Judge Steward will rule on defense motion to supress in Cal Poly protestor Richard Toledo's case

 




I did see Cal Poly protestor Richard Toledo's case on calendar on 8/10/26. It is a busy week with elections, other news and many court cases.

On Monday, there was a hearing on defense motion to supress. Mr. Matthew Kellegrew from the Civil Liberties Defense Center in Oregon has been retained by Toledo. Mr. Kellegrew has also been admitted to the California State Bar.

Deputy DA Dave Watson appeared on the case for the People.

Humboldt Superior Court Judge Kaleb Cockrum said that there appears to be a challenge to the warrant and the case was sent to Judge Steven Steward who signed the warrant. I was not in the courtroom for the arguments. Judge Steward said he will issue his ruling on 8/31/26 This is from court records minutes.

Trial confirmation had already scheduled for 9/22. Jury trial on 9/28. 

8/31/26: Cal Poly protestor Richard Toledo's motion to suppress the warrant was granted in part and denied in part by Humboldt Superior Court Judge Steven Steward. Challenge to Ramey warrant denied, challenge to search warrant granted. Deputy DA Dave Watson is the prosecutor who has appeared on this case for the 8/10/26 and 8/31/26 hearings. Mr. Matthew Kellegrew to submit an order after hearing. If there is a written ruling, when it is added to e court,I will add it to the August 12 post with this update. Trial confirmation and jury trial remain set as scheduled.
