Detective Chris Ortega was very briefly recalled to the stand today where he was questioned about the hospital interview and that Ferrer made a motion twice and held out his hand as if he was holding a knife.
Dustin Holtz, a co-worker of Douglas Anderson was, a witness for the People. Holtz said he knew Anderson and was "friends" with him and "we were fairly close." He added that he only knew Anderson from work.
After he took the stand, DDA Roger Rees asked him if he had been arrested for a DUI in January 2015 and if he had plead guilty to that charge. Holtz answered yes. he also said he had no other convictions. Holtz spent a couple of days in the jail and was housed in the same dormitory as Juan Ferrer.
Holtz said that on his last day there, Ferrer approached him and told him that he had heard that Holt worked at Abruzzi's. Holtz said he was aware of who Ferrer was and his connection to the death of Anderson.
Two weeks ago, DA Investigator Jack Bernstein contacted Holtz about the conversation he had with Ferrer. Holtz said that Ferrer offered him condolences.
Mr. Rees: "Did he say anything about what happened that night?"
Holtz: "He (Ferrer) was walking up the street and heard loud sounds. He said Doug was intoxicated and yelling obscenities at his girlfriend. There was a struggle, a verbal confrontation. Eventually, he ended up stabbing him. He told me that he didn't think Doug was killed. "
DDA Rees: "Did the defendant tell you that Doug came at him with a knife?"
Holtz: "Yes."
Holtz said that Ferrer told him that he was "able to disarm Doug."
DDA Rees: "Did defendant tell you whjy he stabbed Doug?"
Holtz responded that Ferrer thought "Doug was a transient."
DDA Rees asked Holtz why he did not offer this information to law enforcement and Holtz said he assumed that with the case going to trial, law enforcement already had that information.
Ferrer took the stand again and he said that "Pretty much everything he (Holtz) said was right but that I didn't go into details of the altercation." And Ferrer also denied that he said anything about "Doug" pulling a knife.
"I wouldn't jeopardize my case by discussing details of the actual altercation," said Ferrer.
DDA Rees then pointed out a statement that Ferrer had made a coupple of minutes earlier that he had talked to other people about the build-up to the altercation.
