Andrea Heather Avelar was arrested by HCSO yesterday for PC 273.5(a) corporal injury to a spouse or cohabitant more commonly known as domestic violence. Bail is $50,000.
Based on court records, my hunch was confirmed and this is Mario Avelar's wife. She has a 2018 DUI conviction. In the 2018 case, Andrea Heather Avelar aka Andrea Schafle is listed on the complaint. A Fortuna address is listed in e court in the 2025 case. A family law case with DV prevention was filed on 3/19 and Mario Avelar is representing himself pro per.
I have seen both Mario and his wife. I have read the claims in the court documents. Mario has zero credibility with me. Besides my coverage of him on the blog, my own personal experience with him during the Ray Christie case. He is a big guy. So let's see how this case unfolds. Mario has listed his 17 year old step son and 7 year old daughter in court documents. I am going to see if the DA filing redacts their names. I have not added many page that list the 17 year old step son and 7 year old daughter Mario and Andrea share except 1 page where Mario describes an alleged incident. As I said these are public documents anyone can look up. If you have an issue, take it up with Mario who is too cheap to hire a lawyer who could have figured out a way to keep the children's names out of the only page I listed.
Mario is so fearful of Andrea but he wants peaceful contact. The EPO given by HCSO Deputy Hunter Etheridge expires on 3/21/25. The TRO has not been granted in the FL case and no date has been scheduled.
The DA filed a complaint on 3/19 and charged Avelar with one count of PC 273.5 (a). The alleged victim is listed as John Doe. Avelar was arraigned on 3/19. The Public Defender's office was appointed to represent Avelar. A criminal protective order was filed and served in court. Deputy District Attorney Jessica Watson told Judge Lawrence Killoran another protective order will be filed with the children listed as protective parties at the OR bail hearing.
OR bail is on 3/21; preliminary hearing on 3/28.
Charges:
3/28/25: Preliminary hearing continued by defense to 5/7 because Avelar has hired Ms. Kathleen Bryson. Public Defender's office was relieved. In her family law case, a hearing is scheduled for 4/14 on Mario's request for a TRO.
4/14/25: In the family law case, Ms. Bryson appeared with Andrea Avelar. Mario Avelar does not have an attorney. See court minutes for more details. On 5/12, there is a hearing scheduled on ylthe request for domestic violence order + status of Andrea Avelar admittance to Healthy Mom's program. On 8/11, Request for domestic violence order-R/CCRC.
