"We have been in this hearing for five days and there hasn't been a single bit of evidence that Mr. Zoellner had a knife and even stabbed anybody."


"There have been so many assumptions in this case from the very first witnesses; Paris Wright, Elijah Chandler," said Deputy Public Defender Luke Brownfield. "Everyone is assuming Kyle stabbed Josiah. The police department is doing an investigation with one assumption; that Mr. Zoellner stabbed Josiah. The DA's office gets a case and charges it based on assumptions"

"Almost everyone else's testimony contradicts what Mr. Wright said. His own BU brother Keaundrey Clark was kicked out; probably for testifying truthfully."

"Mr. Clark said that he sees a large group of people savagely beating Mr. Zoellner."

"Even if you take Mr. Wright's testimony to be true, it cannot possibly match the physical evidence. Not a single ounce of blood was found in the grass where the stabbing took place."

"If you look at the physical evidence," (it shows) "that Mr. Zoellner did not do this stabbing."

"I understand that this is a probable cause hearing and burden of proof is lower. It is a burden of proof that has to have some teeth."

"This is a 10 inch knife and the DA wants you to assume that Kyle Zoellner, sober with keys and cell phones in his hand, walked into a party to fight with a ten inch knife, got beat up 3 to 1, never pulled a knife. The knife never fell down. He never got injured with a 10 inch knife in his pocket?

"In fact, all evidence points someone else did the stabbing. I don't know who stabbed Josiah. I hope we find out. But the Court should not hold Kyle. The Court should follow the law and ask the prosecution to continue investigating and find out whose fingerprint that is, whose fiber, talk to all witnesses no one has. Then we may find the person who stabbed Josiah. But it is not Mr. Zoellner."

  1. I hope Kyle sues the hell out of the county for this. From what I see, he is just as much a victim as Josiah. I also hope Paris Wrights has assault charges brought against him. They have drug this poor kid through the mud all on assumption. Kyle's life has been turned upside and down and it's not over yet. When he gets out, do you think he's going to go right back to life as if nothing has happened? Nope. He's going to have people staring, making comments, threats, etc all because of this. He's not going to get to live a normal life for some time. We have city officials apologizing and stating we have failed but they don't even have the facts. The fact is and I hate to speak ill of the dead, but Josiah was no innocent good citizen that they are painting him to be. His Facebook is plastered with people fighting each other, black people doing white face, making comments that he "hates fucking pigs", etc. Were there good qualities about Josiah, probably. Did he deserve to die, absolutely not. Josiah's family deserves justice, they are not going to find that justice in Kyle because he didn't do it. The BU claims that Josiah's mom gained 15 sons, well those 15 sons better start coming forward so his family can have justice. No parent should have to bury their child and no parent should have to sit in a court room and hear of the brutal attack that their child went through.

    We read that the fingerprint found on the knife wasn't Zoellner's - then whose fingerprint is it. Have the investigators said theya are still working on that? Thanks very much...gina

  4. Nobody saw a 10-inch knife? Did it match Zoellner's chef knife set with the missing knife - we suppose not - or the judge would have put two and two together.

    1. If you look at John's 10:02 post, the "missing knife" was found in the bag by the officer after a hint by defense counsel. If you look at the 6:10 post from yesterday, the knife was not one of Zoellner's work knives, according to his boss.

  5. Here's what I think happened.... Fight broke out, someone went inside and said there was a fight. Someone grabs a knife because words BU live by, "Brothers before others" There's a tussle and someone thinking they're going to help Josiah and stab Kyle but they stab Josiah by mistake. Now they don't want to come forward.

    1. Agree. A 10" kitchen knife is not the kind of weapon you carry around. It's the kind of weapon you grab impulsively. Wonder if anyone's checked the party house to see if it's part of a set?
