Kaiden Cerise charged with 7 felonies involving a child under 10

 


The DA filed a complaint today charging Kaiden Cerise with 7 felonies. There are several special allegations for Counts 1 to 5. Cerise is scheduled for late arraignment this afternoon. 

Cerise is ineligible for probation due to the special allegation 1203.065 (a) alleged several times in this case. The alleged victim is Baby Doe who is now a year and 5 months old. Torture is alleged in the special allegation for Count 1.

Defendants charged with sex crimes are ineligible for mental health diversion. Is there anyone at the Public Defender's Office besides Deputy Public Defender Ben McLaughin who could try such a case? Humboldt PD is probably hoping for a conflict so they can pass this case off to some other attorney. 

Senior Deputy District Attorney Whitney Timm's request for no bail hold was granted. Ms. Timm told Retired Visiting Judge Ksenia Tsenin  that Cerise faces life without the possibility of parole.

Public Defender request for referral to supervised release denied without prejudice by Judge Tsenin.

OR bail hearing on 6/25; preliminary hearing on 7/2. Time was not waived at arraignment.

I really pray this case does not go to preliminary hearing and the feds take it over. 

No other media was in court and will not have  details stated on record and from my live, in person coverage.

There were two women in court who were talking about the Cerise case before the courtroom opened. They were also texting in court and the Courtroom 2 bailiff seemed oblivious to the fact. People use their cell phones all the time now and the bailiffs aren't doing anything. If the policy is not going to be enforced, why have it or is it being selectively enforced?

After the Public Defender was appointed, the older woman said looking at Deputy Public Defender Wade Orbelian, "I want to talk to you." She got up and sat on the handle of her seat in the courtroom to get a better look at Cerise.

That woman is Venessa Vader who left an angry emoji on this post on my FB news page. According to her Facebook profile, she is from Hoopa. She was not with a Victim Witness Advocate.

If she is connected to Cerise in any way, I doubt the Public Defender's Office will caution her on how to behave in or outside court based on my experience in the past with clients connected to their office and specifically my encounters with them.

I cannot request a booking photo yet, thanks to the Ninth Circuit ruling. For some reason, Cerise's Vinelink photo does not display and I still could not post it because of the Ninth Circuit. HCSO has no problem releasing booking photos when they want and in this case they could and should release Cerise's mugshot. 

Cerise has a long mop of black hair with glasses and he is fat. If the PC crowd does not like my description; they can lobby the Ninth Circuit to change the ruling about booking photos and get over themselves because his physical weight is relevant to the size of the helpless baby he "allegedly" molested.

I have to say allegedly because of the legal process but in court, Ms. Timm told Judge Tsenin, "Mr. Cerise admitted to number of the acts. There is photo and video evidence of Mr. Cerise accomplishing these acts." Cerise was in possession of child pornography which is one of the charges.

6/25: At the OR bail hearing, Public Defender Luke Brownfield was there. He is representing Cerise. OR bail was waived without prejudice by Mr. Brownfield. The 7/2 date was vacated. Setting of preliminary hearing is on 7/22.

After my post on arraignment, I heard from the second woman in the courtroom. I do not know how she got my cell phone but on her voicemail identified herself as V. Johnson,an advocate for Cerise's mother. I could not understand her first name on voicemail.

She said his mother was "processing all this" and was available for an interview to give me the "facts." I did not return her call. I do my coverage from court records, court testimony, facts from credible sources I can verify. I informed Mr. Brownfield she had contacted me and that he may want to speak to her about contacting media in a serious case such as this before it has gone to preliminary hearing. He thanked me.
