Second time in two consecutive court days, David Celli had to fill in for two deputy public defenders; one was a no show in court

Deputy Public Defender David Celli had to fill in for the second time for a colleague on two consecutive court days. On Friday, for Deputy Public Defender Wade Orbelian. Yesterday for Deputy Public Defender Emery Welton. Today, Mr. Celli was at the Board of Supervisors meeting. Where is Public Defender Luke Brownfield? 

Sheriff William Honsal showed up for his office today at the Board of Supervisors meeting. District Attorney Stacey Eads showed up a few minutes after Deputy DA Carolyn Schaffer. Mr. Celli was there and I did not see anyone else from the Public Defender's office while I was there.

Maybe we should just make Mr. Celli the public defender since deputy PDs MIA and not in court is quite frequent. The current Public Defender should be doing what other attorneys in his office end up handling in court. Mr. Brownfield who told Judge Kaleb Cockrum, "what do you want me to do?"  when Richard Stobaugh was not on Zoom in court at the last hearing. The California Department of State Hospitals' attorney had to handle Brownfield's job.

The County is paying an out of area law firm to defend Brownfield and former Public Defender Marek Reavis in the lawsuit filed by former Public Defender Rory Kalin. Gregory Kreis, the third co-defendant in that casesettled with Kalin. 

I doubt First District Rex Bohn is going to do anything about Luke Brownfield and some of the other Public Defender's lackadaiscal behavior. They are being paid by the taxpayers. I would hope the other four Supervisors look closely at the PD's position and how the office is being run since budgets are an issue. Conflict Counsel is a much smaller office and staff and they show up for court and they don't have an attitude like certain people from the Public Defender's office.

Thankfully the case yesterday was in front of Judge Timothy Canning and not Judge Kaleb Cockrum whose poor decision thwarted the DA's effort to keep the public safe. I wrote about my direct experiences with Lundy more than once so this isn't a hypothetical concern. 

Judge Canning issued a bench warrant for $25,000 but it is held until 5/16.Lundy should not be put on mental health diversion and that has been obvious even before this latest failure by Lundy to follow the law. Deputy District Attorney Rebecca Buckley-Stein has opposed the defense request for mental health diversion.

With Ms. Andrea Sullivan relocating, Jackson Parrott's new court appointed attorney is Gregory Kreis

 



I had previously reported that private attorney Ms. Andrea Sullivan is relocating to Southern California. 

She was one of the few private attorneys who regularly took court appointments and in serious cases. Thete was a directed verdict in convicted felon Jackson Parrott attempted murder, mayhem and torture case granted by Judge Kaleb Cockrum. Parrot still has to be sentenced. I had heard quite a few cases that Ms. Sullivan was appointed on would be going to Mr. Gregory Kreis. Yesterday, he was court appointed to represent Parrott. Setting of sentencing was continued again with three future dates scheduled for 5/15, 7/29 and 8/11.

Evolution Hospitality, LLC sues Benbow Inn, Inc, Rogue River Investments LLC and Benbow Valley Investments LLC for $398, 714.28, attorney fees and other relief

Today, there was a case management conference scheduled in a lawsuit filed by Evolution Hospitality, LLC against The Benbow Inn, Inc for breach of written contract. 


A cross complaint was filed in January 2025. The defendants filed an answer on 5/8/25 denying "both generally and specifically each and every allegation" and the plaintiffs "take nothing."

Evolution claims it is owed $398, 714.28 and details of what else is requested is in court documents provided. Evolution is represented by two attorneys from the Los Angeles firm Saul Ewing LLP.

Humboldt gets more than $43.5 million for new Sempervirens facility which will be on 5th street near the Courthouse

 

Humboldt County Department of Health & Human Services (DHHS) has been awarded more than $43.5 million to help construct a new Sempervirens (SV) psychiatric health facility after county staff submitted a grant application that was approved by the state. 

Stipulation and order filed by plaintiffs in Hillsdale Apartments lawsuit

Since my last post on the lawsuit filed by Don Swall and Vanessa Vachon, two tenants of the Hillsdale Apartments in Eureka, the latest development that a stipulation and order was filed by Vachon and Swall on 5/9. They are represented by Ms. Meagan Yarnall and Mr. Jeff Slack. The document was entered late Friday or this morning because I check the case daily.

