This morning, Visiting Judge Arvid Johnson was ready to hear a 995 motion in the John Beideman alleged sexual molestation case.
Mr. Russ Clanton asked that the motion be put over to next week since he received the DA's response to his motion yesterday afternoon. For now it is scheduled in Courtroom 2 at 8:30 a.m. on April 10.
Mr. Clanton wants to file a response to the DA's opposition to his motion.
The defense is requesting all charges except Count 2 be dismissed. The alleged victim is Beideman's former stepdaughter.
The defense is asking the "Court to dismiss Counts One, Two, Four and Five for insufficient evidence; Count 6 as duplicative of Count 5; and Counts Seven and Eight as time barred."
Deputy District Attorney Stacey Eads is prosecuting the case. Today, Deputy DA Joel Buckingham was in court for the People.
Mr. Russ Clanton is representing Beideman.
Jane Doe's current stepfather was in court today with a victim witness representative.
Trial confirmation is still scheduled for April 5. Jury trial is scheduled for April 23.
