Escorted by three bailiffs to court in his usual red jumpsuit with face mask and head covered in netting, Jeremy Kish elicited laughter and smirks from audience and fellow prisoners today To any other person, this would be enough to chill but those who know Kish well, know that he can put a drama queen to shame.
He glared at me as soon as he walked in which I ignored.
He contained himself enough not to beckon his lawyer, Mr. Greg Elvine-Kreis over repeatedly this time but he interrupted Judge Marilyn Miles once during the hearing and once again when the hearing had almost concluded. Kish couldn't let his time in court go without a show. He started yelling as Judge Marilyn Miles was wrapping up the case.
Kish will be back August 13 to have a report by a psychaitrist to evaluate his ability to consent to psychotropic medication and his placement in NAPA state hospital. Today, the hearing was at request of animal control to address the "pet order" Kish had previously obtained. Representing them in court today was County Counsel. Deputy District Attorney Jackie Pizzo was present for the People.
There were no comments by Ms. Pizzo and Mr. Elvine-Kreis. Judge Miles asked Mr. Elvine-Kreis if there was any opposition to the motion. He indicated no. Judge Miles then said, "There is no reason to believe by the People or Mr. Elvine-Kreis that the animals are needed for evidentiary reasons."
The animals in questions are two dogs that belong to Kish and were taken to the shelter when he was taken into custody. Kish then wanted Judge Miles to order that the animals be held until August 17 when according to him, someone from a church would take custody of them.Mr. Elvine-Kreis had provided copies of paperwork from clergy and Kish's doctor and a handwritten note that Kish wanted an individual to take custody. However, the paperwork was not sufficient authorization and Judge Miles basically said it was not in her capacity to take over "animal control duties". The sole purpose of the hearing was to determine if the animals were of evidentiary value to Kish's criminal case.
She indicated that criminal proceedings had been suspended and that it take a long time and it seemed there were alternative remedies to house the animals. She indicated Mr, Kish needed to folow the procedure that animal control had for someone else to take the care of the dogs for him and Mr. Elvine-Kreis indicated that he would assist with that, if necessary.