There is no document in e court and the file is with Judge Timothy Canning. I will be updating the post but I am covering court and other live news right now.

 I have been checking the case regularly. I figured with no response to the First amended complaint and no ruling on the preliminary injunction as of 5/9/25.

"I am the prince of a cisgendered man"

 


I was in court when Zoe Elizabeth McMillanBourne aka Eldo Kaleidoscope Barger aka Jet Kaulitz was scheduled to be arraigned on two counts. Count 1 PC 245 (a) (1) assault with a deadly weapon; a knife. Count 2 Resisting/obstructing Eureka Police Officer M. Shaw. The alleged victim is Hannah Elizabeth McMillan. 

This individual presents as female with hair dyed pink and blue. Spoke in court with a British accent. Rambled on about illegal residence and royal courts. 

Humboldt Presiding Judge Kelly Neel tried to determine this person's identity with as much sensitivity one can in a formal court proceeding and asked, "Were you ever known as Zoe Elizabeth?" It was difficult because the individual was rambling and creating a scene in a courtroom which was thankfully not full of people on a Friday afternoon and mostly court and DA staff. Deputy District Attorney Trent Timm appeared on the case for the People.

Judge Neel appointed the Public Defender's office; set bail at $35,000 and declared doubt. Dr. Mark Lamer's report is due on 6/10.

This is the kind of case some MAGA will use for their anti trans agenda without bothering to read details. The same is true for some others in the LGBTQ community and "allies" who will react to the headline instead of focusing that I did this post so this individual gets the help needed.

Even if the doctor's evaluation confirms this individual is not competent to stand trial, I doubt that the true reason for any mental health issues and this individual's behavior in court will be revealed in court proceedings due to privacy issues. The California State Hospital has not helped most of the individuals they send back to Humboldt Superior Court because I end up covering them again or a new arrest.

I did a google search on the McMillans and am going to wait and see what happens at the next court date. 

People these days do not read information. They react with their biases & agenda. Social media can be a great tool for live reporting & reaching people but the downfall is lazy people wanting their spin validated instead of facts

I just happened to be in the courtroom on May 9 when Erik Neal was arraigned on his latest case. This 2025 case was filed on 5/9 by the DA's officer and charges Neal with one count PC 243 (c) (1) battery with injury on a custodial officer. This alleged act took place while Neal was in custody in the Humboldt County jail.

Convicted felon Glen Shafer arrested by Arcata Police today was in possession of three firearms and had an outstanding warrant from a previous case

On 5/10/25 Arcata Police Officers responded to the 4900 block of Valley West Blvd. for the report of a male brandishing a shotgun. Officers located the male, who was identified as Glen Halis SHAFER and was determined to be a convicted felon. Officers located three firearms, including a shotgun and two rifles near where Shafer was detained. 

Shafer was arrested for PC 29800(a)- Felon in Possession of a Firearm and an outstanding felony warrant for PC 3455(a)- Revocation of Post Release Community Supervision. 

A search warrant was obtained and served at Shafer's residence for additional evidence. 

Nick Martinez pleaded guilty to possession of child porn, 9 months later he is back in custody for probation violation

 


I covered Nick Martinez's case. In August 2024, he was sentenced to 16 months in prison for possession of child pornography. He was arrested yesterday by Humboldt Probation Officer Graney and booked for PC 1203.2(a)(4) probation violation.

On April 28, I reported on a 2022 lawsuit Jeff Lewis filed a lawsuit against United Indian Health Services, Inc. That is a civil unlimited employment case alleging wrongful termination. Lewis worked as a drug and alcohol counselor for UIHS at the Potawot Health Clinic in Arcata.

Lewis is represented by Mr. Benjamin K. Karpilow and Mr.Lewis Brown, attorneys with Meechan, Rosenthal & Karpilow law firm from Santa Rosa. UIHS, Inc. by Ms. Brittany S. Greenhill, an attorney with Gordon & Rees Scully Mansukhani which is a law firm in San Francisco. 

Former Deputy District attorney Jane Mackie is assisting one of the law firms with the case. I believe local attorney Neal Latt testified. I have to go back and read court minutes for last week about Mr. Latt which I only had time to glance at quickly.

This civil trial has been assigned to Judge Steven Steward. There are court documents in my April 28 case. There are 11 causes of action. On May 5, there was a partial dismissal requested by Mr. Karpilow for the 5th cause of action which is Retaliation and it was granted.

