Alcohol, drug addiction and machismo about firearm ownership during jury selection in Daniel Dozier's homicide case

 


Offers were discussed before Daniel Dozier's jury trial and jury selection started. On May 10, Dozier's case was on for trial assignment, it was trailing and finally assigned to Judge Steven Steward with motions in limine scheduled for May 14. Individual jurors were questioned. Then what started out as  courtroom full of jurors dwindled to only 4 jurors left to be questioned yesterday. A new panel of jurors will not be available until Monday.

Public Health have been in contact with at least 109 people exposed to measles last week

 


DHHS provided an update this afternoon to last week's health alert.

First, it was Greg Hill, then Tim Marsolan, now Richard Bise joins DA investigative team

 



I reported Greg Hill going over to the DA's office last year. This morning, I saw Timothy Marsolan who was here for the 9:15 preliminary hearing calendar on a case working with Deputy District Attorney Trent Timm. I just found out a few minutes ago that former EPD Detective Rick Bise who is currently a HCSO Deputy Sheriff and Courtroom 1 bailiff last day is May 24. After the Memorial Day weekend, on May 28, he will be DA Investigator Bise. The DA's office is lucky to have all of them. I hope they put that experience to good use.

Kreis to practice law starting May 28? Will Governor Newsom appoint April Van Dyke as interim judge this year?

 


I reported last month that in a court document Gregory Kreis claimed he will have no income starting 5/27/24. I also wrote about him renting a law office locally. Today, I heard he has atleast one family law client and will be practicing law effective 5/28/24. I checked his family law case. There has been no filing indicating a change in his income.

The Commission on Judicial Performance proceedings have not concluded. The California State Bar still lists him as a Judge. 

Michael Black gets arrested again for criminal threats, committing a felony while out on bail, probation violation and other charges

 


Michael Black posted bond and got himself arrested again by HCSO last night. Black was arrested again for PC 422 (a) criminal threats and PC 69 resisting arrest as well as PC 30305(a) felon in possession of ammunition, PC 1203.2(a) probation violation and PC 12022.1 committing a felony while out on bail. Bail for this recent arrest is $1 million. 

Black has another 2024 case which is already scheduled for trial.confirmation on 8/28 and jury trial on 9/9. Ms. Andrea Sullivan is representing him in that case.

In a previous post, I have documents filed by Kreis in which he listed Ellis as his fiancee. He misspelled the word in the filing. How do we know this was not done while she is supposed to be working?

DA adds trespass to CalPoly arrest for burglary and stalking

 


Broderick Brown was arrested on May 5 by Cal Poly Police for for PC 459/461(a) burglary and  PC 646.9 (a) stalking.

The DA charged Brown with PC 459 burglary, PC 646.9 (a) stalking and PC 602.5 (b) aggravated trespass. Alleged victims are Elizabeth and Tasha Babich.

He was arraigned on 5/8; had an OR/bail 5/10 and criminal proceedings were suspended about defense declared doubt about Brown's competency. Motion for release was denied. Brown is still in custody. Probable cause hearing is on 5/20. Dr. Rassti's report is due 6/10.

Former Lt. Sam Williams resigned yesterday

 


I did cover former Lt. Sam Williams criminal case but this post is not about his court case. Sam Williams resigned from HCSO yesterday.

On 5/13, there was a motion to modify probation filed by Deputy Public Defender David Celli. The 5/18 commit to jail date in Humboldt was vacated. Motion to modify granted. Williams will serve probation requirements in Utah.

The District Attorney's office has charged Frederick Breckenridge with PC 422 criminal threats, PC 76 (a) threatening a public official and PC 653 (m) (a) annoying phone calls. Alleged victim is First District Supervisor Rex Bohn.

I am not surprised that Conan Moore is involved in the Kevin Burks OIS shooting

I have provided some of the related posts on Conan Moore. Despite him being involved in a settlement in a federal lawsuit for excessive force, another recent high profile OIS shooting, he is a HCSO Lt.  

Moore is a legal liability and involved in too many OIS so if Sheriff William Honsal and the Board of Supervisors continue to look the other way; remember that when you pay out for yet another civil suit. 

