$100,000 bail set for all three suspects arrested so far in alleged home invasion

On Saturday, April 15, 2017 at about 10:12 a.m. Humboldt County Sheriff Deputies responded to a residence on Dyerville Loop, in Myers Flat for a report of a gunshot victim and possible home invasion robbery.  The victim told deputies that he was met by numerous individuals at his residence and an argument ensued. The victim was hit in the back of the head by one of the individuals and was shot when he attempted to flee. The victim was transported to a local hospital for treatment.


Two burglary suspects arrested by HCSO; one fled in response to a call on Herrick Avenue


On Saturday, April 15, 2017 at about 7:36 a.m. Humboldt County Sheriff Deputies responded to a residence on Herrick Avenue for a report of a burglary.  As deputies arrived, an eyewitness advised the suspects were still on scene and getting into a vehicle. Deputies approached the residence and the suspect vehicle quickly exited the driveway and drove westbound on to Herrick Avenue.

23 year old Mckinleyville resident arrested for alleged stabbing of HSU student


On April 15th, 2017 at approximately 3:00 am, officers from the Arcata Police Department responded to the 1100 Block of Spear Ave on the report of a stabbing. 
  
When officers arrived, they found a male victim bleeding from multiple stab wounds. Officers immediately began life saving efforts. The man was eventually transported to Mad River Hospital where he succumbed to his injuries.
The assault occurred as the result of an argument at the party.
The identity of the deceased, a 19-year-old male HSU student, will not be released until appropriate notifications have been made.  
A 23 year old McKinleyville resident, has been taken into custody related to the incident.

Off duty APD police officer stabbed to death last night? Followup indicates HSU student stabbed


I just got a tip from a source that an off duty APD police officer was stabbed to death while trying to break up a party last night.

I have contacted APD. There was a stabbing but not of a police officer; but a HSU student.

9:40 Heard from Sgt. Dokweiler :That would not be true. There was a stabbing last night but no law enforcement personnel were involved."

Also spoke with Sgt. Brian Hoffman. No new information other than what has already been released. APD is investigating the case and will release more information as able.

While APD and HSU have not released the name of the victim, a GoFund Me page set up to help the family with funeral expenses was first listed by Channel 3 and then LOCO, on April 16. The GoFundMe pagr names the alleged victim as David Lawson, a sophomore at HSU, who was studying criminal justice.

Jail reports from the weekend identify Kyle Christopher Zoellner as a suspect arrested early hours of Saturday and charged with murder. APD has not released the name of the suspect.

The only interviewed is Brandie Wilson from Humboldt Area Center for Harm Reduction Center. There was no comment from DHHS, a Eureka City Council member or a Humboldt County Supervisor.

In Humboldt Hill,  a man showed up at a house, no shirt, black pants, told reporting party, they would be shot at.

Then left, headed towards Eureka? Possibly open door from an alley is how access was gained?

A more current description of Trystan Lewis from someone in law enforcement, familiar with him.

On April 14, 2017 at approximately 8:40 AM, an Officer with the Fortuna Police Department observed 18 year old, Trystan Issac Lewis driving a 1993 Blue Honda Civic that had been stolen on 4/13/2017. Lewis is currently wanted for two outstanding Felony warrants for weapons possession. 

22 year old Brandon Bemis convicted of sexual abuse of a five year old Fortuna girl



Humboldt County District Attorney Maggie Fleming announced that today a jury convicted 22-year-old Brandon Bemis of felony sexual abuse of a child in violation of California Penal Code section 288(a).
The trial provided evidence that the defendant engaged in sexually motivated touching of a 5-year-old girl in his Fortuna home. The jury heard testimony from Jane Doe, now 6 years old, who was accompanied by her father to the witness stand. 

Attorney Patrik Griego files an amended petition against County of Humboldt seeking attorney fees, cost of lawsuit and declaring current hiring practices as unlawful

Attorney Patrik Griego file an amended petition today in his lawsuit against the County of Humboldt.

The petition names individuals who are listed as citizens, taxpayers and current as well as future clients of the Public Defender office.

The petition states that the County hire a qualified Public Defender who meets the requirements according to Government Code 27701,  that the County of Humboldt hiring practices are unlawful as they exist and asks that the Court award costs of lawsuits and attorney fees and any witness or consultant fees.

Mr. Griego also told me that a request has been made but Mr. Marcus is refusing to turn over his prior employment records.

EPD arrests Alvin Wingo on HCSO Most Wanted list after a tip



On April 13, 2017, at about 8:14 p.m., officers with the Eureka Police Department received information from the Humboldt County Sheriff's Office that Alvin Wingo was sitting inside a parked Chevrolet in the Bayshore Mall parking lot on the 3300 block of Broadway.  Wingo was on the HCSO Most Wanted list for felony warrants and was reportedly armed with a firearm.  

"Being tossed around between six different attorneys over in a 10 month period" doesn't seem to be enough for a Marsden motion

Marsden motion was denied and Public Defender David Marcus is still representing Miles Eastman.

Mr. Eastman spoke with me after court. Mr. Eastman's reasons for the Marsden motion were "absency and no communication."

His issue wasn't specifically with Mr. Marcus but against all assigned to represent him in the Public Defender office. "Being tossed around between six different attorneys over in a 10 month period" doesn't seem to be enough for a Marsden motion.


Nicholas Leigl jury trial continued to June 5, 995 motion on April 26

Nicholas Leigl, one of four suspects, charged in the homicide case of Jesus Garcia had a jury trial scheduled for April 17.

Jury trial was continued to June 5. Trial confirmation to May 24. A 995 motion is scheduled for April 26.

Jury trial for Polish citizen charged with death of baby vacated

Jury trial for Eva Misztal was scheduled for April 17. That was vacated. Trial setting 10:15 on May 9.

At trial assignment this morning, defense made motion to continue based on several reasons including discovery, unavailability of expert. People.

Deputy DA Brie Bennett is prosecuting this case. Deputy Public Defender Casey Russo is representing Misztal.
