Judge Wilson orders Public Defender David Marcus to be in court tomorrow

Alex Simpson will be returning to court tomorrow at 9:15 after Judge Christopher Wilson ordered Public Defender David Marcus to be in court for Simpson's Marsden motion.

Usually, the attorney representing the client is present for the Marsden motion. In Simpson's case, he has had six Deputy Public Defenders. This has resulted in some issues including Simpson having to take time off to be in court,



While this has been brought up in  court before, and observed more than a few times by media and others, today Judge Wilson's valid irritation and frustration with the Public Defender's office elicited smirks by media, community and deputy public defenders present in Courtroom 5.

Certain court dates are having to get rescheduled because people cannot get in to see their Deputy Public Defenders, more people are asking for more Marsden motions then usual, cases having to be rescheduled because the client has had anywhere from four to six public defenders and the Judge giving early resultion fines in at least two cases today; one for was Danielle Egger who plead no contest to probation violation and other cases.

I wrote about another case, a while back.

Regardless of Judge Marjorie Carter's ruling on December 13, the Humboldt County Board of Supervisors are choosing to ignore the mismanagement of that office and cost to taxpayers since they hired Mr. Marcus. Reduction of fines, continuances of in custody cases, all this costs taxpayers.