Greenleaf Nurseries lawsuit, Brandon and Jesse Widmark case, settlement in a federal lawsuit  where Moore was excused of excessive force against press and he  endorsed ousted loser Gregory Kreis. These are just a few examples.

I am pro law enforcement and law and order but I do not support any trigger happy yahoo who hides behind an uniform consistently casting his fellow officers in a bad light and complicating the prosecution of criminal cases.

HCSO just issued an update to the Kevin Burks OIS. Ironic that it was sent out by Lt. Kyle Holt who was promoted to Sgt. in 2019 at the same time as Moore.

Frederick Breckenridge arrested for criminal threats and threatening a public official

 



I just did a post on 49 year old Frederick Wilson Breckenridge and a temporary restraining order against him two days ago. I had posted about his rants and threats on April 17, 2023. In my post on May 9, I included his recent rantings and more threats from Facebook. 

That very day Breckenridge shared my April 17, 2023 post and in one of his latest rants he mentions several Humboldt Superior Court judges, the Public Defender's office, ousted Gregory Kreis and Kreis'  fiancee and Humboldt self help attorney Tanya Ellis, Joe Hale and other people. Except for Rex and two County employees, no one else mentioned by Breckenridge connected in any way to the Courthouse has filed for a restraining order; yet. 

Breckenridge has mentioned me in several recent Facebook posts. This kind of targeting, threats and harassment has happened to me more than a few times. It happens to attorneys. Are we claiming "anxiety and distress" and requesting restraining orders running scared like Rexy? Big Bubba Rex who drives a yuge truck, can run and lock himself in his office as claimed in court documents and has firearms is so scared that he gets a TRO that would not be granted to just your average Joe or Jane. 

Rex gets his legal expenses for this TRI covered by taxpayers, he has a direct line to his buddy, Sheriff William Honsal and many local connections. Imagine being a regular Joe or Jane without the position,money and resources.

Breckenridge had an alleged, recent interaction with First District Supervisor Rex Bohn outside the Courthouse. There are two hearings scheduled in May that I wrote about in my post two days ago. One is a TRO requested by the County of Humboldt; the petitioner is Rex Bohn and a TRO was requested and already granted by CR President Keith Flamer.

HCSO arrested Breckenridge yesterday on a Ramey warrant for PC 422 criminal threats, and PC 76(a) threatening a public official. Bail at booking is $50,000. As of 9:30 this morning, he is still in custody. Breckenridge was arrested by HCSO Deputy Seth Crosswhite.

Given who Breckenridge threatened, charges will definitely be filed. If and when he is arraigned, how long will it take his attorney to declare doubt or file a petition for mental health diversion? 

Aunna Bollman and Kathleen Marcotulli both who threatened some of the same people had restraining orders granted against them and Bollman still has 9 open cases. There are violation of court orders all the time with no consequences for the public.  Let's see what happens in this TRO requested by Rex and how this is treated by the criminal justice system and the County.

Man who lit his victim on fire gets mayhem, torture charge and 2022 case dismissed and negotiates a 6 year prison deal

 


Yesterday, there was a motion to continue jury trial filed by Deputy Public Defender Adrian Kamada in Vaughn Jones's case which turned out to be moot since he entered a plea. This resolution literally a day before trial assignment today and a jury trial scheduled for 5/13.

Deputy District Attorney Roger Rees said that Jones would plead guilty to Count 3 attempted murder, the special allegation for Count 3 as charged was dismissed. Instead Jones would plead guilty to special allegation PC 12022 (b) (1) use of deadly and dangerous weapon; accelerant. Counts 1 and 2;  mayhem and torture; will be dismissed. Mr. Rees said the 2008 strike is outside the five year window according to a change in law and requested it be stricken. Judge Joyce Hinrichs said the Court would do that at sentencing. The 2022 case against him was dismissed by the People. At Mr. Rees' request, Jones custody status was changed to no bail.

Jones entered his plea and this is for a 6 year stipulated prison sentence Sentencing is scheduled for 6/5. 

Like many inmates, Jones looks nothing like his booking photo now. Two changes are that he is now clean shaven and has gained weight and looks like a completely different person.

