Attempted homicide suspect case dismissed with Harvey waiver

 


On 10/24, jury trial for attempted homicide suspect Jesse Beer was confirmed by the People and defense.

On 10/28, the case was dismissed by the DA with a Harvey waiver. Beer had three other 2021 open cases and I did not and may not have time to check the status or resolution for those cases.

Verdict just in alleged gang member trial

 


The People's oral motion for third amended information in alleged gang member Isreal Nathaniel Soria's case was granted on 10/28 without objection. The change is Count 5 from a completed burglary charge to attempted burglary.

Today, on October 31, jury started deliberations  before lunch.  They resumed at 1:30 and worked through without a break. By 4 p.m.  there was a verdict.

Judge Christopher Wilson is retiring at the end of the year. I know he can be stern and talks about being productive.Why was this nonsense that wastes court time allowed for the last two hearings in convicted sex offender Robert Munts' three cases.

Motion to continue, motion to dismiss, cases against alleged pimp are a convoluted mess

 


The People's motion to consolidate was granted yet the open cases for alleged pimp Javier Akeem Ruiz-Keyes continue to be a convoluted mess because of the People and defense.

Ruiz-Keyes also attempted ex-parte communication with the Judge which is prohibited.

Despite a sustained finding that Second District Supervisor Michelle Bushnell violated the Code of Conduct, nothing will happen to her. No one is really held accountable at the den of evil aka the Humboldt Courthouse. This charade on Tuesday is all for appearance's sake and to avoid potential litigation.

David Moutrie leaves Humboldt DA's office and is headed to Santa Rosa

Deputy District Attorney David Moutrie has accepted a position in Santa Rosa and is leaving the Humboldt County DA's office.

I have not seen Deputy DA Shelley Small for quite a while. She has left the DA's and may come back a retired annuitant. The DA's office recently hired two new attorneys. The California State Bar attorney site is down for maintenance over the weekend.

Convicted felon arrested for robbery, battery and parole violation


Ivan Martinez Chavarin was arrested by Eureka Police Department yesterday for PC 3000.08(f) parole violation, PC 211 robbery and PC 243(e)(1) domestic battery.

I have been covering him since 2015. 

Third arrest this month for repeat offender Shiloh Chase

Since I reported on his last arrest , Shiloh Chase has been arrested twice. Yesterday, Eureka Police Department arrested him for PC 496d (a), buying or receiving stolen property. He was released on O.R.

20 year old arrested on a Ramey warrant for domestic violence

 



John Robert Harris was arrested by HCSO yesterday on a Ramey warrant for PC 273.5(a), corporal injury to a spouse or cohabitant.

I checked the City of Eureka website for Campaign FPPC statements and contacted Eureka Assistant City Manager Pam Powell shortly after 5 p.m. the deadline for the latest 460 forms. I specifically asked about Nicholas Kohl and Mario Fernandez.

Defense wants acquittal on two counts; people file 2nd amended information

 


A second amended motion filed by the People was granted during jury trial for alleged gang member Isreal Nathaniel Soria. 

Defense  filed an amended defense motion for judgement of acquittal per PC 1118.1 pertaining to Counts 1 and 3 of the first amended information.

Jose Luis Miranda-Osorio booked for hit and run resulting in death


I have written before about the challenges of finding exact names in the Humboldt Superior Court system. There is only one match for this exact name for a 2018 traffic case for speeding. The disposition lists a 2019 completion date of TVS.

On 10/26/22 at about 5:53 AM, Arcata Police Department received a 9-1-1 call for a pedestrian down in the roadway on the 5000 block of Valley West Boulevard.  

Defense files for yet another continuance in Opera Alley homicide case

Once again, Opera Alley homicide suspect Conor Whited's attorney, Mr. Joe Judge, filed a motion to continue the jury trial scheduled for 11/14. It was granted. Status of dr's report was continued to 11/1.

On 10/24, at trial confirmation for attempted homicide suspect Jesse Beer, both the People and defense confirmed for the jury trial scheduled for 10/31 with a four week time estimate.

It doesn't surprise me a mistrial was declared in the local lawsuit against Starbucks


On 10/24, a mistrial was declared by Judge Timothy Canning in the lawsuit filed by Tyra Jamerson against Starbucks Corporation. This was after a note from juror #9.

On October 19, I did a post on this civil jury trial over an alleged incident at a Eureka Starbucks. 

Samantha Luna case resolution is a slap in the face to local law enforcement

 


Samantha Luna resolved her case  on April 5, 2022 with 7 misdemeanor counts with an informal diversion. Today, she successfully completed the terms of her diversion, and her case was dismissed.

Michael Charles Fasano was arrested by Eureka Police Department at 5:54 p.m. p.m. for two counts of PC 1203.2(a) probation violation, PC 242 battery, PC 211 robbery and PC 148 (a) 1 resisting arrest.

EPD Crime Analyst and PIO Brittany Powell confirmed Fasano was the suspect arrested at Bayshore Mall yesterday.

One suspect arrested, second fled from EPD, officer attacked by dog near Bayshore Mall

On October 24, 2022, at approximately 5:51 p.m., Officers with the Eureka Police Department were dispatched to the 3300 block of Broadway on the report of two persons trespassing on the property. Responding officers were advised that one of the subjects had a felony warrant for his arrest.

EPD, HCSO and K9 Yahtzee take down illegal narcotics and firearm suspect



On October 24, 2022 at about 7:15 a.m., officers with the Eureka Police Department, with the assistance from the Humboldt County Sheriff’s Office and HCSO K9 Yahtzee, served a search warrant at a residence on the 1000 block of Hiller Road in McKinleyville. 

Tanya Brooks charged with child abuse likely to cause great bodily injury

 


Tanya Brooks was arrested on October 20 by DA Investigator Ryan Hill for PC 664/269 (a) (1), aggravated sexual assault of a child.

Brooks was arraigned today. The DA has filed a complaint under one of her akas Tanya Comer. She is charged with PC 273 (a) (a), child abuse or willful child endangerment likely to cause great bodily injury.