I watched motions in limine. Unlike some Humboldt lawyers in criminal and civil attorneys, there is civility and professionalism of these lawyers even though they are on opposing sides. I saw the same demeanor from Mr. Rick Richmond and Mr. Johnny Rundell, both from Los Angeles law firms.

Closing arguments were given this morning. Prior to this attorneys agreed that Judge Steward could let jurors know of the stipulation that Lewis was terminated by UCSF.

I watched part of the closing arguments. Mr. Karpilow told the jury, " you know about my eyesight" as he described his experience in downtown Eureka. I had only recently noticed him using a cane when he was walking from the lobby to the second floor. 

Anyone who lives, works and like me walks frequently around Eureka, especially the Courthouse has seen what Mr. Karpilow described to the jurors.

Two blocks from courthouse, as Mr. Karpilow walked towards a Mexican restaurant, " I see something crawling from a grate. I get closer and realize it is a man. I was told by someone at the Chevron station that he is 18 months sober. This is "two blocks from my hotel." Someone else told Mr. Karpilow "he found salvation." Mr.  Karpilow described another 20 year old he saw come in at the gas station.

Jury was sworn in and read closing instructions by Judge Steward at the end of the day. 

5/12/25: Jury is deliberating. Attorneys went into the courtroom at 1:32 p.m. Verdict. Jury finds in favor of UIHS on all claims.

DA has filed a second criminal threats case against Daryl Jones

After doubt was declared on 4/24 in one of terroristic and criminal threats suspect Daryl Jones' case, the DA filed another case with two counts of PC 422 criminal threats against Jones. The law enforcement agency is California Highway Patrol. Alleged victim in this case is Raquel Ortega.

He was arraigned on 4/29/25 and criminal proceedings were suspended in that case and next court date is 5/15 when Dr. Mark Lamers' report is due in both cases.

Today is one of those days when I remember why I do the blog, why I like being in court doing live coverage. Today, I can momentarily forget the challenges and hardship of doing this blog for 11 years and focus on the positive.

Attempted murder suspect Michael Cady finally in custody

 


On December 13, 2024, the Humboldt County Sheriff's Office asked the public's help in locating a third suspect  "Michael Cady, 34, of McKinleyville. Cady was involved in a robbery and attempted homicide that took place on April 13 in Fortuna." 

Cady was booked into the Humboldt County jail on his arrest warrant on May 6.  Cady was supposed to be arraigned yesterday but both Conflict Counsel and Public Defender's office had a conflict so Judge Kelly Neel continued the arraignment to this afternoon so the CAO could see if a private attorney was available. Ms. Rebecca Linkous accepted court appointment today represent Cady. Judge Neel entered not guilty pleas yesterday to preserve Cady's right to a speedy trial. Bail was set by Judge Neel at $750,000. Preliminary hearing is on 5/20.

"The success of this grant application is attributed to the dedication of Deputy Esget, who went above and beyond by personally delivering the application alongside K-9 Yahtzee."

 

HCSO Deputy Hal Esget is one of the many law enforcement members who is an asset to Humboldt County. Glad to see the HCSO press release just issued recognize him for his efforts in obtaining K-9 program funds.

CA AG grateful to Judge Timothy Canning for ruling on demurrer in lawsuit against Providence St. Joseph




I added the update and Judge Timothy Canning's May 5, 2025 ruling overruling Providence St. Joseph's demurrer in the lawsuit filed by California Attorney General's office to my February 14 post. 

Today California Attorney General Rob Bonta issued the following statement "in response to the Humboldt County Superior Court’s decision to deny Providence St. Joseph Hospital’s (Providence) attempt to dismiss the Attorney General’s lawsuit, which alleges that the hospital violated multiple laws by refusing to provide emergency abortion care to people experiencing obstetric emergencies. Located in Eureka, California, Providence is the only available option for women in Humboldt County to seek emergency abortion care.  

Court of appeals rules Judge Cockrum "erred" in Jake Comb's jury trial


I just received this tip from a reader about the Facebook post. and checked the court of appeal. I have contacted DA Stacey Eads for comment. I also reached out to Supervisor Michelle Bushnell for comment. I am so sorry for Katrina and her family.

DA Eads promptly sent this response, "We are asking the Attorney General to appeal the appellate court’s decision.  There may be additional information I can provide in the future but for the moment I do not have additional comment."


