Trial setting and a case management conference is scheduled in the Nylander vs Nylander lawsuit involving Redwood Meat Co.
The latest development are two filings on March 14 and March 25 by Ms. Shelley Addision on behalf of Marleen Nylander.
Marleen Nylander denies all allegations. In her March 25 filing, Ms. Addison's description of the case on page 2 of her March 25 filing is accurate and made me chuckle when I read it. It is a perfect summary of the family drama that is now a lawsuit. "Plaintiffs filed a derivative shareholder's suit against their father and cousin re: Redwood Meat Co. The father and cousin filed a cross complaint against the father's ex-wife."
For some reason, Ms. Addison's name is not listed as attorney in e court and there is no document in ecourt that she is the attorney for Ms. Nylander.

Spoke with Tom Tellez in July 2024. He is the owner of Wallace and Hinz. I have spoken with Tom many times. Usually it was about compliments from people and I have reported on Walace and Hinz' unique, custom bars for local businesses.
I covered Wallace and Hinz' lawsuit against Joe Mazzotti. That case is still open. There was a warrant issued for Jean Mazzotti on 11/25/24. Joe Mazzotti's still owes Wallace and Hinz money. That is from court records and I confirmed with Tom today.

Retired Del Norte Superior Court Judge Robert Cochran was publicly admonished by the California Commission on Judicial Performance last month for serious misconduct towards a domestic violence victim.
Judge Cochran waived his right to formal proceedings under rule 118 and to review by the Supreme Court.
Maybe if the California Governor's Judicial Appointments staff did their job and the California Judicial Council actually paid attention to local courts; people would not suffer abuse of power and have their lives ruined.

Instead of the lawsuit being dismissed, now Fortuna Elementary is working on possible resolution with former employee
This is why I follow up to make sure the dismissal hearing is final. In April 2023, I reported on a lawsuit filed by Vickie Victorine lawsuit against Fortuna Elementary District. The case settled in October 2024 but the settlemental was conditional. A dismissal hearing was continued twice and rescheduled for the third time on 3/24/25.
Fortuna Elementary attorney, Mr Nicholas Kloeppel told Judge Timothy Canning the parties were working towards a possible resolution.
Victorine and her attorney, Mr. Dwight Cooper were not present.
EPD investigating assault on local older attorney that occurred in office parking lot
Eureka Police Department is investigating an assault on a prominent, local family law attorney and I was told by sources there is a suspect. Older male, fit and a former marine. He was hit at in the back of the head in the parking lot of his office and has broken ribs.
EPD is investigating and each case is different. Since this is an ongoing investigation, EPD is limited in what they can release and confirm. EPD did not release the name. People in the legal community know.
3/28: It has been a couple of days and several people know and have expressed well wishes so I am updating the post that it was Mr. Delman Smith and his office is at 1026 3rd S. He is at home now.
4/1: No suspect. EPD is still investigating.
Commissioner Sarah Kaber, Humboldt County Deputy District Attorney Jessica Watson and a female Humboldt County Deputy Counsel being considered as replacements for Retired Judge Joyce Hinrichs' seat
I have written previously about potential replacements for Humboldt Superior Court Retired Judge Joyce Hinrich's seat. In my December 2024, I reminded people that former Judge Hinrichs told people in the legal community that in exchange for retiring early, she wanted a say in who would get her seat on the bench. Commissioner Sarah Kaber and Ms. Jennifer Dixon were names mentioned to me months ago.
The latest update is that surveys are being done to get input about three women. Commissioner Sarah Kaber, Humboldt County Deputy District Attorney Jessica Watson and a female Humboldt County Deputy Counsel. Everyone jumped to the same conclusion that it is Humboldt Deputy Counsel Heather Cooper. I can tell you that it is not her.
Governor Gavin Newsom's office of Judicial Appointments is not going to comment while this is going on; I have contacted them before.
I have often said and recently to several people at the Courthouse that instead of wasting money on Visiting and Retired Judges who rotate in Courtroom 2; they should just appoint Commissioner Kaber. And then find someone to replace her vacant position. They did that with former Commissioner and now Judge Timothy Canning.
I have no input but my choice from those three options would be Commissioner Kaber. Based on her rulings, her demeanor in court and the positive feedback from court staff and bailiffs; she is the obvious choice. There are many in the legal community who agree with me. These are the people who would appear in front of the next Humboldt Superior Court judge and for once, I hope the California Judicial Council listens to input. The JCC for once, could do something that would benefit Humboldt Superior Court.

