EPD checking nearby surveilance for Subway break in last night
Last night, there was a break in at the 4th Street Subway in Eureka. Eureka Police Department got surveilance from another business across the street.

On 9/29, there was a case Management Conference, demurrer and motion hearing sanctions requested by Rolling Meadow Ranch LLC. in the lawsuit filed by NorthCoast Environmental Center, Redwood Region Audobon Society and Citizens for SustainableHumboldt against County of Humboldt, Humboldt County Board of Supervisors and Rolling Meadow Ranch LLC.
18 year old arrested for possession and use of minor of child pornography
Elijah Faith Abigail Price was arrested by HCSO on a foreign warrant last night on charges of PC 182(a) (1) conspiracy, PC 311.11(c) (1) possession of child pornography and PC 311.4 (c) use or coerce a minor to appear in child pornography. The warrant was out of Del Norte County.

Until Judge Canning issues his ruling, the TRO against Brett Watson was extended to" remain in full force and effect"
After the conclusion of testimony in the lawsuit filed by City of Arcata against Brett Watson this week, Judge Timothy Canning said he would issue a written ruling which is expected by or before March 22.

Local attorney Victor Campos arrested by HCDTF
80 year old local attorney Victor Manuel Campos was arrested yesterday by Humboldt County Drug Task Force for HS 11366 operating or maintaining a drug house and HS 11351 possession of a controlled substance, fentanyl. Campos' bail is $35,000.
Kyle Andrae Cross was arrested by HCDTF at the same location for the same charges as Campos at the same time.
Cher-ae Heights robber faced a maximum of 15 years in prison, got sentenced to 3
Aubrey Ross who was convicted of robbing Cher-ae Heights robber was sentenced to three years in prison. His original exposure was 15 years in prison but that was before the verdict. For the robbery charge, he faced 5 years in prison. I covered the trial and verdict.
Ross has 105 custody credits. Judge Joyce Hinrichs ordered restitution for $181, 940 is to be paid to Cher-ae Heights Casino every month. The amount per month will be determined by the CDC.
Will the Court grant Michael Acosta represent himself again?
Today's trial setting in local attorney Michael Acosta and his co-defendant and partner Sarah Carroll's case was contiued to April 5. I had spoken with Acosta and he said he was going to ask to represent himself, again. Today, Acosta got another court appointed attorney, Ms. Rebecca Linkous. Acosta's Faretta motion was rejected on March 7 but he can resubmit it.

John Doe's older brother called and threatened me just now
I just got this email. So I called the number. This email was deceptive. The email address does not belong to the person who answered the cell phone and wanted to speak to me.
That person turned out to be "H", John Doe's older brother who cursed me out and threatened me and told me to take the post down about Benjamin Pesch.
Second judge denies J.D. Grow's motion, this makes 4 nos for 4 requests this year
For the second time, a judge denied J.D. Grow's 17 (b) motion to reduce the charge to a misdemeanor in his 2016 case. On March 2, the motion denied by Judge Steven Steward. The last time in January, it was Judge Kaleb Cockrum who denied the 17 (b) motion without prejudice.Judge Cockrum also denied Grow's request for expungement and dismissal.
Benjamin Pesch called law enforcement himself to report he may "have illegally touched a minor"
Another coach in Fortuna. This one calling law enforcement and admitting touching a minor on a baseball team he coached. John Doe's father and Benjamin Pesch used to be close friends. Pesch told HCSO there had been a similar incident with another minor.
70 year old convicted sex offender arrested by EPD for failure to register
Terrance Douglas Henegar was arrested yesterday for PC 290.013 (a) failure to register as a sex offender. This is a felony charge. He was released on O.R.
HSU case for false fire report and annoying 911 calls gets 12 month diversion
In December 2021, 21 year old Basir Ali Jama was arrested by HSU PD for PC 148.4(a), false fire alarm or false report of a fire. This is a felony and Jama was released on O.R.
The DA charged Jama with two counts of PC 653 x (a) making annoying 911 calls in one case and in another case with one count of PC 148.4(a), false fire alarm or false report of a fire and one count of PC 653 x (a) making annoying 911 calls.
On 7/27/22, Jama was given the opportunity for diversion. There is a 12 month diversion hearing and a motion to consolidate both cases on 7/27/23.

County fails to file response in lawsuit filed by Yurok Tribe employee
In February I reported on Yurok Tribe's Wellness Court Coordinator Pepper Lopez wrongful termination lawsuit against Humboldt County.
In my post last week were the court filings and allegations of retaliation as well as discrimination and harassment based on sex, gender identity, race, national origin and religion. On March 3, there was a case management conference.