As you see in my post, I had to clarify the sentence was 50 years to life. I am not linking all my coverage on this case.

You can read the entire ruling online. While the ruling mentions the prosecutor and defense, the ruling only highlights the trial court aka Judge Kaleb Cockrum who presided over the trial and erred which resulted in the judgement being reversed. 

People in the legal community and some in the general community will take sides depending on their bias. I was there for the trial and the testimony mentioned in the ruling. 

I googled Evidence Code 1101 and 1103. It was easier to read and understand that legalese then the apellate ruling. Combs made three points, the Apellate Court reversed based on one point. This is the worst apellate ruling I have read and I am talking specifically about their interpretation of 1101 and 1103 justifying their decision. I wasn't there for the jury notes and obviously not there for the deliberations. No judge is perfect, all judges interpret the law, no judge can be completely free of bias and that is true of a superior court judge, an apellate judge or a Supreme Court justice.

I am glad the DA is asking California Attorney General Rob Bonta to appeal the ruling by the Apellate Court. Let's see if the AG's office actually does something for Humboldt County. It is time the California AGs office actually fights for victims and their families where it does not involve Bonta only caring about making headlines and only filing lawsuits for specific  agendas.

In January of 2022, after a long day and night of drinking, defendant Jake Combs shot and killed Trevor Earley after Earley allegedly threatened to kill his dog.  Combs was convicted by a jury of first degree murder and sentenced to 50 years to life in prison, including a 25-year-to-life firearm enhancement.  Combs argues that the trial court erred by:  (1) responding to the jury’s questions regarding the elements of premeditation and deliberation by referring them to the standard instruction on those elements; (2) in admitting evidence that while in jail awaiting trial, Combs attacked another inmate in a wheelchair; and (3) in denying his motion to strike the firearm enhancement in the interests of justice.  We agree with Combs’ second argument, and accordingly we reverse.

Page 13 and 14 of the ruling:

 As noted, Combs argues that: (1) the trial court erred in responding to the jury’s questions regarding the elements of premeditation and deliberation by referring them to the standard instruction on those elements; (2) that the trial court erred in admitting evidence that, while in jail awaiting trial, Combs attacked another inmate in a wheelchair; and (3) that the trial court erred in denying his motion to strike the firearm enhancement in the interests of justice.  Because we conclude that his second argument has merit, we need not reach the others.

At approximately 7:17 a.m. on Thursday, May 8, 2025, the Rio Dell Police Department and Rio Dell Fire Department responded to a report of a residential structure fire on the 1000 block of Riverside Drive.

Two judges denied this last minute defense motion by the Public Defender for this alleged molestor, then hours wasted on intervention by the PD, this is why cases drag on for years and there is a backlog

 


Manuel Garcia Avalos went from alleged molestor to convicted molestor in a few days.  Like many inmates, he looks nothing like his booking photo. He has lost some weight, has glasses and is now clean shaven.

"East Coast based-Liberty Healthcare sneaks into unsuspecting communities across California and employs a disturbing placement strategy where they try to secretly release dangerous SVPs and rapists into residential neighborhoods"

 

Liberty Healthcare had an exclusive contract with the California Department of State Hospitals to place sexually violent predators on conditional release. After 2023 and a request to audit, looks like nothing has changed. Senator Brian Jones is the only California legislator doing anything to address public safety and address issues with release of SVPs.

Liberty tried to place SVP Joshua Cooley in Humboldt and failed only because of the public. Now, they want to place SVP Richard Stobaugh in Humboldt. I am going to send this to DA Stacey Eads, Deputy District Attorney Whitney Timm, DA Chief Investigator Kyla Baxley, Sheriff William Honsal and some community members I spoke with today.

We should thank Sheriff William Honsal, District Attorney Stacey Eads, Deputy District Attorney Whitney Timm and DA Chief Investigator Kyla Baxley who alerted the public.
Their thanks for keeping this community,women and children safe was being chastised by Judge Kaleb Cockrum who didn't want to deal with the public who have a right to be heard by California law. Judge Cockrum is the one who made the decision to conditionally release sexually violent predator Richard Stobaugh. Instead of lecturing us on the technicalities of law, Judge Cockrum should do his job and protect Humboldt. Retired Judge John Feeney did not throw a hissy fit and Judge Feeney allowed the public to speak and give comment about sexually violent predator Joshua Cooley at multiple hearings. As frustrated as I was at that time, ultimately Judge Feeney made the right decision and the process was not rushed nor was there disrespect towards the attorneys, the DA or the public.

