Some of Jevin Kitchen's statement today included what he said at the preliminary hearing. Most of the time he did not read from his written statement, he would glance at it sometimes, but he recalled memories as if he was in the moment.

Jevin's testimony at the preliminary hearing was heartbreaking; today Jevin's remarks were just as powerful. He referred to Marci Kitchen as Marci, not mom for most of his statement.

The only person supporting Marci Kitchen that has been respectful is her mom

This was Marci Kitchen's brief statement to Judge Kaleb Cockrum.

"All my life, all I wanted to be was a mom. But a mom doesn't kill her own child; injure her own child; leave her own child". She also made a reference to Faith Tsarnas.

Probation, 7 years 8 months is defense request for Marci Kitchen

Judge Kaleb Cockrum went over the letters he had received, statement of mitigation from Defense, statement of aggravation from Prosecution.

Defense brought up PC 654 that I wrote about yesterday. "If Court does not grant probation," said Ms. Meagan O'Connell, the defense in their initial statement argued for  7 years, 8 months.

Stephanie started her statement by giving Judge Cockrum the last picture she took of Faith. Then, holding up a box of ashes, she said, "This is how I brought my daughter back"

Will PC 654 impact Marci Kitchen's sentencing tomorrow?

Sentencing for Marci Kitchen is scheduled for tomorrow in Courtroom 1 at 8:30 a.m.

There is one California Penal Code that can impact Marci Kitchen 's sentence. That Penal Code is PC 654.

Penal Code 654 means you can't be punished twice for the same act in California.

Between 09/11/2018 and 09-13-2018, Officers with the Eureka Police Department have responded to approximately 25 reports of vandalism to vehicles.  A majority of the reported damage to the vehicles was tires being slashed, however some victims also reported paint damage.

Motion to increase bail, motion to examine source of bail as well as motion to amend complaint was scheduled for Ariel Sosa today.

As expected, alleged molestor Seng Yang could not afford a private attorney

Trial setting and status of retention private counsel was scheduled for alleged molestor Seng Yang this morning.

As expected, Yang could not afford a private attorney. The Public Defender's office was reappointed. Trial setting was continued for two weeks to October 1; Judge Dale Reinholtsen granted that request.

Yang is charged with 16 counts which include forcible rape of Jane Doe (his own daughter) and exhibiting a minor in pornography.  Jane Doe is the alleged victim for all counts.

Yang's jury trial has been delayed because he wants to see if he can retain private counsel.  Both  Public Defender Marek Reavis and Deputy District Attorney Stacey Eads raised the issue at the last hearing whether Yang can afford to retain a private attorney.

Stipulated sentence of 16 years for Mario Nunez and Joe Olivo in the Jesus Garcia homicide case

Joe Olivo Jr and Mario Nunez are scheduled to be sentenced on September 17 for the death if Jesus Garcia.

Mario Nunez and Joe Olivo Jr entered a guilty plea on August 29 to the amended charge of voluntary manslaughter, PC 192 (a) and amended gang enhancement PC 186.22 (b) for a stipulated sentence of 16 years.
