On 10/24, Aunna Bollman was arraigned on information in her latest criminal case and Humboldt Superior Court Judge Steven Steward made a tentative ruling on the DA' motion to terminate her mental health diversion in her remaining 11 criminal cases. She already has 4 civil restraining orders that were granted.

I have been so busy that I haven't had time until today to add Judge Steward's detailed remarks from 8/27/25 and 10/24/25 indicating how he would evaluate and make a decision on the motion for mental health diversion.

In my October 19 post, I did brief updates indicating I would do a separate post on these remarks. Whether you care about this particular defendant or not; she has endangered many people; her behavior did not change while she was on mental health diversion; she went off on meds during that time she contacted me. I chose to handle her lapse privately with Conflict Counsel who previously represented her. Now, it is Mr. Gregory Kreis. Judge Steward put a lot of thought and time into his tentative ruling. He kept the case with him for consistency despite a very busy calendar. Both Judge Steward and Humboldt Assistant Presiding Judge Timothy Canning have made better decisions on mental health diversion. While I may not agree a 100% with them giving these defendants another chance; I feel they have done the best they can under the useless California crime laws and done more to protect the public than the many failed rulings by Judge Kaleb Cockrum and who has let out multiple offenders with repeat arrests and lengthy history and two others who have targeted me and one who threatened to shot me in broad daylight. 

Humboldt Deputy District Attorney Carolyn Schaffer who is also very busy did an excellent job with arguments regarding Bollman.

I will add his final ruling to this post which is scheduled for November 21.

8/27/25: "Ms. Bollman is on mental health diversion in 11 cases. There was a new filing in 2025. "

Mr. Kreis said he is not ready to proceed with the preliminary hearing because he received discovery "yesterday and today." He said he was ready to submit progress reports. "There is a new doctor here in the community," said Mr. Kreis who is not available today to testify. "

Attorneys had a private discussion with Judge Steward at the bench.

"Electronics were seized and information downloaded," said Ms. Schaffer. She said that would be shared with Mr. Kreis. "The preliminary would proceed first, then the motion on mental health diversion."

"There are 50 additional pages of discovery turned over yesterday," said Judge Steward. "Precipient witness now available upstairs. There is more electronic discovery which must be turned over today. As to the motion to terminate mental health diversion. It makes sense since the basis of that request is the new filing. It makes sense to have the preliminary first and testimony in the new case in conjunction with doctor's reports to make evaluation if mental health diversion is still appropriate and if she is in compliance. "

"While on diversion, Ms. Bollman, largely compliant, took meds, participated in treatment."

"There is factual dispute why she stopped taking meds. Dr. White told her to taper off; she discontinued her meds."

Judge Steward cited case law. "Diversion maybe terminated. Court also has discretion to grant mental health diversion under modified terms."

Judge Steward said Bollman "can function with meds."

"The plan in place is not a viable plan. The previous plan failed. The Court is not persuaded that the existing plan addresses adequate concerns. There is no structured monitoring that she takes her meds or supervision. Dr. White was not available to the Court."

"At this time, I will not terminate mental health diversion. I will continue the matter for a revised diversion plan."

Dr. Lamers was suggested as a potential provider. Judge Steward said "med compliance, long injectible meds, designated specific provider responsible for supervision", reporting schedule every two to three weeks, submitted written or in person progress reports" are measures he wishes to see in a diversion plan.

Judge Steward said mental health diversion hearings do not have "a consistent judicial officer. If there is a sufficient plan; I will set regular reports in this department so there is continuity. I do reserve ruling on mental health diversion. If Court finds unsatisfactory performance, I will terminate mental health diversion."

11/21/25: In the  11 cases, she has mental health diversion, final ruling continued by DA to review evaluation and treatment plan to 12/5. Readiness Conference in CR2501364 continued to 12/5 to coincide with other cases. Defense intends to file petition for mh diversion in this case. On 11/24, petition for mental health diversion was filed in the 2025 case.

12/5/25: DA requested continuance to 12/10 to review new documents submitted today.

12/10/25: Mental health diversion granted in all 12 cases. There is a hearing on 12/11/25 for receipt of treatment plan and to set future review hearings.
