Retired Judge Wilson read the arraignment on information and every current charge. Judge Wilson is familiar with Brewer Hearst criminal history including his juvenile case. Judge Wilson said Brewer-Hearst is a convicted felon and the possession of firearm charge, his priors which include the same charge for a different firearm. Judge Wilson mentioned Brewer-Hearst's involuntary manslaughter conviction for the death of Taevonne Latimer.
Ms. Andrea Sullivan asked for a bail reduction since Brewer-Hearst was not held to answer on Count 5. I covered this in my post of the preliminary hearing. Deputy District Attorney had indicated he was going to ask for a no bail hold.
Mr. Harris said bail according to schedule should be $750,000. That the count in the complaint that Brewer-Hearst was not held to answer at preliminary hearing had been replaced with another drug charge in the information. He went through Brewer-Hearst's priors and said he now has a "third strike" and that he was arguing for a no bail hold.
Mr. Harris Brewer-Hearst said that Brewer-Hearst was "a danger to the community" and "is a flight risk." Mr. Harris was arrested when he was in "abscond status."
Ms. Sullivan asked Judge Wilson not to take notice of the juvenile case. Regarding bail, Ms. Sullivan cited the Humphrey case. She asked that the bail be reduced to $200,000.
Mr Harris said that Brewer-Hearst had retained a private attorney. There was no financial declaration to determine the bail reduction.
Judge Wilson said the juvenile case was admission in an open court proceeding due to the serious nature of the charges. Judge Wilson said "he was taking judicial notice of the juvenile file. That case resulted in the death of another individual."
He repeated what Mr. Harris said about Brewer-Hearst being on supervision when he was arrested and "on abscond status." Judge Wilson added " he entered admission before me."
Judge Wilson said Brewer-Hearst was "a danger to the community. After citing case law, Judge Wilson said, Brewer-Hearst "was not eligible for release on non-financial terms, that any bail amount he can meet would not address public safety. "
Judge Wilson denied defense request for bail reduction and granted the People's request for a no bail hold. Brewer Hearst entered a time waiver. Ms. Sullivan mentioned on record again that defense intends to pursue mental health diversion.
Readiness Conference on 4/10; jury trial on 4/21. Bail reduction requested by defense denied; People's request for no bail granted. Defense reiterated pursuing mental health diversion.