Another workplace harassment order, this one requested by CR President Keith Flamer from a man who has previously made threats against Rex Bohn, Travis Schneider, HCSO and a Humboldt judge

Some of you may have seen other Facebook posts by Breckenridge's like this one I took a screenshot on 4/21/24.

A temporary workplace harassment restraining order requested by the College of Redwoods against Breckenridge has already been granted by Commissioner Sarah Kaber. A hearing on this order is scheduled for 5/29. Petitioner is CR President Keith Flamer. Breckenridge is a former CR student.

There is another case filed by the County of Humboldt against Frederick Breckenridge. A hearing is scheduled in that case on 5/23. Petitioner is First District Supervisor Rex Bohn. Commissioner Sarah Kaber recused herself on this case. Judge Kelly Neel "partly granted and partly denied" requests in the TRO.

Must be nice to have the Rex influence for County employees to get a TRO based on anxiety and emotional distress. If that is the criteria, I can think of a few restraining orders I should get. Breckenridge allegedly "aggressively got in my face" claims Rex and the only witnesses are Humboldt CAO Elisha Hayes and Clerk for the Board of Supervisors Tracy D'Amico. Just like Rex claims the courthouse steps are his, now D'Amico works for him? So no independent witnesses? Is their video? audio of this alleged encounter?

This guy has threatened local attorneys, mentioned other Humboldt County Supervisors, Rob Arkley, in his latest Facebook rants. None of them have filed restraining orders. He even tagged Lost Coast Outpost in one of the posts. Breckenridge could go off on anyone. How is the public protected with a restraining order granted for Rex?

This is the third such case filed by the County that I have covered. Aunna Bollman and Kathleen Marcotulli are the other two cases. Bollman and Breckenridge have threatened some of the same people at the Courthouse.

HCDTF, can you release more information about this arrest?

Received this inquiry a few minutes ago.

"Interesting there was a DTF arrest of 2 people in a bust of some sort May 5th at 11 am and no news report. One of the people arrested by DTF is a drug and alcohol councelor."

I followed up by asking which person out of the two arrests they claim is the drug and alcohol counselor. Both have been arrested before. 

Winnop was the response. This was at 9 p.m.

I could not find any evidence that Winnop is a drug and alcohol counselor except for a 2018 reference about her being a "mentor" to other drug court clients.

What event does Cal Poly Humboldt need security personnel starting today through May 20? Is this a scam?

 



I received this email about about 40 minutes ago. After checking with the person who sent it to me, I am sharing the information. 

"You may use all of it.  My name is Jennifer Lumbert, and I am an HSU alumni.  I don't require anonymity."

Cal Poly Humboldt has yet to respond to me about Broderick Brown's arrest. If their communications department and Chief of Police cannot be bothered to respond to media inquiries, I am not wasting time sending them another inquiry about this Craigslist ad. They know how to reach me if they want. There is also the obvious question whether this email is one of the many scams on Craigslist.

Cal Poly Humboldt regurgitates the same bs. We all saw what we did with our own eyes. Cal Poly Humboldt can claim whatever they want; they have zero credibility with me and many because they still have not answered the illegal detention and arrest of a local reporter. They have not responded to the letter by the local Jewish leaders. They did not respond to ACLU. Unless CPH is willing to provide those answers, these updates are useless. 

Most people are over reading about this back and forth between CPH and the protestors for three weeks saying basically the same thing. 

Tom Jackson should write a book, "How to lose the PR battle and stop influencing even those who used to be on your side" Has he seen the comments and headlines online about this latest CPH spin?

Setting of VOP hearing and status of appeal for Michael Acosta continued to August

This morning Michael Acosta's 2020 case was on for setting of VOP hearing. In February, Mendocino Judge Ann Moorman summarily revoked Acosta's probation. This means the conditions of probation stay in effect, but it stops the clock running on the probation period. 

Retired Visting Judge Leonard LaCasse scheduled a setting of the VOP hearing and status of appeal for 8/6/24.

The State Bar has placed Acosta on involuntary inactive status. He is ineligible to practice law in California. I reported that on April 24.