It takes seconds for someone to assault you. There are some known criminals, potential criminals and others who lurk mainly on 5th street from the bus stop near Eureka City Hall to 5th and Broadway.
I am not the only one in danger. I have written about some encounters before but this time there was no place to take shelter and this was in in the middle of the day around lunchtime. Others will relate to the post because if you work or live downtown; this is a daily occurence. I don't think these two different people who I encountered at different times today know me. I just happen to be the target available at that time for the misdirected hate of two people who cannot be bothered to change their situation. It was the afternoon encounter where I narrowly escaped getting assaulted.
Frank Alves held to answer to forcible rape, lewd act by a caretaker on a dependent adult and forcible sexual penetration with a foreign object
On March 8, I reported that 61 year old Frank Emanuel Alves was arrested yesterday by HCSO on a Ramey warrant and booked for PC 289(b) forcible sexual penetration with a foreign object, PC 288(b)(2) lewd act by a caretaker on a dependent adult, PC 209(b)(1) kidnapping and PC 261(a)(2) rape by force or fear.
I added the three felony charges that the DA filed as well as the Ramey warrant to that post. Charges in the complaint by the DA are sometimes are different than what the suspect is arrested for after the DA reviews the report and this type of case, the CAST interview. The DA charged Alves with PC 261 (a) (2), PC 288(b)(2) and PC 289 (b).
Alves was the landlord caregiver for this dependent adult who is the alleged victim.

Idaho trucking company sues Ray Christie claiming he owes them $574, 599.79 for cattle hauling services
On a hunch, I checked e court today. Sure enough there is a 2025 case filed by Prince Trucking against Ray Christie.
The civil unlimited breach of contract was filed on 2/25/25. The first hearing is a Case Management Conference on 8/5/25.
"Plaintiff is a trucking company located in Idaho doing business in California. Defendant is a livestock dealer."
Prince Trucking claims Christie owes them $574, 599.79 " for cattle hauling services. There are details and specifics, interest and attorney fees requested in the six page complaint.
Prince Trucking represented by Mr Randall Cooling Nelson from Carr, Kennedy, Peterson and Frost which is a Redding law firm.
There is no attorney listed for Christie. I checked with Mr. Rick Richmond who represented Christie in his 2018 case. The Larson Law Firm is not involved with this case and had no knowledge of it until I contacted Mr. Richmond.
Last time I was in court for Christie's 2018 case on 1/9/25 was for the dismissal of that case which I reported on and was only covered on this blog. I was walking out with Mr. Richmond after court when a woman approached Mr. Richmond saying she needed to talk to him. The reason was that she claimed Christie owes her money.

School threats suspect Daryl Jones had a Arcata address in his 2016 local traffic case
Terrorist threats suspect Daryl Ray Jones of Lawton, Oklahoma who called over 20 schools and businesses will be extradited to Humboldt County. He is still at the Comanche County Detention Center as of yesterday. As I said, their inmate search and online information is terrible. I called right after he was arrested and they told me there is no one by that name.
I searched court records for Jones. He has a 2016 traffic case in Humboldt Superior Court for speeding. Jones paid $489 in fines. His previous address in court records for 2016 was on Heindon Road in Arcata.

On 3/21/25, there was a case management conference in a lawsuit filed by Green Leaf Nurseries LLC, et al. v. County of Humboldt, et al. The general category is civil rights. It was continued to 7/18/25 as requested by the County.
Mr. Patrik Griego of Janssen Malloy has appeared on the case as plaintiff Green Leaf Nurseries' attorney. At the 3/21/25 hearing Mr. Frank Martin from Janssen Malloy appeared for the plaintiffs.
The Mitchell Law Firm is representing defendants County of Humboldt HCSO, Sheriff William Honsal and three HCSO deputies and one HCSO Sgt are defendants named in the lawsuit. Two of those names you will recognize from the recent Widmark trial Sgt. Conan Moore and HCSO Deputy Chad Crotty.
No other media has covered this lawsuit. I first reported on this lawsuit in August 2023.

