Sentencing was continued to January 16 for convicted sexual batterer Elhadji Ba to get a pre-sentence report. He was placed on three years of formal supervised probation. Jail time imposed was covered by 185 actual days in custody and 184 4019 credits.
On December 10, Ba entered a conditional plea based on a grant of probation and up to 369 days in jail.
Ba pleaded guilty to false imprisonment as a felony and battery as a misdemeanor.
If Ba complies with terms of probation for 12 months, his felony will be reduced to a misdemeanor.
Deputy District Attorney Stacey Eads is the prosecutor for this case. Deputy Conflict Counsel R.J. Leohner is Ba's attorney.
2/17/21: Deputy District Attorney David Moutrie appeared on the case for Ms. Eads. There was a 17 (b) motion by the defense to reduce the felony to a misdemeanor which the People did not object to. The 17 (b) motion was granted.
The People did object to probation being reduced to one year. Even though there has been a change in law, Mr. Moutrie told Judge Killoran that the agreement was for three years probation for the serious crime.
The defense motion for PC 1203.3 and 1203.4 was not granted.
