blood alcohol content was over 0.15%, a violation of California Vehicle Code Section 23578. The case against Hart arose from a vehicle stop on October 31, 2014 conducted by Eureka Police Department Traffic Officer Dave Chapman, in a restaurant parking lot in the 1300 block of Broadway in Eureka. The case was prosecuted by Deputy D.A. Brent Kling with assistance from D.A. investigator John Burke and Department Information Systems Analyst Tom Pinto. Hart was represented by the Conflict Counsel’s Office.
