On March 20, he gets 270 days; Randall Miles Cook out on SWAP already, with no victim notification

On March 20 this year, Randall Miles Cook was sentenced to 270 days in jail by Judge Marilyn Miles for molesting his own 7 year old granddaughter.

Originally the plea had no jail time. Cook, of Cookhouse Realty, who is also a member of Humboldt Association of Realtors plead guilty to a felony on 12/17. The charge is child endangerment. PC 273 (a). This was a change in plea. Two charges of PC 288 (a) were dismissed. 

There was no notification to the victim and her mother. The victim's mother just returned from a vacation yesterday to find this out on her own. "My daughter was robbed of justice," said Veronica Cook. "And then I find out Randy has been released last Thursday."

During the court proceedings, Randy Cook showed no remorse. The family members' demeanor towards Veronica Cook, the daughter in law was hostile. 

If Randy Cook was released from custody, the Sheriff or the Department of Corrections would make that decision.

ADA Kelly Neel who prosecuted the case had left for the day but was kind enough to get back to me and let me know she will provide a response tomorrow when she is in the office and can look at the file. 

Ms. Neel told me that Penal Code 4019 which allows good time credit and if the sentence left is a certain amount of days, the inmate can apply for SWAP. That was confirmed by Lt. Marco Luna who supervises SWAP.

Randy Cook served his time in custody, he received good time credit. Lt. Luna said he was SWAP eligible. He was evaluated for risk. Since his felony was reduced to a misdemeanor and since he was not a registered sex offender, he was put on SWAP.

Since Randy Cook's attorney, Michael Robinson, had mentioned he had medical issues at sentencing, I brought that up to Lt. Luna. He said not all SWAP work is labor intensive.

  4. A plea should not be allowed for cases involving child molestation. There should be no excusing someone from having to register. That puts all other children in danger.

  5. I agree! This man is our property owner and upon doing research I'm sad to find this out because he randomly stops by our property sometimes and I have very small children. He was caught in the backyard taking pictures when he thought nobody was home and today he randomly rolled by in his car. A silver brownish Chevy with a Jesus fishy on the back. I understand why he'd like to check up on his property that he owns. But we live right down the street from a school and I don't think he has any right to come by his property randomly if he these allegations exist. Especially if he just got away with this SWAT bs. What a creep! I feel horrible paying rent to a man whom allegedly molested his grand daughter and has took her innocence forever! Everytime I see this man roll by or come by our place I get a sick feeling in my stomach! I think a law should be passed that we should know who we are providing for by paying our hard earned money for this mans well being. Child milestones deserve lethal injection and should NEVER get away with SWAT.

  6. I don't understand how this man is able to rent his property out secretly through a property management company in Humboldt county when these allegations exist. We are currently renting one of his property's through pacific property management and we've had some problems. He was caught randomly popping by, taking pictures of our backyard when he thought no one was home and being a creep on his own time. I have two very small children! This man makes me sick to my stomach and what an insane world we live in when a child molestor gets away with some community service and doesn't get lethal injection. I purpose they make a law that when we decide to rent and shell out our well hard earned money to a property owner that we also get to do a background check on them. I sure has hell wouldn't have signed a one year lease to feed this old excuse of a man. He randomly rolled by today in his silver Chevy with a Jesus fishy on the back (Dear god I hope he repents) and boy do I feel sick to my stomach everytime I see his face!
