Preliminary hearing for Seng Yang was scheduled for May 9. Original time estimate was 4 hours. That time estimate was changed to 6 hours.
Seng Yang is charged with 10 felony counts. Charges include rape of a child including forcible oral copulation, sexual intercourse, sodomy, distribution of child pornography and knowingly employing or coercing a minor to participate in the production of child porn.
Alleged victim Jane Doe.
About 11, including people Jane Doe were present for court for the first time today. Those 11 people, Victim Witness, two DA CAST investigators, EPD Detective Ron Harpham and I waited outside Courtroom 1 for an hour and a half while attorneys met with Judge John Feeney in a closed courtroom.
Judge Christopher Wilson sent the case over to Courtroom 1 for the preliminary hearing. First, the attorneys talked, then Public Defender Marek Reavis went into a closed courtroom to speak with Yang while Deputy District Attorney Stacey Eads spoke with Jane Doe. Then, the attorneys were inside. Mr. Reavis came and got the certified court interpreter, Mr. Alee Elong Ly. He traveled from Sacramento for this hearing. After that, it still took 45 minutes for the courtroom to be open to the public.
When the courtroom finally opened, Mr. Reavis told Judge John Feeney that the defense was making a motion to continue.
The reason given by Mr. Reavis was that, "so our (defense and prosecution ) negotiations can continue and Ms. Eads can speak with the complaining witness and her family."
The People did not object. Ms. Eads said there is electronic evidence that is controlled and protected and was made available to Mr. Reavis to review.
If the case does not resolve, witnesses for the People will include EPD Detective Ron Harpham and Jane Doe.
Deputy Public Defender Ben McLaughlin had been representing Yang. Now, Public Defender Marek Reavis is Yang's attorney.
