CalPoly Humboldt's blowhard response to ACLU via their lawyer is meaningless because their actions prior to the protests speak for themselves

 


Over two weeks later, Cal Poly Humboldt responded today to the ACLU's May 4, 2024 letter. 

Universities nationwide and American politicians handled these protests despicably. HSU's arrogance since they got the "Cal Poly Humboldt" designation they never deserved only further emboldened them because they think they own Arcata and Humboldt. They have money and political backing and like most entitled bullies, they know people will remain silent out of fear or because they are paid tools who have sold their soul for a penny. 

At least some people in this country are waking up and seeing there is no difference between the Democrats and Republicans when both parties allow foreign interests to dictate American policy and freedom of speech.  If you are such a "patriot" then you would be speaking up for freedom and civil liberties and not just express outrage when your opinion is silenced and it affects your tiny, selfish bubble.

Social media is useful but not when the focus is on the wrong people and the motivation is an agenda

 


In 2020, I did a post on convicted sex offender Shawn Lee Perrot who was arrested on several sex  charges involving a minor. In 2022, I did a post on him suing Humboldt County. Perrot has many aliases. His Megan's Law listing has a SVP designation. SVP as in sexually violent predator?  Court documents there was a SVP filing in 2020 but dismissed in 2022. Not all court documents are in e court.

With 23 searches and cases coming up in a name search for Perrot,I will update the post with court records when I have time. Where were all these keyboard warriors and those sharing screenshots in 2002, 2004, 2021, 2022, 2023 or 2024?

The person and persons who created this hysteria on social media about a ribbon cutting and posted the same information from Megan's Law should have done some in depth research on Perrot but that actually requires effort, sacrifice and takes time.

In 2004, former Humboldt County DA Deputy Andrew Isaac prosecuted Perot. According to court records, "the People withdraw the motion to commit, defendant is released to parole only."

Judy Cunha seems to be the only defendant in Ingomar wrongful death lawsuit inching towards resolution in three years

 



The case management conference scheduled on 5/10/24 in the 2022 Ingomar Club wrongful death lawsuit was continued to 9/9/24. A  "conclusion was reached" regarding defendant Judy Cunha and parties may try  mediation. A partial dismissal pertaining only to Cunha was granted on 3/3/23

This lawsuit was filed after 9 year old boy who was found unresponsive in the Ingomar Club pool in 2021. The status of Judy Cunha's license for Cunha's Small Family Home, court documents for the negligence and wrongful death civil lawsuit filed on 7/19/22 and the list of defendants in that lawsuit are in previous coverage. Since 2021, I have been the only one to follow up and report on the incident and lawsuit.

If this DA administration can resolve a molestation case with 10 felonies, what is the difference between the Eads and former Gallegos administration?

 


On 5/14, alleged molestor Laverne Dobereiner's case on for setting of preliminary hearing was continued by stipulation to 5/21 and offers were exchanged. Deputy Carolyn Schaffer appeared on the case for the People. Deputy Public Defender Ryan McClurg is Dobereiner's attorney.

Dobereiner is charged with 10 felonies which are 7 counts of PC 288.7 (b) oral copulation or sexual penetration with a child who is 10 years or younger, one count of PC 288 (a) lewd or lascivious acts with a minor,  one count of PC 287 (c) (1) oral copulation with a minor under 14 and one count of PC 287 (c) (2) (b) forcible oral copulation with a child under 14 years of age.

Witness complications cause delay in attempted murder, domestic violence and torture case

 


At the last hearing, an offer was made to resolve attempted murder, domestic violence and torture suspect Jeon Durr's case. The preliminary hearing scheduled for 5/16 was continued to 5/23  with an oral motion made by Deputy DA Candace Myers  due to witness complications/availabilty, Deputy Conflict Counsel Owen Tipps stated objection on record but waived written notice

Man resolves child porn case with no jail time, no requirements

 


Instead of his preliminary hearing on 5/16, 51 year old Frank Callaway pleaded guilty to posession of child porn. This is conditional plea for no additional jail time. Sentencing is on 6/26.

Callaway posted bond after being arrested and booked. The plea is for no additional jail time and no other requirements are listed on the plea form.

