Steven Upton being sought in E street shooting same guy who refused to testify in the Bodhi Tree case

There are several media reports about a woman being shot at Grant and E street.

I lived across the street from that building several years ago.

 The alleged suspect being sought is Steven Upton, the same guy that refused to testify in the Bodhi Tree case. He was held in contempt by Judge Dale Reinholtsen.

He is the one that took Rhett August to the hospital after he was shot last year.



Eureka Police Department Press Release:

On 5/12/13, at about 7:30 PM, a Eureka Police Department officer on uniformed patrol saw a black 1999 Mercedes sedan traveling westbound on the 200 block of 14th Street, Eureka. The officer conducted a traffic enforcement stop on the Mercedes for an observed vehicle code infraction. The driver of the Mercedes, later identified as Steven Nicholas Upton, yielded on the 1300 block of ‘A’ Street.
Upon contacting Upton, the officer recognized him and recalled he was presently wanted for a recent felony domestic violence offense. The officer subsequently took Upton into custody. During a search incident to his arrest, the officer located several grams of marijuana and drug use paraphernalia on Upton’s person. The unemployed Upton was also suspiciously found to be in possession of multiple $100.00 and $50.00 dollar bills. Additionally, Upton’s 32-year-old male passenger was on felony probation
Officers conducted a search of Upton’s vehicle. Under the driver’s seat, officers found a loaded .40 caliber Walther P99 semi-automatic pistol. A criminal history check confirmed Upton was a convicted felon and thus prohibited from possessing firearms or ammunition.
Upton (age 23) was arrested for carrying a concealed loaded firearm in a vehicle, being a convicted felon in possession of a firearm, and being a prohibited person in possession of ammunition. He was transported to the Humboldt County Correctional Facility where he was booked on the aforementioned felony offenses in addition to the separate domestic violence charge.

Eureka Police Department Press Release:

 On 11/14/12, at about 10:00 AM, investigators with the Eureka Police Department’s Problem Oriented Policing (POP) Unit conducted a probation search at an apartment located on the 1400 block of Bay Street, Eureka. This was in response to complaints that non-renters had illegally moved into the apartment resulting in increased “traffic” there.
Investigators contacted Steven Nicholas Upton (age 22 of Eureka) and his girlfriend, Beatrice Braheda Runner (age 24 of Eureka), inside the apartment. A records check confirmed Runner had 5 active warrants for her arrest for offenses including possession of a controlled substance, petty theft, and possession of marijuana. Runner was also currently on formal probation for possession of a controlled substance.
During a search of the apartment, investigators located a loaded .38 caliber Smith and Wesson revolver, ammunition, and approximately 24 ½ ounces (1.5 pounds) of processed marijuana bud packed for sale in multiple bags. Investigators also found additional evidence of drug sales activity including a digital scale, indicia indicating narcotics trafficking, packaging materials, $1,550.00 cash (suspected drug sales proceeds), and a large quantity of cutting agents (MSM and super lactose powder--A cutting agent is a chemical/substance used to "cut" (dilute) illicit drugs to increase profits). The MSM was packaged in a manner and appearance made to look as if it was approximately 1 ½ ounces of crystal methamphetamine for sale in 5 individual baggies.

Upton and Runner were arrested and transported to the Humboldt County Correctional Facility where they were booked for possession of marijuana for sale, possession of drug paraphernalia, unlawful possession of a firearm by a convicted felon, maintaining a place for the purpose of unlawfully selling, giving away, or using a controlled substance and other drug related offenses. Additionally, Runner was arrested and booked on her warrants.

    1. The police have not released a press release and photo yet. I saw him briefly a year ago in court. Looking for a picture.