A violent criminal's rights are not more important than the innocent public and victims who did not break the law. As usual, California legislators, Attorney General Rob Bonta and California Gavin Newsom have failed survivors and the people.

As I search on this issue further, a CBS News report in May 2024 "a sudden spike" in sexually violent predators being released by the California Department of  State Hospitals and gives a comparison with stats of how many SVPs were released since the law passed.


CBS8 reported in August 2024 that Senator Jones' Sexually Violent Predator Accountability, Fairness, and Enforcement Act” never made it to a vote. A public records request showed it costs more than $450,000 a year to house a SVP.


EPD releases details about fatal collision on West Harris

 


On May 6, 2025, at about 8:27 AM, Eureka Police Department (EPD) Patrol Officers, Community Safety Engagement Team (CSET) Officers, and Humboldt Bay Fire (HBF) responded to the report of a semi-truck versus bicycle collision at W. Harris at Union Street. Upon arrival, Humboldt Bay Fire personnel determined the bicyclist to be deceased.

Redway 4th, 5th and 6th grade students today at the Courthouse. They were split in two groups. One got to see the Board of Supervisors in action. The other the courts. Humboldt Superior Court Judge Lawrence Killoran gave up.his lunch hour to answer their questions in the jury room.

I did not take any photos because these are young students. I only got to see them briefly during Judge Killoran's presentation in between a very busy day. I didn't even have time to talk to the teachers because the court tour was a surprise. Humboldt Superior Court CEO Meara Hattan, Operations Manager Kelly Nyberg and Assistant Operations Manager Scott Anderson all assisted with the court tour.

Jarred Vaughan charged with forcible oral copulation and forcible rape of a minor

Jarred Wade Vaughan was booked on four charges. The DA has only charged him with two felonies. Arraignment took place this afternoon. Based on the charges, Judge Lawrence Killoran increased the bail amount which is now $150,000.

Count 1 is PC 287 (c) (2) (c) forcible oral copulation. Count 2 is PC 261 (a) (2) forcible rape of a minor.

Did DHHS' Ryan Bishop resign due to an investigation and after complaints against him?

 



Ran into a reader at the Courthouse who asked me the latest about the Richard Stobaugh case.  The reader asked if I was working on a news story. I have not seen it reported anywhere else which my reader confirmed.

That turned out to be a tip I will be following up on although I am sure the County will hide behind we cannot comment on personnel decisions. My source asked to remain anonymous. According to my tipster, Ryan Bishop resigned from DHHS two weeks ago after being investigation and that there is an interim director handling his duties and that DHHS will be advertising for the position. The tipster said there have been "hundreds of complaints" about Bishop.

I sent an email to DHHS Director Connie Beck. She forwarded my email to DHHS spokesperson Christine Messinger. "Hi, John. Thanks for reaching out. I can confirm that Ryan Bishop no longer works at DHHS. Please direct further questions to HR."

As suggested by Ms. Messinger, I reached out to HR and Humboldt County PIO Cati Gallardo. She responded, "We can confirm that Bishop is no longer employed by the County of Humboldt. As this is a personnel matter, we are unable to provide further information."

Motion to continue Richard Stobaugh placement hearing will be heard tomorrow, DA received over 130 comments, whether public comment will be allowed has not been decided

I am at the BOS meeting right now where DA Stacey Eads is speaking to the Board of Supervisors. The BOS has a letter of opposition on the agenda opposing the proposed placement of sexually violent predator Richard Stobaugh in Manila. The BOS supports the DA and the Sheriff. I already reported on this last Friday. Humboldt DA Chief Investigator Kyla Baxley also spoke at the meeting. I went to the BOS meeting after today's court hearing on Stobaugh and once again, no media was present.

Whether you are planning to be at the court hearing or not tomorrow, you should read information that is not available anywhere else and could influence your decision.

State Bar of California sues vendor for issues with February 2025 bar exam

 


Today, the State Bar of California filed a lawsuit in Los Angeles Superior Court against ProctorU for the issues applicants had with the February 25 bar exam.

I have only included the first and last page of the complaint. The State Bar of California issued a press release issued today.

I did a post on this on April 27.
