Two days in a row, missing jurors hold up Brian Daniels' trial

 

Prior to evidence starting in Brian Daniels jury trial, Judge Kelly Neel had told attorneys to have witnesses ready to go and no delays waiting. Deputy District Attorney Luke Bernthal has done an excellent job.

In August of 2019, Sarah Michelle Wentworth was arrested after she assaulted her mother and then barricaded herself in the residence on Harris.

Kyle Muhaw arraigned on 12 counts and served with a protective order

Kyle Muhaw was arraigned on 12 counts this afternoon, served with a protective order and the Public Defender's office was appointed to represent him.

Guilty, bail revoked, Chauvin remanded into custody

 

Guilty verdict on all charges. Bail revoked. Derek Chauvin cuffed and remanded into custody. I tweeted right after verdict was read and jurors were being individually polled. 

The attorneys have a week to submit documents on the Blakely factors and the Judge Peter Cahill also gave a deadline for the Pre Sentencing Investigation. Sentencing is in 8 weeks. Exact date will be announced in scheduling order.

Christopher Sovereign arrested for committing felonies while out on bail

On April 16, 2021, the Eureka Police Department’s Problem Oriented Policing Team (POP), with the assistance of the Humboldt County Drug Task Force, served a search warrant on Christopher Sovereign (30 of Eureka), his place of employment in Eureka, and an associated residence in Rio Dell.

Yurok Tribal member Taos Proctor killed in boating accident on Klamath

 

On April 15th 2021 at approximately 8 p.m., three boaters had their vessel overturn near the mouth of the Klamath River. One member of the boating party, Taos Proctor of Klamath, CA, was found deceased. The cause of the accident is under investigation.

Jason Smith trial resumed this morning with Judge Kaleb Cockrum hearing more motions in limine. The livestream was briefly offline at the request of Deputy District Attorney Trent Timm. This is for "1040/1042" evidence.

Just spoke with APD Chief Brian Ahearn. He told me the suspect is one of the three mentioned in the press release. 

1:41 p.m. Checked some of what the North Coast Journal article is reporting and attributing to Chief Ahearn. He told me the only person who died was at G street. So whether it is inaccurate reporting, attributing the wrong source or confusing writing, I am going to wait for an official update. 

Kyle Muhaw has an extradition warrant from Georgia and a no bail hold

 

Criminal threat suspect Kyle Muhaw is on a no bail hold. Besides his Humboldt charges, he has a warrant for extradition from Georgia.

After a Del Norte Superior Court Judge denied the motion to recuse Judge Kaleb Cockrum, he scheduled hearings on other motions.

Today, he ruled on several defense motions in the Jason Smith case. It took all morning and most of the afternoon. There were also more motions in limine.

Kidnapping, robbery and assault suspect Franklin Molina's jury trial has been vacated. As I indicated in my last post, a resolution was discussed. Molina accepted that offer at trial assignment.
