DA files petition to revoke Michael Acosta's probation
The last update I did on local attorney Michael Acosta's 2020 drug case was that he was planning to appeal, despite the fact that he and his co-defendant,Sarah Carroll got a plea deal. Since then she has been arrested for a hit and run and Acosta is representing her in the case.
This morning when I checked Acosta's case regarding the status of the appeal, I saw that a petition to revoke his probation was filed by the DA with no other details in-court or any court date. There was also a petition to revoke probation for Carroll in the 2020 case which is scheduled for pre-trial on the same day as her preliminary hearing for the hit and run case on December 28.

Ryan Helmer arrested on warrant for embezzlement and grand theft
Ryan Michael Helmer was arrested yesterday by Fortuna Police Department on a warrant for PC 503 embezzlement and PC 487(a) grand theft. He posted bond.

John Fullerton resigned from the Humboldt Audit Committee
On the agenda for the December 19, 2023 Board of Supervisors meeting, I noticed a vacancy on the Humboldt Audit Committee. Before I even clicked on the attachments, I knew it was John Fullerton. Just a feeling. I was correct.
Ginger is open and so far, I have only heard good reviews
Ginger did a soft opening and while at lunch, the restaurant was empty when I stopped by because they had just opened, I have seen a few cars in the parking lot at dinner. They don't have takeout menus so the waiter let me take photos. I did of the food but not the wine list. I spoke with 4 people who went there this week and every single person gave it a good review.

Media was told to hold off on advance notice and I did listen and post after 8:45. Those sirens you heard starting at 8:45 just as I was walking up to Target and all those law enforcement cars are for the annual Shop with a Cop at Target.
Sarah Carroll booked into custody after court appearance but posts bond
Local attorney Michael Acosta's partner, Sarah Carroll was arraigned for her hit and run arrest. Judge Lawrence Killoran set bail at $25,000. Despite opposition from Acosta, who I said would represent her and is her attorney in this case, Carroll was remanded into custody after court. She posted bond. There is an OR/bail hearing on 12/18. Preliminary hearing is on 12/28.
Man who molested cousin sentenced yesterday and booked into jail
After being sentenced yesterday to 6 years in prison, Christian Bautista-Ramirez was booked into the jail yesterday. It was a stipulated sentence with 5 out of 6 charges dismissed. That time is half the 12 year cap of what was agreed to in the plea. Probation was denied by Judge Kaleb Cockrum.
Deputy District Attorney Whitney Timm is the prosecutor. Ms. Andrea Sullivan is Ramirez's attorney.

Probation for Redway convicted sex offender guilty of possession of child porn, SM, 600 images and 9 cases?
Redway resident Matthias Wilberger resolved his case before preliminary hearing yesterday to both counts. He has to register as a sex offender for lifetime.
The plea is condtioned on probation which People oppose and will argue for prison at sentencing which is scheduled for 1/26/24.

Lassen County Judge Tony Mallery facing disciplinary action from CJP may retire
Lassen County Judge Tony Mallery is facing disciplinary action and may retire, according to a news article from the California Courts site.
"I just want to inform the Humboldt County residents that they have choices in this upcoming election."
I just received an email from Brian Roberts who is one of two challengers running against Second District Supervisor Michelle Bushnell. I was the first one to report on his candidacy.
"I just want to inform the Humboldt County residents that they have choices in this upcoming election," said Mr. Roberts.
"My commitment is 100% as I will shutter my Cannabis cultivation for four years while in office. I will be present at every meeting and not have any conflict of interest regarding cannabis." Full statement posted below.

"I can confirm that a tentative settlement agreement has been reached as to Judge Elvine-Kreis. The tentative settlement will have no impact on Mr. Kalin’s lawsuit against the County of Humboldt, Luke Brownfield and Marek Reavis"; settlement has yet to be finalized
I heard back from Rory Kalin's lawyer, Mr. Johnny Rundell who is a partner at Hershey Law Firm. Also see my post from yesterday about what I verified from e court, which LOCO could have easily done in a couple of minutes. LOCO's headline which I took a screenshot today, in case, they change it after this post was misleading. LOCO quoted Judge Gregory Kreis saying the suit has been settled yesterday. I don't trust LOCO's half baked reporting. As for Kreis' remarks yesterday, I leave it up to the readers to decide whether he said it, whether LOCO reported it accurately and what his next spin will be after this post. It isn't official until it is finalized and filed with the court. It hasn't. I already knew this because I checked on the case records twice this week.

Defense declares doubt about Root Birmisa's competency to stand trial
Since my last post on alleged molestor Root Birimisa, he had hearing today with defense declaring doubt about his competency to stand trial. Dr. Sidhu was appointed to evaluate Birimisa. The preliminary hearing scheduled for 1/9/24 has been vacated. There is a hearing on 1/11/24 for doctor's report.