Deputy District Attorney Whitney Timm is the prosecutor. Mr. Michael Robinson is Callaway's attorney. Judge Joyce Hinrichs took Callaway's plea.

Alcohol, drug addiction and machismo about firearm ownership during jury selection in Daniel Dozier's homicide case

 


Offers were discussed before Daniel Dozier's jury trial and jury selection started. On May 10, Dozier's case was on for trial assignment, it was trailing and finally assigned to Judge Steven Steward with motions in limine scheduled for May 14. Individual jurors were questioned. Then what started out as  courtroom full of jurors dwindled to only 4 jurors left to be questioned yesterday. A new panel of jurors will not be available until Monday.

Public Health have been in contact with at least 109 people exposed to measles last week

 


DHHS provided an update this afternoon to last week's health alert.

First, it was Greg Hill, then Tim Marsolan, now Richard Bise joins DA investigative team

 



I reported Greg Hill going over to the DA's office last year. This morning, I saw Timothy Marsolan who was here for the 9:15 preliminary hearing calendar on a case working with Deputy District Attorney Trent Timm. I just found out a few minutes ago that former EPD Detective Rick Bise who is currently a HCSO Deputy Sheriff and Courtroom 1 bailiff last day is May 24. After the Memorial Day weekend, on May 28, he will be DA Investigator Bise. The DA's office is lucky to have all of them. I hope they put that experience to good use.

Kreis to practice law starting May 28? Will Governor Newsom appoint April Van Dyke as interim judge this year?

 


I reported last month that in a court document Gregory Kreis claimed he will have no income starting 5/27/24. I also wrote about him renting a law office locally. Today, I heard he has atleast one family law client and will be practicing law effective 5/28/24. I checked his family law case. There has been no filing indicating a change in his income.

The Commission on Judicial Performance proceedings have not concluded. The California State Bar still lists him as a Judge. 

Michael Black gets arrested again for criminal threats, committing a felony while out on bail, probation violation and other charges

 


Michael Black posted bond and got himself arrested again by HCSO last night. Black was arrested again for PC 422 (a) criminal threats and PC 69 resisting arrest as well as PC 30305(a) felon in possession of ammunition, PC 1203.2(a) probation violation and PC 12022.1 committing a felony while out on bail. Bail for this recent arrest is $1 million. 

Black has another 2024 case which is already scheduled for trial.confirmation on 8/28 and jury trial on 9/9. Ms. Andrea Sullivan is representing him in that case.

Why is Gregory Kreis' fiancee Tanya Ellis, who still works in self help at Humboldt Superior Court serving papers in his divorce case? In a previous post, I have documents filed by Kreis in which he listed Ellis as his fiancee. He misspelled the word in the filing. How do we know this was not done while she is supposed to be working?

In my coverage of former HCSO Lt. Sam Williams, I made a reference about the political nature of this case and a reference to DA Investigator Steve Dunn. I have heard about Dunn's bias from more than one source. I wrote my observations about the court case before I saw this email yesterday and just my own knowledge of politics, law enforcement and the court system for decades.

DA adds trespass to CalPoly arrest for burglary and stalking

 


Broderick Brown was arrested on May 5 by Cal Poly Police for for PC 459/461(a) burglary and  PC 646.9 (a) stalking.

The DA charged Brown with PC 459 burglary, PC 646.9 (a) stalking and PC 602.5 (b) aggravated trespass. Alleged victims are Elizabeth and Tasha Babich.

He was arraigned on 5/8; had an OR/bail 5/10 and criminal proceedings were suspended about defense declared doubt about Brown's competency. Motion for release was denied. Brown is still in custody. Probable cause hearing is on 5/20. Dr. Rassti's report is due 6/10.

Former Lt. Sam Williams resigned yesterday

 


I did cover former Lt. Sam Williams criminal case but this post is not about his court case. Sam Williams resigned from HCSO yesterday.

On 5/13, there was a motion to modify probation filed by Deputy Public Defender David Celli. The 5/18 commit to jail date in Humboldt was vacated. Motion to modify granted. Williams will serve probation requirements in Utah.

The District Attorney's office has charged Frederick Breckenridge with PC 422 criminal threats, PC 76 (a) threatening a public official and PC 653 (m) (a) annoying phone calls. Alleged victim is First District Supervisor Rex Bohn.
