DA Maggie Fleming watched Deputy DA's initial closing argument, wonder what she thought?


In the shortest closing I have ever heard, all of 40 minutes, Deputy District Attorney Luke Bernthal gave the worst closing argument; and this is a homicide case.

Mr. Bernthal is not feeling well today but his entire presentation of this case has been lackluster; today was no different.

Will Mr. Bernthal use his rebuttal to try and prop up what he could not achieve during the presentation of his case?

When you spend your initial closing argument mentioning the defense, telling the jury what to think, passing off opinions as law, reading CALCRIM jury instructions with no specific examples of how evidence or testimony proved your case, that says it all.

Usually, rebuttals are short. The prosecution makes their case in their initial closing argument.

Deputy Public Defender Casey Russo is going to give his closing in a few minutes.

  1. Closing Arguments in Fiore started on a Thursday rolled over to a Friday and I concluded on a Monday. That was an 8 week trial.
