Next Warren court date more than just pre-trial hearing: City Attorney's motion to squash subpoena of EPD Record Supervisor and County Counsel's motion to quash defendant's subpoena

The court dates for one of Jason Warren's cases are as follows: March 18 Pre-Trial Conference at 2 p.m. in Courtroom 4, August 5  Trial Confirmation at 2 p.m. and the Jury Trial is scheduled for August 17.

As I posted yesterday, I was not there for the entire court hearing yesterday in Warren due to covering the Bullock case in another courtroom. Both cases have gag orders.

This was not mentioned in the T-S' coverage of the Warren case yesterday so I am not sure if it was addressed in court yesterday.

Due to the gag order, the best I can do is interpret the abbreviations in the court computer. It seems that the Eureka City Attorney has either filed a motion or a declaration in support of a motion to quash a civil subpoena of Erin McBride, EPD's Police Records Supervisor. There is also a motion by County Counsel to quash a subpoena by the defendant.

These motions are scheduled for March 18, 2015 and Judge Timothy Cissna may rule on that day after attorneys present arguments.

From avvo.com:

"A subpoena is a command under court rules to provide certain documents or to appear at a deposition or hearing. The person who is commanded to appear or produce documents may not agree that he or she should have to appear or produce. The motion that person files is a motion to quash the subpoena. If the court agrees, the court issues an order quashing a subpoena. It is an order by the court that the command to appear or produce need not be followed. A motion to quash is generally the only legitimate way to avoid a subpoena, unless the attorney who issued it agrees to voluntarily withdraw it"

  1. re: Bullock case
Hi John, is it because of the above referenced gag order, I have read nothing about the Bullock trial? Am I to assume that the trial has started and is on going?

    Thanks.

  3. I was remiss in checking the "Notify me" box in my 1st comment (@12:45 p) so I tried to make up for that request in my following comment (@12:47 p).

Regardless, what is the current status of the Bullock case? Thanks.
