Prop 47 affected all of California but state grants only deem certain counties worthy of dollars

Humboldt not on the list for either grant.

We pay taxes, we suffer the consequences but we are not good enough for the state to give money for a problem the state lawmakers created.

SACRAMENTO (June 8, 2017) – Grant awards from a voter initiative that reduces from felonies to misdemeanors certain low-level crimes and directs state savings to rehabilitative programs received approval today from the Board of State and Community Corrections.

Arcata City Council approves community reward fund for information leading to arrest and conviction in the David Lawson case


At its meeting on Wednesday evening, the Arcata City Council approved a community reward program for information leading to the arrest and conviction of the person responsible for the April 15 homicide of David Josiah Lawson. Community members have donated $21,000 to establish the fund. According to Arcata Police Chief Tom Chapman, the APD has had success with reward programs in the past and will continue to accept funds for the Lawson case reward.

"The issue we have had since the beginning is that many public officials and others have painted a picture that Kyle was in a fight at the party which is false."

There was no fight.  What actually took place was a group of men beat Kyle up and Kyle never had a chance to defend himself.  Once everyone realizes that a "fight" did not take place but an assault & battery did take place, people will be asking the same question we are; why has the DA not filed charges against the men that beat Kyle up?"

In November 2013, defendant Brice Lee McKinnon was sentenced to 80 months in state prison following his conviction on five counts of arson.

Moving forward from 2013 to 2017, McKinnon was released from state prison on January 26, 2017 subject to local parole supervision.

No, we were not aware he was being investigated.  His fingerprints were on file with the CA DOJ and we received the arrest record as soon as he was arrested.  Prior to his arrest, he had no records of felony or misdemeanor charges.  We checked, as we do with all employees,  Your help in dispelling this nonfactual information is appreciated."

A follow up letter to Humboldt media from local NAACP media coordinator

I am the Media Coordinator of the Eureka Branch of the NAACP. As one of the members of the executive board, I'd like to clarify a few things. In the wake of the recent murder of HSU student, David Josiah Lawson, the presence of vitriolic speech has become most prevalent on some of our local media outlets. The majority of the executive board collectively drafted a letter asking media organizations to examine and possibly change their policies related to the comment sections on their websites, social media pages, etc.

APD is asking witnesses to come forward, "that is not happening."

APD sends supplemental police report to DA who will decide if charges will be filed against Castillo brothers and Paris Wright


According to Kyle Zoellner's uncle Jay Zoellner, APD Sgt. Detective Todd Dockweiler  met with Kyle Zoellner's father today. Detective Dokweiler made the decision to send a supplemental police report to the District Attorney.  The DA's office will decide whether to file charges against the Castillo brothers and Paris Wright for assault and battery on Kyle Zoellner.


If Chief Andy Mills leaves EPD, will his replacement be Captain Brian Stephens?

Eureka Chief Andy Mills has not officially resigned from EPD.  He has been offered a job with the Santa Cruz police department.
The offer is tentative, pending background check.

They harassed APD on the night Josiah was fighting for his life and APD was trying to administer life saving efforts. They harassed the Zoellner family and friends at the courthouse.

Eric Lively to be arraigned tomorrow on one count of murder


Eric Lively arraignment on information scheduled for June 8 at 8:30 a.m.. Charge for the jury trial is the same as the preliminary hearing; one count of murder. Lively is charged with the death of Jesse Simpson.

Jury trial scheduled for July 31. Lively is represented by Mr. Russ Clanton. Deputy District Attorney Adrian Kamada is prosecuting this case.

Sohum upskirting suspect yet to appear in court, even once, defense to file the nth motion to continue jury trial

Trial confirmation for David Nunez, the Sohum upskirting suspect, was scheduled for this afternoon at 1:30 in Courtroom 5.

Ms. Kathleen Bryson made a special appearance for Nunez's attorney. She asked for a further date on 6/14 when Mr. William Dubois will be in town. Mr. Dubois plans  file a motion to continue the trial date.

The case is being prosecuted by Deputy District Attorney Whitney Barnes. Nunez is represented by Mr. William Du Bois.

 "The federal government is getting ready to update its flood maps, and you may soon be required to purchase flood insurance for the first time. However, if you are one of the more than 200 citizens in Humboldt County who will be affected by these changes, you may have a few weeks to lock in lower rates with your insurance company."

Is this letter even legit? Yes. I checked with Liz Smith, Humboldt NAACP President.

This is what she refused to sign, calling it a "media check" and proposed other solutions.

Why has no other media published this? Was it even sent to them?

Chad Smith's bail reset to two million, six hundred and fifty thousand; preliminary at June 15


Chad Smith's bail was reset to two million, six hundred and fifty thousand in court today.  Judge John Feeney initially set it at 1 million, but reset it after arguments presented by Deputy District Attorney Stacey Eads.

Chad Smith to be arraigned on 13 counts today including lewd and lascivious acts upon a child and intentional violation of a protective order

Chad Alan Smith, is charged by the District Attorney's office with 13 counts with several special allegations.

Counts 1 and 2 are PC 288.7 (b) Oral copulation or penetration with a child who was 10 years of age or younger. Alleged victim Jane Doe #1.

Making threats of filing a lawsuit seems easy in the heat of the moment. Then going ahead and filing one just because you can is stupid.

Proving a claim in court requires an understanding of law. In cases of threats, harassment and verbal abuse and grandiose but delusional opinions, especially in the comment section of any media source requires an understanding of reporting and journalism.

Tina Sampay requests dismissal of her "day in court with me"

On June 5, when my attorney's office tried to file a response, the clerk told them the matter had been dismissed on June 2. A hand-delivered copy of this dismissal without prejudice, which was requested by Tina Sampay, on June 2 was hand delivered to my attorney's office today at 4:30 p.m. On the dismissal, it says attorney was notified on June 2.

Restraining order granted against Chad Smith in his pending divorce case

There is one Family Law Case, which currently has a pre-trial on June 13, in which A. Smith has filed for dissolution of marriage with minor child. A. Smith is represented by attorney S. Brenda Morgan.

There is a CWS subpoena filed by a Jamie Kuntz on April 3. A restraining order requested by A. Smith was served on Chad Smith 5/15/17 and is set to expire on 6/19/17.

No resolution, then resolution, Nicholas Leigl pleads out in the Jesus Garcia homicide case

I was the only media present Friday for trial assignment for Nicholas Leigl.

They were waiting to see what courtroom he was assigned to so I left. He was also on the court calendar for today, as listed in the post below, as of Friday evening.

However, Leigl ended up pleading on Friday. Just found out. No other media was in court at that time either.

Leigl plead no contest to an added Count 3 PC 186.22 (a), according to the DA's office. Sentencing on December 14, 2017.

Count 2 and the special allegation for Count 2 was dismissed.

Joshua David Grow total bail was 35,000; attorney is Ben Okin; preliminary yet to be held

Another PC 288 charge involving a minor female and a local businessman; more charges expected


Back in December 2016, this was a statement prepared by HCSO Deputy Scott Aponte. I have cropped the original document as it listed the alleged victim's residence.

Joshua David Grow was arrested by HCSO for PC 288(c) (1) on January 23, 2017 at 9 p.m. Arraignment was 2/24. Grow entered a not guilty plea.
