Juan Ferrer made a voodoo doll to try and control the trial and after being convicted, was caught saying even after he "fucking killed" the victim Humboldt County gave him voluntary manslaughter instead of murder

This post includes details from the probation report.  Some information was stated in court.

Judge John Feeney declined DDA Roger Rees request to play recordings twice obtained by the DA's office of phone calls Ferrer made in the jail using another inmate's PIN and name.

"Earlier today, I listened to the entirety (of recordings)," Judge Feeney said. "I don''t think it would be appropriate at this time."

Mr. Reavis objected to these clips being played because he said they would be inflammatory to his client. DDA Rees wanted them played to show Ferrer's "callousness and lack of remorse." These recordings were made from the middle of May to the end of May.

Nine family members submitted victim impact statements to be included with the probation report. The probation report also has statements from the victim's employer and co-workers. Three family members that were present read letters they wrote and read others on their behalf.

Highlights of probation report:

Ferrer ineligble for probation based on PC 1203 (e) (2).

He is excluded from serving his prison term in Humboldt County Correctional Facility pursuant to section 1170 (h)

Ferrer was ordered to pay restitution of $3,152.19 to Doug's sister Patricia Henderson for roundtrip airfare for transporting her brother's remains.

Ferrer did use alcohol and marijuana, he experimented with meth and cocaine, LSD and Ecstasy.

He has a prior conviction from 2000 for pushing a store clerk.

Ferrer made phone calls from jail using another inmate's PIN and name.

Probation officer cited circumstances that contributed to aggravation. Probation report shows that the defendant showed high degree of callousness, engaged the victim who was walking away, failed to come forward even after the death of the victim's death was reported in the media.

Jail telephone recordings indicate Ferrer told his grandmother what to say and what not to say during the trial. He deliberately used another's inmate PIN and name to call his grandmother to influence her testimony, states the report. If you read my daily coverage, I hinted at some possible witness tampering.

In one of the phone recordings he said he had no remorse for killing Doug and that he did not know how he would display remorse when probation would interview him. He said even though he "fucking killed" the victim, Humboldt County gave him voluntary manslaughter instead of murder.

In these recordings he said he described a voodoo doll he drew of DDA Roger Rees, drew pins on it and then covered it with his own blood he got from testing his blood sugar so he could control the outcome of the trial.

When he was interviewed on June 8, he said he felt sorry.

In the probation report, there is information that the jury was not allowed to consider but was included for purpose of sentencing. Ferrer's association with the Norteno gang, a photo of him posing with a handgun pointed at the camera and his assault on his mother's boyfriend.

The family released a brief statement just minutes ago that they sent out to all media:

The family of Douglas would like to publicly thank DDA Roger Rees and DA Maggie Fleming for thier compassion and commitment to pursuing this case and obtaining justice for Douglas. They have restored our faith in the justice system which was badly damaged under the administration of Paul Gallegos. 

Hopefully now the healing can begin.
