Timothy Littlefield has been accused of molesting a female minor victim and in his first trial, the jury deadlocked 11 to 1. In his second trial, he was found guilty of 11 molestation charges but a mistrial was declared after the verdict. The Judge's decision in the second trial is being appealed.

So little surprise here. Littlefield's new appellate attorney got the permission of the Court to file a supplemental brief. They likely raised new issues and the people represented by the AG wanted permission to supplement their reply brief and address these issues. They got that today and the court ordered their supplemental reply brief filed. There is also a pending request for judicial notice taken under submission. The people are opposing that. It is likely something to do with the fact that his prior attorney had agreed to a 6-month suspension prior to her working on his brief. She was suspended shortly after it was filed. His new attorney is setting up a possible ineffective assistance of counsel claim on his former appellate attorney. That argument is probably obviated by the new briefing that was allowed.

DeleteI would say 2-4 months. Probably closer to the 2, since presumably the issue and legal analysis has already occurred by the Appeals Court Staff Attys.

ReplyDeleteThank you for your response. I know the next court date is today, but I assume another continuation will be ordered until things happen at the appellate level. In the interim, Is Mr. Littlefield legally bound to humboldt county, or is he free to leave the county. I know the terms of bail include the promise to stay within the county...but in this situation, is he allowed to leave town whenever he pleases?