I said back in February 2024, former Deputy Public Defender Rory Kalin could file appeal. April 18, 2024 was the deadline and it has been filed.in California First Apellate District. There has been years of coverage on  this lawsuit, including exclusives on this blog. If you are not familiar with the lawsuit, even one or two previous posts will get you familiar with the basics.

DA rejects police report for Raymond Bacon's arrest by EPD in April

 


The Humboldt County District Attorney's ofgice rejected the police report and no charges have been filed for the April 2024 arrest of Yurok Tribe's Economic Development Corporation's executive director Raymond Bacon. There is still a tribal court case and a family law case and I explained in my last post about the criteria of any future potential coverage. Details about the April arrest are in previous coverage.

Broderick Brown arrested for burglary and stalking by Cal Poly Humboldt police

 


Broderick Uriah Brown arrested by Cal Poly Police for yesterday for PC 459/461(a) burglary and  PC 646.9 (a) stalking.

I reached out to both Cal Poly Humboldt Communication spokesperson Aileen Yoo and CPH Chief Peter Cress to see if this arrest is related to the protests or a separate incident. Neither have responded which isn't a surprise given a pattern over the years from CalPoly.

I reported in July 2023 on Brown's arrest by CalPoly HSU Police for PC 626.6 (a) direction to leave campus or facility due to interference with peaceful conduct; failure to leave or reentry.

Brown has a conviction in a 2016 DUI case. Two dismissals in 2021 and 2018 traffic cases after providing proof of correction. Out of 10 cases that come up in a search, Brown has 5 open cases including a case against Cal Poly Humboldt police filed 4/5/24.

Two arrests for assault, several harassment cases, did delay of mental health services by County and state cause a danger to public safety?

 


On April 26, Kristen Wise was arrested by the Eureka Police Department for attempted murder. The DA has charged her PC 245 (a) (1), assault by means likely to produce great bodily injury and a special allegation making this great bodily injury a serious and violent felony. Alleged victim Carylyn LoraLouise White.

This is at least the second case where I have noticed the DA's office has filed a complaint and first amended complaint on the day of arraignment which was 5/1 for Wise. She has a 2023 ase for assault & battery and several civil harassment cases in the Humboldt Superior Court system.

65,000 Bail was set at $65,000 by Judge Kaleb Cockrum and Conflict Counsel's office was appointed. OR bail is on 5/3; preliminary hearing on 5/8. 

A Kristen Wise of Eureka sued the County of Humboldt and California Department of Health Care Services for delays in providing mental health services. I reached out to the Legal Services of Northern California to see if this is the same person. I heard back that they would attempt to reach her but no other response after that communication.

Windy Acres and Domingo Santos reach settlement in less than of a year since lawsuit was filed

 


I reported on this lawsuit in December 2023. Windy Acres filed a settlement on April 10. A dismissal hearing is scheduled for 12/6/24.

In March 2024, a substitution of attorney was filed with Humboldt Superior Court signed by defendant Domingo Santos on 2/28/24. Mr. Rick Richmond stopped representing Domingo Santos in September 2023.

Mr. Rick Richmond was the primary attorney who appeared for Ray Christie at several hearings before the case was finally resolved in December 2023.

2021 DUI conviction, 2024 second DUI case with high BAC l

 


Andrea Hopkinson was arrested in January 2024 for DUI. It has been confirmed with the filing of the new charges that she is the one with the 2021 DUI conviction I wrote about in my previous post. I have been regularly checking on the case and the DA's office finally filed charges on 4/25/24. Arraignment is on 6/5.

It has been an intense and busy few weeks as local readers already know and since her next court date is not for a month, live and more pertinent news was the priority.

Offer made in attempted murder, domestic violence and torture suspect's case

 


On 5/2,  preliminary hearing was scheduled for Jeon Durr.  It was continued by stipulation to 5/16 and offer made to resolve the case. 

The DA's office charged Durr with PC 236 false imprisonment, PC 243(d) battery causing great boldily injury, PC 664/187(a) attempted murder and PC 273.5(a) corporal injury to a spouse or cohabitant and added the toture charge later.
