Family of Gary Lee Ross yells at his attorney; Ross is charged with burning a 60 year old over an argument over cigarettes and will be sent to Porterville State Hospital

Gary Lee Ross was in Courtroom 5 today and a report was given from the Redwood Regional Center to Visiting Judge Philip Schafer, Ross' attorney David Lee, and Deputy District Attorney Stacey Eads.

Based on the recommendation of the Redwood Regional Center, Ross will be sent to the Porterville State Hospital. Mental health has been ordered to prepare a medication order before the DA's office can prepare the transport order for Ross.

A hearing for status of that medication order is scheduled for November 9 at 2 p.m.

Ross' family was in court and after the hearing, they were talking with Mr. Lee. They were not happy with the Redwood Regional Center recommendation. They yelled at Mr. Lee who was trying to explain to them that criminal proceedings were suspended until Ross was evaluated for competency to stand trial, "What if he is found innocent? He will not get this time back. Thanks a lot for your help!"

Criminal proceedings suspended for Gary Lee Ross, who burned a 60 year old over arguments regarding cigarettes

Last week, upon request by Gary Lee Ross' attorney David Lee, Judge Marilyn Miles ordered that that criminal proceedings be suspended in his case and an evaluation was ordered by the director of the Redwood Regional Center. PC 1368, 1369, 1370 were discussed. Judge Miles said usually a court appointed psychiatrist does the evaluation to determine whether the client is competent to stand trial or not and Mr. Lee pointed out a sentence that gave the Regional Center that authority to do the evaluation and they can refer to psychiatrist.

Ross is a client of the Regional Center. His family was present in court.

  1. Commitment to Porterville usually means a defendant is incompetent due to a developmental disability, which is consistent with being a regional center client. There's usually a loooong wait for bedspace. There isn't much a defense attorney can do about any of this, given the nature of the charges.