Supplemental case management statement from the Mitchell Law Firm has a file stamp of 2/6/25 but the document is signed and dated 3/5/25. Defendants asked for a continance in approximately 120 days.

When I checked the case on 3/21 and again this morning, the plaintiffs had not filed anything.

Why is this one 2024 case for Callie Buck still on calendar?
The last post I did on local attorney Callie Buck was on 10/26/24. In September 2024, she resolved three of her criminal cases. In August 2024, I reported the civil lawsuit against her was dismissed.
It seems one 2024 case is outstanding and you will see from the court minutes I have provoded, a reference to another case CR2401594 which I covered previously and resolved.
CR2401593 is the case that had disposition reset on 3/18. It was dismissed by the DA.
My guess is the rabbit hole that passes for Humboldt Superior Court overlooked this case, it was not on calendar, no one noticed it and the problem is getting fixed. No big deal. Just someone's life on hold due to the usual incompetence of the California criminal justice system. The CA Judicial Council is the most useless state bureaucratic, unnecessary organization. They don't monitor courts. They don't do anything about complaints. Judges aren't going to hold other judge'saccountable. I used to think it was the CA Coastal Commission.

On 3/20, Larue's preliminary hearing was continued by defense since Ms. Andrea Sullivan is waiting on verdict in ValentinDiaz rape case. This was on the same morning, the Widmark brother trial resolved and sentencing was being scheduled. Preliminary hearing rescheduled for 4/10.
Larue said he maybe hiring private counsel. Ms. Sullivan is a private attorney and a good lawyer. If Larue had the money, why did he make taxpayers pay for private court appointed counsel?

10 days after the last hearing in the lawsuit filed by local law firm Janssen Malloy attorneys, Ms. Meagan Yarnall and Mr. Jeff Slack on behalf of Don Swall and Vanessa Vachon, Ms. Yarnall filed an amended declaration.
Swall and Vachon are two tenants of Hillsdale Apartments who are suing Dwivedi Tower LLC and the owner, Mr. Anil Dwivedi who took over the property in January 2025.

I have been adding updates to the last post I did on Lucas Russell. The last update was that Readiness Conference was continued to this morning for discussion about resolution. After rejecting the People's offer last July, just minutes ago and right before his jury trial scheduled for Monday, Russell just entered a plea in his molestation case.

There was a plea this morning after some back and forth and hold up by Brandon Widmark who had at least three in court discussions with his attorney, Ms. Rebecca Linkous. As Deputy District Attorney Roger Rees detailed the pros and cons of the plea offer, Brandon Widmark finally got a clue.

Arcata Police Department sent out a press release. Eureka Police Department also issued a brief press release later. I followed up with APD Chief Bart Silvers. APD is the lead agency. As I expected, the suspect's name is not being released at this time.

Anakalia Sullivan, a local attorney and one of my advertisers, was arrested by Eureka Police Department for VC 23152 (a) and VC 23152(b) last night. She was booked and released on OR.
Booking photos are no longer released after the Ninth Circuit ruling. I have reached out to EPD to see what they can release and confirm. One of my questions was about confirming the location.
I have also reached out to Ms. Sullivan and gave her the option to officially comment. I am fine if she does not; that is what any lawyer would tell their client. She is extremely busy. She just completed the Widmark trial, has another trial and several preliminary hearings.
I may update the post. Just like any other case, the DA has yet to review a report and charges have not been filed.

Mr. Patrik Griego of Janssen Malloy represented Littlefield. In another lawsuit, Mr. Griego and Ms. Meagan Yarnall of Janssen Malloy represented ENF again. That case was ignored by the local media.

DA dismisses case against Carla Jean Pirovano
Carla Jean Pirovano was arrested in August 2023 for criminal threats. The count was reduced to a misdemeanor by the People before a preliminary hearing took place. The case was then scheduled for a disposition reset.
Yesterday, the DA dismissed the case. The protective order was terminated.
