"I told him I didn't want it to happen and to stop but he touched everywhere", testified second alleged victim and HSU student

Jane Roe, the second alleged victim who testified at the preliminary hearing for Andrew Stone yesterday, also met Stone through Leon around the same time, Fall 2014. She said she did not "interact often with him", would go over to the apartment he shared with Leon. She did not recall what date the alleged rape occurred in February. She said she did not want a romantic relationship with either Leon or Stone.

On the day, the alleged rape occurred, it was just Leon, Andrew and her "listening to music and drinking." Jane Roe said that Leon fell asleep and that she was going to leave but "Andrew asked me to stay." They talked "about random things." She described the apartment and sais they were sitting in the kitchen and talking.

When she stood up to leave, Stone asked her "not to go" and touched her hips.

"I told him I didn't want it to happen and to stop but he touched everywhere. I told him to stop and tried to leave but I couldn't" because he had her "pressed against the counter." She said Stone touched her hips, shoulder and torso. Jane Roe said that Stone did not kiss her.

"He started to pull my pants down, I was facing the counter and he was behind me. He got my pants down almost all the way " and continued to touch her in the same places.

Ms. Bennett: "Did you see his penis?"

Jane Doe: "Yes."

Ms. Bennett: "Did you feel his penis?"

Jane Doe: "The back of me."

Ms. Bennett: "Back, butt, leg area?"

Jane Doe: "Yes."

Ms. Bennett: "Was he moving?"

Jane Doe: "To try and get it into me." She then clarified penis into vagina.

Jane Doe: "I was telling him to stop and he kept going for a couple of minutes. He stopped after he pushed hard."

She said he then walked away and asked her what was wrong.

She left and walked back to the dorm. She called a friend on the way back to the dorm and told the friend what had just happened and she later told Leon. She did not know Jane Doe until Leon called her to get them in touch.

Jane Roe was also asked to do a pretext text to Stone. She mentioned to him that she was worried about that night and she told him she had asked him to stop. Jane Roe said Stone's response was that "he didn't know I felt that way and he was sorry."

Jane Roe said that she felt "upset, scared and shocked" while the alleged rape was taking place.

Ms. Bryson's cross examination was brief. She got Jane Roe to admit that Stone did not cover her mouth, hit her or force her, that she did not scream or try and wake Leon up, and that Stone did not ejaculate.

She also asked Jane Roe how she could see his penis if he was behind her and Jane Roe said she turned and looked back.
